Girlfriend killer to hang

A 35-YEAR-OLD man of Kalulushi, who killed his girlfriend, has been condemned to hang by the neck until pronounced dead by Kitwe High Court judge Isaac Kamwendo.
Mr Justice Kamwendo handed down the sentence against Given Sinkala of house number 71, Chifulwe Lane in Kalulushi, who was facing one count of murder.
Particulars of the offence are that on January 13, 2015, Sinkala murdered Esther Phiri.
In his judgement on Wednesday, Mr Justice Kamwendo said there was overwhelming evidence that Sinkala murdered Esther and that he found him guilty as charged and was convicting him accordingly.
“I sentence you to death by hanging until you are pronounced dead by a medical practitioner. And if you are not happy with what I have done, you can appeal to the Supreme Court within 14 days,” Judge Kamwendo said.
During trial, Jane Phiri, the deceased’s elder sister, testified that on the fateful night, around 22:30 hours, she was with the deceased at home at a time when they had a funeral.
She said Sinkala then called Esther on the phone requesting her to see him, and that is how she left the funeral house.
Jane said Esther did not return home that night, and the following morning, she received information that her sister was found dead on the road.
The court heard that when Jane and other family members went to the crime scene, they found Esther lying in a pool of blood.
The matter was later reported to the police, and Sinkala who was a prime suspect, was charged and arrested for murder.

  1. This sentence has never been carried out in practice. The judges love to make themselves sound like the tough guy when handing these stupid sentences. What a mockery to the relatives of the victim!

    • He is innocent maybe. It is possible someone at the funeral could have done the gruesome act due to jealous. It is 50:50. It shouldn’t mean that because he went to see her then he killed her without any investigation of some sort.

  2. Hmm……….. did anyone witnesses the murder? If not. Sentencing someone to hang until pronounced dead without proof that he killed is not right!!!
    It’s possible that the murdered girl met her horrible fate on her way to see the accused.

  3. ..3 and 5.exactly my thots…..unlss we hae not been told in detail the available evidence…if it is as reported in this article….even Wynter Kabimba can manage to win this case or atleast get a lesser sentence

    • Is that how low you think of me sure bwana? I however agree with you that the evidence is circumstantial. Or maybe the has not given the full details of the case.

  4. The explanation is not clear here. There are a lot of questions here. For how long did she see her boy friend. where did they go from there? Did her boyfriend leave her somewhere. Could she have been attacked by other people after parting company with the boy friend. What has the boy friend has to say??? The problem we have in Zambia is that our policemen are not forensic experts. Their only jobs is to harass the opposition parties and people selling marijuana. Please ba police let us carry out a forensic investigation before we hang an innocent person. He could be guilty but from the vague explanation given it cast more doubts that answers.
