UPND Vice President Geoffrey Mwamba says has described the Kenyan election petition result as a victory for democracy and says Zambia should learn and emulate the Kenyan governance system.

Mr Mwamba said Kenyans have shown true separation of power and impeccable democratic practices.

He said the petition in Kenya was heard unabated.

“The Supreme court of Kenya has just nullified the recent Presidential elections in that country that had declared Mr Uhuru Kenyata as the victor. The elections were petitioned and the judiciary in Kenya rose to the occasion and judged without undue influences and invisible hand of the executive,” Mr Mwamba said.

“It is a victory for the Kenya electorate.”

The Kenyan Supreme Court has nullified the election of Uhuru Kenyatta in Kenya due to irregularities and new elections have been ordered within 60 days.

This is the first time a Presidential election has been nullified in Africa.

And UPP Leader Savior Chishimba said the shame hanging on Africa as a continent of leaders who have no respect for the rule of law is slowly, but surely being removed.
“We don’t need militia groups of youth in political parties as we have seen from a crop of political leaders who keep jumping from one political party to the other in our nation,” Mr Chishimba said.

He said Zambia can learn from Kenya where the Courts have shown that a case can be won if you keep it simple and focused within the specified timeframe.

“Opposition lawyers were not eloquent, but they argued from the standpoint of the law. That’s why I like my lawyer, Mrs Lilian Mushota – she is calm and collected. She always wants to keep each case plain and simple with a focus on legal issues,” he said.

“A day before my release, Mrs Mushota went to meet with the DPP to calmly raise numerous legal issues surrounding my irregular detention and the next morning the case was discontinued. Lawyers are not politicians, but officers of the court who must help with the speedy delivery of justice. Mrs Mushota always says to me, “Mr. President, Courts don’t work the way many think.” The Kenyan Courts have surely taught all a lesson.”

He added, “The hope for the birthing of a prosperous corruption free new Zambia in which all the people live together in unity must be kept alive. Let us pray for our nation without ceasing. People-centred rather than politicians-centered change is coming to Zambia. The coming change should not be about substituting the corrupt with the corrupt again.”

    • Upnd petitioned elections with preliminaries while odinga presented facts within the specified time. Upto now I have never heard what upnd presented in courts. Can someone help me with just half of the fact upnd petitioned before the conscourt.

      Stick to the topic, GBM has a point, just acknowledge it. Just a week ago you were singing a different song about Odinga losing. Now, that things have changed, you are trying to find other reasons.

      Yes, while I agree with you about GBM being excused from the court hearing, and reported to be transported to SA on health grounds, only to be seen smiling at HH meeting with DA, that leaves a question whether his so called sickness was not faked. Agree.
      But that topic doesn’t belong here.

    • @kanene you can as well agree with me on a point of what upnd presented before the conscourt against what odinga presented. Odinga stuck to internal affairs of his party without blowing the trumpet across the boarders unlike the stinky socks who have been everywhere to lobby them to interfere in the sovereignty of our country. How many times did odinga come crying in Zambia ati bandibida ma voti.

    • Remember UPND wanted to go beyond 14 days. I watched the whole judgement today from K24 on startimes. The chief just opened with the following sentence and i quote ” We have to make the ruling today as stipulated in the constitution as wise we will end up with the constitution crisis if we go beyond 14 day”.

    • The judgement was TRASH. Why? Because the irregularities the court relied on could not have affected the final outcome. How could irregularities in transmission affected the final results. The transmission could have been hacked but the hard copies still showed UHURU to have won the elections.

    • It’s UPND who should learn from Kenya, Odinga did no go to court with preliminary issues, BUT solid evidence and the court went straight into the hearing and submissions were presented and investigated. HH and Fat Albert went with unreasonable preliminary issues and they ended up running out of time. Up to this moment hh and upnd have no evidence to support their case….SO HH & FAT ALBERT, LEARN FROM KENYA

    • I am wondering why the UPND lawyers, HH and GBM are being blamed and not the ConCourt and Mr Lungu himself. For example, did Mr Lungu hand-over the reigns of power to the Speaker during the hearing of the Petition? Did Mr Lungu vacate State House during the same period? All this shows that the decisions of the ConCourt were being directed by Stately which in itself is a serious case to abrogate the Constitution of Zambia.

RAILA HAD LOST A PETITION BEFORE IN 2013, HE NEVER INSULTED ANY JUDGES!! This time around he has won a petition BUT HE DID SO BY PRESENTING SOLID EVIDENCE WITHIN SPECIFIED TIME!! His team NEVER RESORTED TO UNNECESSARY PRELIMINARIES!! He attacked the case head on within time and got the judgement!!By the way Raila is a long time political player who has even been Prime Minister, I never heard him asking his MPs to boycott parliament, and cheating that the international court would declare him a winner!! He NEVER GOES TO ATTACK KENYA OUTSIDE like some of these UPND leaders, HE FIGHTS FOR KENYA’s AT HOME!!

  3. GBM you should learn from this yourself. You’re fishing in an empty river. ..depending on tavern talk as evidence. Your friends in Kenya were focused and within a tight program they finished all requirements such as the day to submit the petition, day to notify the respondents etc. They never went to the press to say ” we have overwhelming evidence. ..” It was all quiet until now.

      In my opinion, the confusion in Zambia was mainly caused by the impartial judiciary and ECZ. The application of 14 days was the main culprit, whether in those 14 days are calendar days or business days. To add salt to the wounds, the court clearly failed when they allowed hearing to continue next week, only to recede on that decision. If our ConCourt was clear in its interpretation of these two accounts, I believe, we wouldn’t be talking about UPND not having presented their case on time.
      So, I would not so decisive to blame UPND for not having brought their case on time, blame ConCourt for its inefficiency or worse still, for its being impartial. WHY ARE PEOPLE NOT TALKING ABOUT CONCOURT?

    • besides the Kenyan ruling is trash. run by the curtail of opposition. No irregularies found with Uhuru. Hard copy poll count ignored . Focused on hscked website. The judges wanted to make a ruling within 14 days. Hence the rush. This 14 days will kill legal systèms in Africa.

    • When GBM was acquitted by the court in Kitwe, he wanted to follow the presiding magistrate to the chambers until he was restrained by the court staff. You can’t thank or despise the judge because he’s only doing his job.

  4. Raila did not grandstand and play to the gallery in trying to get a perceived wrong corrected. He proved it in the courts of law by going about his case in a mature and civil manner. HH with you GBM as his running mate are all over the show trying to get sympathy from the likes of Maimane and Malema.

  5. The Kenya election process and result is a big SHAME on Edgar and his government.
    The process was clean and transparent throughout with live tv and live streaming. Edgars was a sham and not transparent.
    The court was also a major joker.
    Can Edgar ever agree to hear Hichilema’s Petitions live on TV?
    Scared little men in power in Zambia.

    • Don’t lie ba Donkey. There were many preliminaries and the court dealt with them and gave rulings timely and precisely. Your CONCOURT couldn’t make any rulings on the constitutional provisions. They couldn’t even give a simple order to DEAD N B C to release video footage let alone hand over of power. The Kenya election has been nullified on constitutional flaws.

  9. The petition for Zambia was done in good time but knowing the irregularities that rocked Zambian elections including daylight rigging by one chavula, PF delayed the ruling to say time elapsed. Remember you were busy saying Raila is sick and stubborn because elections are not won in courts but now there you have it! A rerun is a technical knock out to Uhuru.

    • only time will tell if indeed it will be a TKO to Uhuru. i doubt that though.With regards to zambia,i sincerely hope the UPND can learn a thing or two on how to conduct a petition without raising too many irrelevant issues. they had all the momentum,but simply failed to execute when it mattered. lets not forget also that we need to have indepedent concourt judges…not those selected by an incumbent president!!

Odinga may just loose again, just wait!! Unless someone says the greater part of the 54% for Uhuru was fraudulent against the 47% for Odinga!! The gap was big and even irregularities are sorted out, they MAY NOT bridge that gap and further give additional votes to Odinga for him to overtake Uhuru!!UNFORTUNATELY, tribalism plays a large part in Kenyan politics and even business! Kenya is more tribal than Zambia, Uhuru comes from the largest ethnic group,his Vice from the third largest. With regional and tribal voting, do you expect results to go different from what they were at first??

It is a case study for both opposition as well as ruling party.I only hope that the ruling will not create mayhem and extermination of Kenyans nationals.Certain judgements,bold as they may be,creates chaos which will be difficult to abate.The judge should have looked at a bigger picture than appeasing one group at the expense of the nation.He will run with his robes when Kenya is in flames.Election verdicts are not defeated with elapsing of time.The judgement will leaves catastrophic results.

  14. UPND Legal Team take note from utunenu not just concentrating on raising money for rentals (Mushipe). Hit the nail on the head , keep the subject simple and straight forward. If you had concentrated on the aspect of the IT guy in the server room, you would have made it but you Tonga morons were beating about the bush ! Try 2021 guys

  15. Why did God throw me in a hopeless continent like this one. A friend has emigrated from Zambia and just advised me he would like his children to grow up in a much more organised society. And here, the issue is that we are in decline, unless you are in incurable denial you cant see the decline

  17. Very brave and welcome decision, not only for Kenya but for the entire of Africa. Indeed a precedent-setting decision. Maybe other scared judges like our very own may gather any iota of courage and bravery from this decision.

    Zambian judges really missed an opportunity to go down in history as trend-setters when they could not even allow the evidence to be presented in court.

  18. Countries do learn from each other. Zambia is learning too. It may soon be possible for Zambia’s Supreme Court to act likewise – overturn an election result. This is a landmark case, not just for Kenya, but indeed for the whole of Africa, if not the world, including the United States of America. Was it not America’s Supreme Court that endorsed that fateful election in which Al Gore was the clear winner? Were Al Gore to have been the president, America would not have gone to war against Iraq. What a different world we would have been living in today? How proud today are those United States Supreme Court Justices for overturning the will of the people? Let the Kenyans go to the polls in 60 days, and let Kenyatta be a Kenyan again.

  19. That is good. But people are not fair to themselves if there was no evidence before the court and the ruled for the Uhuru you same people were going to say the court is corrupt. Now because it has ruled for the opposition you say the democracy. I think lets present the court with enough evidence and NOT partial evidence. Kenyan opposition had enough evidence to convince the court. So GBM produce enough evidence and the court will rule in your favour.

      Kenya’s Supreme Court Judges have created a precedence. Other countries will soon follow. If Odinga wins the Kenyan election, then expect Uganda to soon follow Kenya’s example, and if Museveni vacates the throne in Uganda, then expect Ethiopia, subsequently to bend to the wishes of the majority. It’s only a question of time. As for Zambia, I consider you smart enough to already know what is on the menu. It is not good news for any politician who plans to survive by way of rigging.

  22. This fatso UPNDonkey also! It is UPNDonkeys that need to learn from Kenya that:
    1. In Africa, the Courts can nullify an election if sufficient evidence is presented. If not, petitions are thrown out legally.
    2. In Kenya like in Zambia a presidential petition must be closed within 14 days, therefore the petitioner must be focussed with evidence from day one. Otherwise you end up insulting innocent Court officers for your own problems.
    3. Parties must accept the verdict of the Courts no matter how unpalatable, Raila did this in his petition previous elections.
    4. Last but not least, (UPN)Donkeys are not capable of organising a complex thing like a petition, just look at the shambolic unimpressive “speech” by underfive to DA MPs. Like it was written by a grade 5 pupil at Namwala…

  23. Raila Odinga, Maimane, Malema and HH are birds of the same feather! Sellouts! Uhuru will win again. He is by far a better candidate than Odinga. Remember Raila was Vice president under Kibaki, what did he do? Look at Kenya now. Uhuru has vision. This is a temporary set back. And GBM, dream on with your party, Wynter Kabimba will get more votes than you in 2021.

  24. IT IS NOT PRECEDENCE BUT EVIDENCE. IT IS NOT PRELIMINARIES BUT SUBSTANCE. BY DAY 14, UPND WAS STILL PRESENTING PRELIMINARIES. IT IS NOW OVER 1 YEAR AND NOT A SINGLE IOTA OF EVIDENCE HAS BEEN ADDUCED.

  25. The sad thing is UPND is a rotten party. We suppose to reconcile the PF and the UPND so that come 2021 the loop holes in the system can be sorted out together in harmony. As always UPND will always waste time and come to the table when its too late. This is what costed them the elections and trust me ,this will come to haunt them again. Just whats wrong with UPND? South Africa wont win you elections please come back home and make peace at home and get sympathy from would be voters at home and show leadership. You killing yourselves and the party. Listen to the people for once. Malama has no brains to share with you Mr HH.
