PATRIOTIC Front (PF) leader Michael Sata has sued the publisher of Stand Up for Zambia (SUFZ) News, Chanda Chimba III for allegedly publishing defamatory articles about him, including his sickness.
Mr Sata claimed he had been seriously injured in his character, credit and reputation and was demanding damages and an injunction restraining Mr Chimba and his servant or agents from distributing, circulating or selling the said tabloid until determination of the matter.
He said Mr Chimba’s publication alleged that his sicknesses had led to fears that he might not lead the country longer due to his serious medical condition.
In a statement of claim filed in the Lusaka High Court yesterday, Mr Sata said the defamatory articles were under the headlines “Sata is a sick man”, “Close encounter with the Cobra” and “King Cobra spearheads homosexual campaigns”.
Mr Sata indicated that the first article stated that he was diagnosed with four threatening diseases in September 2009 after undergoing 22 different medical tests at a named clinic in Lusaka.
He said a tube was inserted to pump out some fluid around the heart as a consequence of his heavy smoking and that there were fears that even if he was elected as president, he would not lead the country for a long time because of the serious medical condition.
Mr Sata said the second article stated that he would make a dangerous leader should Zambians make a mistake of voting him into office because he was exceedingly tribal and a reckless dictator.
“That Mr Sata lacked any qualification to be head of State and his understanding of issues was limited to attacks, insults and lies,” he said.
Mr Sata said the third article indicated that his desperation for power had turned him into a pro-gay activist.
“Sata is desperate because the Orange Party in Taiwan which bankrolled his last three attempts at the presidency is out of power and is demanding back the money that they spent on him and the land and other things that he had promised.
“Following the loss of power of the Orange Party in Taiwan, Mr Sata has now turned to gay activists and countries that support homosexuality to fund his campaign so that in return he would enhance gay rights in Zambia.
”The PF leader said the article also indicated that he had promised to remove from the Statutes the sodomy and bestiality laws as contained in Chapter 87 section 155 of the Penal Code so that gay rights would be guaranteed and enshrined in Zambia.
Mr Sata said the articles in their natural and ordinary meaning were understood to mean that his health had considerably deteriorated, and that the Zambian electorate should not vote for the plaintiff in the forthcoming presidential election as he was unlikely to conclude his term of office due to poor health.

Who doesnt know that Mr. SATA failed to climb the stayers due to serious health reasons when he was scheduled to attend a radio programme with QFM on one of the Thursday about a month ago. Who doesnt know that Mr. SATA is supporting gays including the Bwinjifumu homosexuals. Who doesnt that Sata received funding from Taiwan in the previous elections and owes these pipo colossal sums. But Mr Mulongoti said Mr Sata should desist from commenting on the way President Banda is running Government because he (Mr Sata) failed the people of Zambia when he served as Cabinet minister.
Mr Mulongoti said in an interview in Lusaka yesterday that Mr Sata should stop boasting that he can effectively run the affairs of the nation when the opposition leader made a lot of mistakes when he served in Government.
“The MMD is trying to correct the many mistakes that Mr Sata made when he was in Government…why is he distancing himself from the wrongs that he made?” he asked.
Mr Mulongoti dismissed insinuations that the ruling party has run out of ideas on how to run the country, saying it has initiated a number of development programmes which have helped to improve the living standards of people.
Mr Mulongoti said the people of Zambia cannot continue to be cheated by Mr Sata that he will develop the nation within 90 days if he is ushered into office as president when he has allegedly failed to deliver improved service delivery in some PF-controlled councils.
“Zambians have seen for themselves how the PF-controlled councils have failed to provide improved social amenities to the people, but Mr Sata is again politicking that he can deliver development to the people of Zambia.
“People should not be cheated by this type of cheap politics because they are coming from politicians who failed to deliver when they were in power, and just a reminder, the 90 days they promised the people has passed but we have not seen any development in the PF-controlled councils,” he said.
Mr Mulongoti said the people of Zambia should stop listening to Mr Sata because he has shifted his concentration and attention to unnecessary issues at the expense of development.
He said Zambians should stop listening to Mr Sata because he has worsened the status of the country’s social sector because of his incessant attacks on President Banda and his administration.
“Mr Sata should not be trusted because he failed to deliver because of his inability to set the right priority for national development when he was in Government,” Mr Mulongoti said.
He urged Zambians to support President Banda and his administration in the 2011 tripartite elections.
“We are advising all well-meaning Zambians not to waste their votes by voting for the opposition. The only candidate we have to support is President Banda who has demonstrated remarkable leadership from the time he became President of this nation to date,” Mr Mulongoti said.
this the beginning of the end for sata. the courts will not grant an injunction and even they do, just like fred membe did in 2008, CC3 will continue to publish his stories in violation of the court injunction. what comes around goes around. RB’s case against membe is still in court two years afterwards so sata is fighting a losing battle and more skeletons will come out

Disclose Your Sickness, Sata Challenged
GOVERNMENT has challenged Patriotic Front (PF) president Michael Sata to make public the results of medical tests he underwent on September 8, 2008 before he can continue to malign others.
But Mr Sata said the diseases which were detected after the tests had been treated and declared that he was ready to disclose the type of diseases in the presence of Mike Mulongoti.
Mr Mulongoti who is acting chief Government spokesperson said in Lusaka yesterday that he had been forced to challenge Mr Sata after observing careless talk on the health condition of Government leaders.

I remember Mr Sata talked ill of George Kunda on Let the people Talk last year. He constantly referred to Mr Kunda as “ka Kunda notumulomo utwakashika kuma ARVs”. If Mr Kunda also sought to sue him now, what will this make of Sata? When it suits him, he yells the loudest! And to think educated Zambians can expend their energies hero-worshipping these ” very old political have-beens” as modern day economic liberators and messiahs that Zambia need for change really baffles my mind.
