Incarceration of HH shows how organs of Government can be abused -Nevers Mumba

Movement for Multi-Party Democracy (MMD) President Nevers says the incarceration of UPND leader Hakainde Hichilema brought divisions to the fore and scars which Zambians must strive to heal.

In a statement to the media today, Dr. Mumba said the incarceration of Mr. Hichilema and others only exposed how organs of Government can be abused to carry out political vengeance through what he deemed as bogus prosecutions on trumped up charges by those entrusted with power by the people.

Dr. Mumba says the Amnesty Southern African representative correctly observed when he said, “Persecution by prosecution is the hallmark of the Patriotic Front (PF)’s strategy to disadvantage all those that are politically opposed to it.

Dr. Mumba notes that just a few days ago former Lusaka Province Minister Obvious Mwaliteta was cleared by the courts of law, after being locked away in jail for year for the crime that never existed.

Dr. Mumba says this is a proof that the law enforcement require and urgent surgical restructuring in order to meet the required standards that will meet the true aspirations of every citizen, rich or poor regardless of gender, religion or political persuasion.

“Our Police are supposed to be the guardian and the backbone of our society and must always endeavour to give out the best and always be ready to stand in defence of the persecuted and the weak”

“This noble task of law enforcement is a core asset that must profoundly define our character as a Nation and as a people with shared values and a common destiny.”

“We regret to note that from the beginning of Mr Hichelama’s traumatic and State sponsored persecution, it was all clear that he was innocent and that the whole process had been designed to humiliate, break and torment a citizen whose only ‘offense’, was to aspire to run for public office which is his fundamental right enshrined in the constitution of Zambia”

“We call upon all our fellow citizens to pause and collectively search our inner beings honestly and truly. Did Hakainde a decent family man and law abiding citizen, deserve this inhuman treatment? Did Hichilema who always diligently and dutifully availed himself to any Police station, across the Republic once summoned even by a mere constable, deserve an entire battalion of masked troops, to forcibly gain entry into his private home and teargas his wife, family and staff in the dead of the night?”

“It’s high time our Nation retune our collective conscience and rediscover our moral compass and ask ourselves hard and honest questions about the direction of the Country. President Hakainde Hichilema is my brother from another mother”

“We are each other’s keepers and we warmly welcome his release,but not the manner it has been carried out. HH deserved an outright acquital because he is absolutely innocent. Sadly, citizens once again have been robbed of an opportunity to hear the truth as a consequence of the Nolle by the DPP.”

“HH has now become an African giant in the fight against injustice and we congratulate him for standing up for virtues of human dignity and democratic values of our people. All people of good will must condemn the PF Government for leading our Country towards an ugly path of hatred and vindictiveness. We thank the Almighty God that in all this He remains the final Judge. In the same vein, we wish to encourage our Judiciary to always be firm and fair and remind them that they are the bedrock and custodians of our freedoms. Without their fair dispensation, adjudication and defence of our shared values as a people, our Nation is headed for the abyss.” Dr. Mumba said

  1. It is common sense what Nevers Mumba is saying. So embarrassing in a country with 2 former presidents, it had to take Catholic Bishops and Hon Scotland to resolve a straight forward issue. Which law did they study, No wonder they were debarred by LAZ

      RELEASING OF HH SHOWS HOW GOVT ORGANS CAN BE ABUSED. What Scotland did is totally abusing of the judicial system in the our country.
      HH release was negotiated with conditions attached for those who are ignorant.

      1. That forgets about whinging of 2016 election
      2. Accept defeat and recognise ecl
      3. Make peace and dialogue.

      Without him accepting to these conditions he would still be languishing in mukobeko.

  2. This episode will go down as one of the darkest times in our history as a nation, and it all happened on Mr. Lungu’s watch. His legacy as president will always be marred by this injustice and the many others that are not seeing the light of day. We need to sit down as a country and revamp our institutions! The DPP chambers needs a total shakeup, the police force also needs to be rebuilt from the ground up. The electoral commission must be disbanded and replaced! The leadership of the judiciary must be impeached and the concourt reconstituted with fairer jurists. And, that will be just the starting point!

  4. I think HH has a case to answer. The commonwealth SG brokered a deal and it is in this vein that DPP entered a nolle. Also I think HH agreed to start afresh by recognising ECL as president of Republic of Zambia.

    • Indeed if I were him and I had no case I would have opted to stay in Mukobeko until the case achieved its logical conclusion. That’s how Madiba did it.

  5. Forget about the recognition. That won’t happen. we will move forward agreeing that 2016 was a sham, and an illegality, a bad episode in our country. Lungu will continue to be president but the legitimacy he seeks can only come rom following the due process of the law and ensuring the petition is head. That is simple, its not about HH, its about majority of Zambians people appreciating and recognizing that the due process that ensure the mandate of the presidency as been fulfilled. No one knows where this majority now is as this is what to petition was trying to establish.

    Let us hear the PETITION and see how many of those 50%+1 were REAL VOTES! But no, we know they were stolen, that is why the petition has not been heard!

    • Do the stolen votes include the ones Maureen Mwanawasa failed to prove instead chickened away from the petition. Please gentlemen let us be serious. Do you really think intelligent lawyers like Jack Mwiimbu and Vincent Malambo would fail to prove stolen votes even in 5 days. Please spare the nation with this petition issue. Can’t you think for once why the same lawyers who purportedly abandoned HH on the petition case reappeared to continue representing when he actually told the Concourt that they should give him time to look for another set of lawyers. The truth you may not want to hear deliberately so that unnecessarily tension continues is that ECL won the 2016 elections. Its sad that educated people are deliberately ignoring the truth.

  8. CONT. If UPND had conceded defeat like the late Michael Sata did and concentrate mobilizing in none strong holds, 2021 would have been theirs possibly. Surprisingly again with all the learned people in UPND they seem not to understand that theres not enough time for 2021. They choose to hold on to issues of 2016 even when they fully know that it would not send HH to state house. This beats me in understanding the political strategy of UPND. HH is out why not spend energies on 2021 strategies than insulting ECL and holding press conferences or walking interviews just to utter disparaging remarks on ECL. Why upholding an insulting stance on social media against the president. Please plan for 2021. JUST ADVISING.

    • @Dominion, your arguments make sense broadly. However, the way the petition case was handled left a lot of suspicion. Why did the Concourt bungle the whole thing? Why were the PF lawyers behaving like they already knew the outcome? Why did the president not follow the constitutional provisions and hand over power to the Speaker? In other words, why did our laid down systems not work? We need to know this before the next elections, otherwise, it will be a repeat of this mega mess! The only way for Mr. Lungu to cement his credibility is for the court process to prove that he indeed won the election!

  10. The Nolle was on the understanding that the past must be left behind but here’s a failed nicompoop resurrecting tensions with his unguarded mouth. If you have nothing to say just keep quiet. That Nolle has conditions which HH and government must respect.

  11. If Nevers thinks it is the way to get fame let him try the same. Its time we stopped encouraging hostility. I urge Nevers to GO FARMING and not waste his time making statements to please jim and jack.
