Chungu granted bail, but stays in prison

FORMER Zambia Security Intelligence Services (ZSIS) director general, Xavier Chungu has been granted bail of K100 million by a Lusaka magistrate’s court in a forgery case but will return to prison on other charges.

Kabwe senior resident magistrate, Joshua Banda granted Chungu bail in his own recognisance pending judgment in a matter he is facing two counts of forgery and falsifying a document contrary to the laws of Zambia.

It is alleged that Chungu on dates unknown in 2003 forged passport number ZH 88471, purporting to show that it was issued properly when in fact not.

In the second count, he is charged with falsifying a document contrary to Section 352 of the Penal Code CAP 87 of the Laws of Zambia.

Particulars of the offence are that, Chungu on December 3, 2008 in Lusaka, knowingly and fraudulently presented the passport in question to Mary Bwalya, an immigration officer.

Chungu’s lawyer, Malewa Kaona, applied for bail pending trial saying that his ailing client’s condition was not suitable for him to be taken back to prison, to which the State did not oppose.

“Following an application for bail pending trial and reasons advanced, I now grant the accused bail of K100 million in his own recognisance,” Mr Banda said.

Mr Banda had set July 31 this year as judgment day in this matter but failed to deliver it because Chungu could not be taken to court as he was incapacitated after being admitted to the University Teaching Hospital.

And the Lusaka magistrate’s court has acquitted Lusaka businessman, Gilbert Temba after the court found him with no case to answer on charges of forgery and uttering.

Magistrate Kenneth Mulife acquitted Temba after the State informed the court that they were not calling any more witnesses and in his ruling said that the State had failed to establish a prima facie case and accordingly set him free.

This is in a case in which Temba of 1264 Libala Road, Roma Township was facing two counts of forgery contrary to section 342 and 347 and uttering of false documents contrary to section 352 of the Penal Code Chapter 87 of the Laws of Zambia.

  2. Will this man Chunga ever come out of prison alive. Its time for him to harvest what he sowed. I pitty the man coz he was s trong man during Chiluba regime. Are our children going to be safe by becoming shushus looking at what is happening to Chungu. How is possible that he forged a pasport or was he given a passport bearing different deatils by his boys in the system to facilitate his escape last time. What about those who signed the passport. Chungu just open up you can no longer be saved by secrecy of oath as things are going. Unless its a trick by the system to deceive the public yet something else is being done.

  3. I AM STARTING TO FEEL SORRY FOR CHUNGU, HE WILL SOON DIE IN PRISON. THE CHARGES ARE JUST TO COMPLEX, AND THE MAN HIMSELF MADE A MISTAKE BY RETURNING TO ZAMBIA- UMULANDU TAUBOLA. THE BEST THING FOR HIM WAS TO REMAIN A GLOBAL TROTTER AND SEEK ASYLUM. SAD FOR THE WIFE AND HIS BEAUTIFUL DAUGHTERS.

  4. He must not die. He is a key witiness in FTJs cases. You see in Zambia when a key witness dies the case is cancelled.

  6. So who poisoned him in prison? Someone wants him dead? Maybe he was right when he fled last time saying he was tipped that his life is in danger.

  7. food poisoning is a common thing and does not necessarily mean someone put some poisonous substances in his food. its basically a chemical reaction of foods we eat. am saddened by the happenings in our country were the spy boss, army , zaf and zns generals are tried in common courts. these are no ordinary individuals, they carry with them information that can set this country on fire and i strongly think that a special military or special court would have been put in place for these pipo. Chungu is on trail but todate his not been allowed by the president the only person that can allow to say what he knows on the issues in court, why? national security issues. imagine chungu spilling the beans about all the dirty secrets in government how would zedans and the world at large react. war

  8. Well, Dean, Ngenda, Kaulung’ombe, Baldwin, Paul Tembo etc are awaiting this criminal’s arrival soon in the heavens above to help usher him into hell where Lucifer awaits him. During Chiluba’s criminal tenure, Chungu was the regime’s bite dog and for all those who crossed paths with this great Satan, they will never forget what they went through. Let him fry in his stinking sins.

  10. I think what is going on Chungu is very wrong. His is an ex Interlligence Chief,and such people should not be put on trial, but instead made witnesssess. The national security system in under his nose. What the Government is doing is weakening the Security system of the nation. Chungu should be freed unconditionally, i think . Alot will come out which will implicate everyone,including leaders in government now. For security reasons,Chungu should be freed NOW without any conditions

  11. # 13. Ever heard of Alberto Fujimori former President of Peru and former spy boss? Well he is doing time in jail for lots of crimes he thought would never see the light of day. Chungu will have to be tried and convicted or found not guilty. These guys messed up this country too much.

  12. These cases take very long in Zambia. This man may die before any meaningful conclusion is done. May be if he was not in that filthy prison he would last long. If he dies in prison, there will be no justice done, only punishment of being in prison whilst being tried.

  15. Elo bamabala lali kwata umuchanga 100 million Kwacha Bail. some fellas cant even afford 3000 police bond and are rotting in cells God have mercy on these crooks sent us more monkeys and stray dogs.

  16. The man is in ICU at UTH. The lawyer who applied for and obtianed bail for him in two of his matters is Maria Neves.The Constitution recognises and declares that every person in Zambia has been and shall continue to be entitled to the fundamental rights and freedoms of the individual, that is to say, the right to life, liberty, and security of the person and the protection of the law. Innocent until proven guilty.
