LAZ unhappy with proposed constitution enactment mode

The Law Association of Zambia (LAZ) says it is disheartened with the recent statement by the government proposing the mode of adopting the new Constitution with the exception of the Bill of Rights and Article 79 through parliament.

LAZ President George Chisanga says the development is most disturbing as it comes against the backdrop of government having recently suggested that it would take to parliament what is termed non-contentious clauses of the draft constitution for enactment.

The LAZ president said this in statement released to ZANIS in Lusaka this evening on the proposed mode of enacting the new constitution through parliament.

Mr. Chisanga said LAZ is acting with other stakeholders in the demand for a people driven constitution who have repeatedly called for the creation of a legal framework to protect both the content and process necessary for enacting a people driven constitution.

He added that the PF government is for the first time attempting to introduce a completely new constitution order which will change Zambia by sending the entire final draft constitution to parliament.

He further said government has spent colossal amounts of money on the constitution making process and has since called upon all Zambians and stakeholders to hold government accountable to its promise in this important process.

Mr Chisanga said government should act in good faith and enact the entire Constitution through the national referendum.

  1. LAZ President, you are making a fictitious political argument & not a legal one. How can this be a betrayal of trust when GRZ is sponsoring the Bill which has been approved by both President and Cabinet? Have you ever heard of the role of the Chief Whip who ensures that GRZ policy receives full support in Parlaiment? Have you heard any ruling party MP say they do not agree with this GRZ policy? Do you even know that a valid Constitution will be the outcome of this process? Have you not received a copy of the Bill? Is it not setting out the same contents approved by the technical committee? Isn’t it more noble to lobby all MPs to vote for this Bill representing good law? LAZ PRESIDENT, YOU ARE NOT SPEAKING FOR LAZ/ZAMBIA IN YOUR STATEMENT BUT BETRAYING YOUR SECRET POLITICAL ALLEGIANCE!
