Mwaliteta, 4 others plead not guilty to aggravated robbery charges

Former Lusaka Province Minister Obvious Mwaliteta and four UPND members have pleaded not guilty to two counts of aggravated robbery.

Particulars of the offence are that in count one Mwaliteta and the four UPND members on 14th August 2016 in Lusaka jointly and whilst acting together stole a handbag and k350 from Elina Nyirenda and used force to overcome the victim.

And in count two the accused stole a black berry phone valued at K4000 from Emmanuel Simbeye in Lusaka.

And Defence lawyers this morning rejected an attempt by the Director of Public Prosecutions to include a third count on the indictment accusing the office of wanting to sneak in the third count.

Defence Lawyer Keith Mweemba argued that it would be unconstitutional for the DPP to include a third count when the accused persons were arrested for two counts of aggravated robbery.

Judge Bowa said he will make a ruling on the inclusion of the third count by the DPP on Monday 12th December 2016.

The Judge has set 12th and 13th December 2016 as date for commencement of trial.

And the court will on 7th December 2016 hear Mr. Mwaliteta’s constitutional bail application.

    • @muntu wandi, you must be a serious blind follower. Mwaliteta commited a crime which carries a very serious sentence if convicted. By the time you are done being blind, you will not know the difference between hh and God or UPND and whichever church you go to.

  4. Mwaliteta and others were simply trying to protect their votes.PF just wanted to torture them. And I think they have been tortured enough, not so? There’s no way a man of Mwaliteta’s status could involve himself in aggravated robbery. It is total rubbish. You managed to steal the votes, so leave those heroes alone.

  8. For the 1st time in Zambian politics we have experienced such inhuman behavior towards each other. I accepted the guy who said Lungu is a sadistic cruel human being.
    Those who claim to be Christian, because Lungu uses the word Christ or anybody who pronounces the word Christ, is a Christian?
    Kaunda through out his reign he was praying, praising in public the name Jesus Christ. When people starved to death was when they realized that KK was a satanist.
    Lungu leave Mwaliteta alone , you committed crimes while Mwaliteta was preventing those crimes.

    • @Washington square, no body died of starvation under KAUNDA. In fact malnutrition quadrupled when MMD came to power because massive job losses and high food prices.

  10. Rumor has it that most of those MVT branded in a well known violent Party and registered something 2016 were actually stolen MVs either from individuals or GVT. A number of them also had no number plates and may still be rolling the streets without number plates, Road Tax, Insurance and Fitness.
    Please let justice prevail and don’t let Criminals hide under the guise of ‘Cadre’.

  12. Does any one know the truth about mwaliteta’s arrest,aggregated robbery trying to steal votes but today we ar told he wanted to steal a b/bery phone worth K4000,he wanted to steal a hand bag,what the hell
    How can the whole lot of the minister lower him self to a common K350.I can’t buy such stupid story,just leave innocent souls free.
