Zambia lose Guinea Bissau player case

Zambia has lost its appeal against Guinea Bissau over the latter’s alleged use of an ineligible player in the two sides 2017 Africa Cup Group E qualifier three months ago.

FAZ filed a complaint that the player goalkeeper Papa Massa Mbaye is alleged to be of Senegalese extract and has been capped by the nation of his birth.

CAF however, states that the Senegal-born Mbaye qualifies to play for Guinea Bissau because one of grandmothers’ hails from the ex-Portuguese colony and he has been a resident of that country from the age of 18 since 2009 despite a career that took him to Germany and Spain.

CAF added that Mbaye’s passport issued on June 1, just three days before Guinea Bissau beat Zambia 3-2 to seal their debut Africa Cup qualification, is legally binding.

Below is the CAF’s organizing committee of the Africa Cup of Nations full decision:

“1. In relation to the passport copies, ID cards, and other official documentation received for the player, the relevant authorities of the Republic of Guinea Bissau issued those documents. Hence CAF cannot dispute their authenticity.

2. The fact that the passport was issued on 1 June 2016, few days prior to the match played on 4 June 2016 against Zambia, does not change its validity.

3. In relation to the articles of the Regulations Governing the Application of the Statutes, article 6 does not apply in this case, since the player was never registered with the Senegal FA, hence this case is not about a change of association.

4. In relation to article 7 of the application of the Regulations Governing the Application of the Statutes which is about Acquisition of a new nationality and states: “Any player who refers to art. 5 par.1 to assume a new nationality and who has not played international football in accordance with art. 5 par.2 shall be eligible to play for the new representative team only if he fulfils one of the following conditions:
a) He was born on the territory of the relevant association;
b) His biological mother or biological father was born on the territory of the relevant association;
c) His grandmother or grandfather was born on the territory of the relevant association;
d) He has lived continuously for at least five years after reaching the age of 18 on the territory of the relevant association”.

The Committee established that the player does not fulfil criteria 7.a), and 7.b) above, since Guinea Bissau FA itself recognized that the player was born in Dakar, and that his parents were not born in Guinea Bissau.

“In terms of the clause 7.d), it requires that the player must have lived continuously for at least five years after reaching the age of 18 on the territory of the relevant association. The player has been resident in Guinea Bissau since April 2009, but he did play football abroad in Spain and Germany since then.

“In terms of clause 7.c), the Committee believes that Guinea Bissau FA fulfils this requirement since they have established that one of the grandmothers of the player,
Ngone Kane Diouf is from Guinea Bissau.

“Based on the above elements, the Organizing Committee considers that the player has fulfilled the obligation of article 7.c) of the Regulations Governing the Application of the Statutes, and that the player is deemed eligible. Consequently, the result of the match played versus Zambia on 4 June 2016 stands”.

  1. Who the fuuuuck filed a case from those FAZ cadres? Instead of winning just clean and clear, FAZ want to take advantage of something, just compare Under 17 scandle.

  2. Zambians don’t learn. Did you expect to win this petition?? All petitions against west Africa or francophone teams always fail. cAF is biased. Just win football on the pitch not in boardrooms

    Chishimba Kambwili has been admitted to the Intensive care unit (ICU) at Ndola Central Hospital. The Ndola DC says government has ordered that he gets no visits and the story must not break to the media.
    He was rushed to Ndola central shortly before lunch yesterday after he appeared on Sun FM where he spent hours insulting the UPND and its leaders . They are saying he has developed a combination of BP and sugar although a doctor at Ndola central said he has a heart complication as well.
    ZAF are trying to work with Flying Doctors Services to evacuate him to Lusaka and later SA.

  4. If they won this issue would not have arisen. They should have petitioned as soon as the lineup was announced. The game is won on the pitch, rarely in boardrooms. Remember this all the time.

  5. I for one while being Zambian and wanting to see Zambia excel do completely support the position and finding of CAF. I find it embarrassing that Zambia would want to get points out of the match on technicalities when they had every opportunity to get the full 3 points out of the match on the pitch. How embarrassing is it that we would want to qualify on the basis of the citizenship categorisation of one’s grandparent.!! Sha!!!!

  6. Chalk this up as another loss for the current administration. As some point, they need to start producing positive results. Maybe they just need to crawl back to Kalusha & Renard and ask them to come back.
