Mpombo falsified 3 receipts – witness

A WITNESS yesterday told the Lusaka chief resident magistrate Joshua Banda that former Defence minister George Mpombo allegedly falsified three receipts when he was asked to retire imprest.

And magistrate Banda yesterday ordered that trial should proceed even when the accused’s lawyer Wynter Kabimba was not present in court yesterday because he was in court when his client’s matter was adjourned to yesterday’s date.

Mr. Mooya Haalwindi, a soldier who was Mpombo’s ADC in 2008, testified that he got the receipts from a named Ndola man to produce the three receipts amounting to K18 million and paid him K250,000 as a token of appreciation.

He said the man gave him one receipt for Luangwa Lodge in Eastern Province amounting to K10 million, another for Ndola’s Chabanga Lodge worth K5 million with the last for Kanjaba Lodge worth K3 million.

This is in a case in which Mpombo is charged with theft by public servant contrary to Section 277, forgery contrary to sections 342 and 347 and uttering a false document contrary to Section 352 of the Penal Code Chapter 87 of the Laws of Zambia.

Mr. Haalwindi said it was not in order for Mpombo, 57, a farmer of house number 4 Katonte Farm, Ndola Rural to falsify information when trying to retire the imprest.

Mr Haalwindi said in 2008, Mpombo received a letter from the then permanent secretary reminding him to retire imprest and he called him (Haalwindi) and asked him why he did not manage to retire his imprest.

He was then given some receipts which he also handed over to Marble Mangala, Mildred Mulawo and Idah Shabwanga, all from Defence Ministry’s accounts department to retire the imprest on his behalf.

Mr Haalwindi said Mpombo then directed him to call a Mr Ignatius Lungu who was then his protocol officer while in Ndola who also in turn directed him to a named man whom he met the following day with Mpombo at Chabanga Lodge in Ndola where he produced three receipts from various lodges.

Magistrate Banda has adjourned the matter to July 1 for cross-examination because Mpombo’s lawyer Kabimba was not in court.

Mpombo informed the court when the matter came up for cross-examination in the afternoon yesterday that his lawyer could not be present before the court because he had travelled out of the country for a funeral.“My lawyer received an unexpected bereavement in the United Kingdom and he flew out of the country last night, so he cannot be before this court,” said Mpombo.

Mpombo told the court that his lawyer’s law firm was in the process of preparing a notice of adjournment.

When asked by the State prosecutor when his lawyer would return, Mpombo said his lawyer would be returning at the weekend.

Particulars of the offence are that Mpombo jointly and while working together with other known persons, being a public servant as minister of Defence, stole K18 million which came into his possession by virtue of his employment.

The offence is alleged to have been committed on unknown dates but between June and September 2008 in Lusaka.

Magistrate Banda adjourned the matter to July 1 for cross-examination.

  2. There is a lof of theft. Very few Zambian men have any credibility if at all. It does not surprise me, the country is corrupt, full of Power mongers. Mirraculously some Zambian Men are good and could be relied upon, but most of them are Jokes, Cheats, Dull, brainless. Thanks

  4. Well, I wonder whether Banda even has time to retire his imprest before the next trip beckons. Banda’s wife too continued receiving government teacher’s salary years after she stopped teaching and yet nobody has gone after her with such vengeance. We’ll see, only time will tell but from what I can see, Mpombo will be joined by other thieves in Cabinet today.  

  5. Some cases are not worth wasting time on. K18m, the court charges will be even more than the amount involved. Political case. (How I wish Lucy can also be tried for her bounced cheque.)

Too bad for you Mpombo, you are not welcome in MMD and the mighty UPND. May be you can join the thugs in the PF where finished politicians are welcomed.

  7. Mpombo, always know which battles to pick as this is guerrilla warfare. The govt is big and exposed and u are small but can maneuver. You were dumb to start a battle that you knew you couldn’t win. Now you will lose everything including you freedom all based on your own stupidity and theft. You lost one of the most powerful jobs in the country only to beginning relentlessly insulting your former friends.

  8. Sadly most, if not all, people in govt and other organisations have this bad behaviour. Too bad Mpombo is being targeted for being an opponent to the powers that be.

  9. Well, maybe all the government ministers and senior civil servants do the same. But remember the unwritten tenth commandment “though shall not be caught.” The fact that Mr Sata was not caught in the matrix of plunder of does not make him innocent. We still remember the trunkful of money at Mulungushi rock of authority. To think that some people think Mr Sata can fight corruption is the biggest joke of the centuary. Iam made to believe that only General Miyanda retired imprest in the entire Chiluba Government.

  10. court hero,how would mpombo call a person who attends court sessions so often in his own dictionary,ok sir you are a court mosquito,you thought the post will always be there for you,they just want to make money out of you then dump you,no more mpombo in the headlines as a hero now you are in the headline as a thief,you have run out of ideas that you end up picking a chief loser in legal issues-kabimba,why of all lawyers pick on this minion????why??look at what he has caused failing to apire before the court

    RB’s people have tried all means to find a fought in Mpombo. Zambians should realize that this is not justice only when one is out of favour with the Govt. Where were accountants when $18 million was mis-applied? just imagine. Then fire the entire accounts department they are doing nothing. By the way did Chiluba retire his imprest? what about Mwaanga, Katele etc.

  12. Kabimba tried to force an adjournment by missing the session. If that does not sound cowardly enough, the POST are trying to make that the isue in the whole matter by trying to demonise the court for proceeding without Kabimba who deliberately just did not bother to go.

  14. Number 22 Iam a former Accountant in the govt. Let me tell you how it goes. These guys ministers, deputy, ps. directors and their deputies retire feck imprests and in accounts and even in audit one can not question the retirement of the minister or any of all those guys above. Even RB is he up to date with his imprest. I personally left unretired imprest because of the same altitude. So let mpombo free he is not alone even the saving ministers are not innocent. They want to go for Mulongoti and they will go straight to imprest because they know no one is perfect with it.

  15. Couldnt Mupombo just be asked to settle the 18 zmk that he took? Anyway if he did falsify the reciepts then just like he tried to bounce a cheque he needs to answer to the law…its a pity even the likes of Mulongoti when they were in MMD Fleddie and his PF vuvuzela the Post warned him that the country was watching and oneday he would answer who got him the new suits he was wearing and the likes but am sure he forgot..now he ahs to answer and he is blaming GRZ…he can call for amagedoen the mother of all wars but the law does not wilt
