
The Lusaka High Court has quashed the findings of the Dennis Chirwa tribunal that found former Communications and transport minister Dora Siliya in breach of the constitution.
Lusaka High Court Judge, Phillip Musonda has found that Dennis Chirwa tribunal exercised excessive jurisdiction when it invoked Article 54 sub-section 3 to declare Ms. Siliya in breach of the constitution.
The Dennis Chirwa tribunal found that Ms. Siliya breached the constitution for disregarding legal advice from the Attorney General’s chambers relating to a Memorandum of Understanding between government and RP Capital partners of Caymans Islands to value Zamtel Assets at $2 million.
Ms. Siliya applied for judicial review in which she challenged the Tribunals’ powers to invoke constitutional provisions which are a preserve of the High Court.
Judge Musonda in the ruling delivered found that Ms. Siliya did not breach the constitution and further said the Dennis Chirwa tribunal findings that there was no breach of part two of the parliamentary and ministerial code of conduct will remain undisturbed.
He said findings that Ms. Siliya did not breach part two of the parliamentary and ministerial code means she is cleared by the tribunal and the High Court under Article 54 subsection 3 of the constitution.

I am not a lawyer but this was just pure common sense. The Tribunal acted like a ‘vigilante’ group rather than a group of learned men. This is sad for justice. It is like I once said on this site, KK’s son was accused of manslaughter but the court found him guilty of murder! Naturally a higher court acquitted him. The court’s or tribunal’s job is not to be the investigator and charger as well as jury at the same time. The court or tribunal must answer to the question before them in light of the evidence adduced. Mr Harrington did not accuse Ms Siliya of breach of constitution. He may do so now, but he did not do that then.

Sorry, you have missed the point. There was an incessant attack on Ms Siliya for over a month in one editorial after another before the tribunal began to sit. The tribunal is made up of men and they are bound to be affected one way or another. Similarly, it was the ‘matrix of plunder’ submitted by the Post that made HE LPM, SC to move against his benefactor. Think about it; now that there has been no noise from the Post, the HC has delivered a different judgment. Anyone of us at one time or another will need the courts to defend us against vigilante groups. Believe me, when that happens, you will be glad when your innocence is approved.

In Zambia, Corruption has worsened to the extent that it has spread to institutions that are supposed to fight it. I believe we have now reached a stage where we urgently need courageous men the likes of Mwamba Luchembe and Captain Solo to liberate the country from the vultures that are wantonly destroying public resources, taxpayers and donors money. I beg to differ. Corruption has not worsened in Zambia. It is just that there is now more light shinning on the corrupt and they are being found out. When you are in a dark room you cannot say is dirty because you cannot see, but once you turn on the light, you see all the dirt that was always there but never noticed. Guilty findings at lower court do not always translate to guilty at an appeals court. There are several cases in the US and Europe were judgements have been overturned by an appeals court. It was very clear from the proceedings that Dora Siliya did not steal nor did she initiate the transctions in the ministry. She found on going transctions in her ministry, The concern at hand was the use of influence, You might notice that over the period of time people lost track of the real case and started assuming that Dora stole money. This, I believe is as a result of the media which was busy shifting peoples from an financial abuses to Dora’s case. Lets be reading between the lines. Anyhow, such was expected. I ask the … Dennis Chirwa Tribunal 3 Judges who executed that initial ruling on Ms MP Siliya Dora to resign on moral grounds for making a big mistake and probably cheating the Zambian people from all parts of the Earth. In fact, this is a clear indication that someone has been compromised in the handling of this case from its beginning to now this end.
I also implore the opposition political parties to use this flip-flop of the Zambian Judiciary System over the Ms MP Dora Siliya Saga/Tribunal in the 2011 elections campagins.
Such uncertainties in court rulings indicate that even the UPND Anderson K. Mazoka appeal over the lose of 2001 elections might have been compromised.

It’s undenied that Henry Banda (RB’s son) has close connections to RP.
Dora might have gotten away with it legally, but the scenarios stated above suggest something fishy over the deal. that is the reason why peopl are angry not because of hating dora. However there is a bitter after-taste that the Law seems not to have acted or rather sided with morality this time around.
Well, due process has been followed. The tribunal sat, acted ultra vires and passed a controversial judgement that was contested by Dora. Dora appealed to the High Court and won her case. The tribunal is inferior to the High Court, regardless of its composition. I suppose the option left to the complainant, Harrington, if he still feels very aggrieved is to appeal to the Supreme Court. The High Court went by the facts and not tabloid fuelled emotions, which is the right thing to do. Had the cold hard facts compelled a different High Court judgement, chances are that Dora would be in tears by now.

Prevention is better than cure
This was all a planned move. RB asked Dora to resign and asked her to seek for a judicial review. RB then gave instruction to Philip Musonda to rule otherwise once the case is given to him. RB decided not to appoint anyone in the Ministry of TRans and Comms so that Dora can bounce back. RB was the one who first cleared her even before the tribunal. We are dealing with mafias who can not stop on anything but what pleases them.
A tribunal is subordinate to the high court ladies and gentlemen. Even pipo like Bihop Mambo, Imakando, fRED m’MEMBE, Kapoko, VJ, Kashiwa Bulaya and MCS can sit on a tribunal. This does not make the tribunal superior to the courts of law. When the CJ appointed the the tribunal, he said they were to collect evidence and not to convict Dora. The tribunal can be lower, but the caliber of its constituents does matter. The two judges are on the supreme court bench. Their guidance on the tribunal carries more weight than an ordinary me. No matter how you dress this issue, it is a big big contradiction. High court overturning a supreme court justice’s opinion is no small matter, even if this was was in a less environment!

You know in sensible jurisdictions when they are outraged by a courts decision they never attack the judges they always lobby for change of legislation. Judges are like interpretors they don’t write the law the interpret it.I feel sorry for zambian judges having to be the brunt of a magnitude of ignoramus. This means that a junior to them, Supreme Court Judges, has shown that DCJ man Dennis Chirwa and his counterpart Chitengi are incompetent in understanding the Zambia Republican Constitution. No more, no less!

I believe the tribunal did in record time turn out its report and handed its findings to the appointing authority. Now here comes the amazing part. In the meantime, the person at the centre of the controversy decided to appeal the Tribunal’s verdict; the court heard her and also in record time, returned its verdict: Not guilty.
CONT’D…While all this is happening, our president, in keeping with the sense of urgency he always approached this matter with; has also been carefully studying the Tribunals findings, and with that same sense of urgency has …NOT YET FINISHED READING THE REPORT!!! Now that Dora has been cleared, what’s the purpose of the President continuing to study the report? He might as well just re-instate her into her old post or name her as his vice president; make that second vice president.

The news of the exoneration of the adorable one has been met with shock across the nation. Perhaps we should not be. The handling of the entire matter has been so unprofessional that you would be forgiven for likening Zambia to an episode of The Muppet Show.
The tribunal found her guilty of an offence, told us that if it were Judas who had been found guilty then his removal would have been warranted, and went on to leave it to Judas to decide what to do. The term ‘spineless’ is not adequate to describe that decision. We require a word that incorporates ‘cowardice’, ‘patronage’ and ‘boot-licking’.
And much to the shock of most Zambians, Judas did nothing. Well, actually he did do something; he went into a closed door meeting with her at the Sun Hotel in Livingstone.
Nothing, however, could have prepared the Zambian public for the exoneration at the hands of Big Phil. There is an expression that states ‘the law is an ass’. Zambian law would qualify as a big ass then.
How can a matter that was taken to the Chief Justice and decided upon by including two Supreme Court Judges be overturned by a high court judge? To add insult to injury, the logic in his judgment is the type we are accustomed to hearing from people without grade 12 certificates like Teta and MCS.
It is common knowledge in legal circles that the shrewd state council never looses matters that are before Big Phil and so there are those who knew that this matter could not have been decided any other way.
Let the voters define their destination come 2011, and who should captain the ship to safe havens . Zambia is for all not the few .

Excuse my ignorance in “law” as I happen to be an engineer, because in engineering if a shaft is rotating at 200 revolutions per second another engineer will not argue and say the speed is 400 rpm. If this is what the law is about, then we have a circus in our country and people with legal background ( most lawyers,judges etc)are the most despicable,and corrupt scoundrels! It’s no wonder cases take many years, Dora was clearly in the wrong, Chiluba and his concubine are in the wrong but will go free with buffoonery we’re witnessing. What a shame!!
Wait a minute, am I just confused or this just doesn’t make sense to everbody else.
First the high court says the tribunal went outside thei scope by ruling on the fact that she breached the Consitution – fair enough and fine to me! But then the same High Court goes on to say in fact she did not breach the Constitution at all. Isn’t the high court also going off limite here – I mean wasn’t the case under contention before the high court to know whether the Tribunal had a jurisdiction or mandate to rule over the Constitution and not whether Siliya breached the Constitution or not. My understanding is that the contention was over the tribunal’s jurisdiction; not the guiltness of Siliya – or was it both? Anyone else understanding me here?
One more thing: can someone who is schooled in law school me on the relationship between a tribunal appointed by the CJ and a court such as the high court. I ask this because why did Wlliam H. and the other civil societies decided to have or ask for a tribunal if they could have just easily gone to court? If their lawyers ‘knew’ that the findings of the tribunal could easily be overturned by a court of law with such impunity, why didn’t they decide to go straight to court? And will Dora cry bias if this circus is taken to the Supreme Court and the same judges who found her guilty are sitting on the bench? I have a feeling this will just go on and on without end as I reckon they will appeal this decision by judge Musonda.
Jigga, I completely agree with you. This judge’s role was supposed to be to review the powers of the Chirwa tribunal and not on whether Siliya is guilty or not. Now look: “Judge Musonda in the ruling delivered found that Ms. Siliya did not breach the constitution” Just who the hell asked this fool to dwell on that matter? Such forked judgements only goes to show the extent to which our judiciary is rotten!
I think the only thing that can save Zambia from destruction is federalisation. To me, the vicious vernon of tribal bigotry has demented most people and blinded them wholy from reality. The law is an arse. #274 I agree with you. The legal profession these days has gone to the dogs as well as dogs have gone to the legal profession. The Chief justice not long ago said shady charecters and conmen of all sorts of stripes had invaded the legal profession. I just hope PF member Mr William Harrington is working on an appeal to the Supreme Court since I have not read not of his comment(s) so far.
This Dora Siliya case just has to be exhausted through all available channels in our legal system so that I can have a glimpse of how thing full work in our Zambian Judiciary stsem.
