NDOLA Principal resident magistrate Collins Lundah has sentenced former MMD Ndola district vice-information and publicity secretary Alex Mubanga to 18 days imprisonment with hard labour for conduct likely to cause a breach of the peace.
This is in a case Mubanga, 53, popularly known as ‘Shimpundu pa nkoloko’ was charged with conduct likely to cause a breach of the peace, contrary to section 178 (F) of the Penal Code Chapter 87 of the Laws of Zambia.
Particulars of the offence are that Mubanga on August 27, 2011 in Ndola, jointly and whilst acting together with persons unknown, did threaten violence against Patriotic Front (PF) member George Mutale outside Mixed Doubles pub.
Passing the sentence in the Ndola magistrates court yesterday, Mr Lundah said he had thoroughly gone through the facts and found Mubanga guilty. “I have gone through the facts thoroughly and I have found you guilty of the subject offence,” Mr Lundah said.
Mubanga said he did not have anything to add or subtract to the statement of facts when it was read out to him. In mitigation, Mubanga of house number 1091, Lubuto township in Ndola, asked the court for leniency because he is an asthma patient and also suffers from diabetes.
“I have understood the charge and I plead for the courts leniency because I have realised that what I did was wrong and I have since transformed into a better citizen,” Mubanga said.
Mubanga said he has reformed and is remorseful for his actions. He complained that the MMD has abandoned him despite the fact that he is a staunch member of the opposition party.
Mr Lundah said he would be lenient because Mubanga is a first offender who had shown remorse. The sentence runs from October 5, the date on which his bail was revoked after he changed plea, admitting the charge.

Please jst avoid these poisonous drinks: Coke/fanta/shweps/pure joy/etc. A 300ml of coke (for example) contains more than 20g of sugar! so if u drink sugard tea/coffe in the morning, and later (ku ncito) u drink 2 bottles of coke/fanta, u hav taken more than 60g of sugar, and this is where diabetes come from.

The past elections that we just had have beebn the most violent this country has ever seen. We need to find long lasting solutions to this instead of barrying our heads in the sand. Yes, there was a smooth handover of power, but what was happenning on the ground leaves much to be desired. There was so much lawlessness where “thugs” could attack electoral official and burn electoral material on the election day. As if that was not enough, the post election period was even worse, peoples property was looted and burnt for their stance before the elections. It indeed very sad and we need a commission of enquiry on this very serious matter so that all wrong doers can be brought to book.

The Courts and Judiciary are a shame in Zambia. In fact I will be bolder and say all institutions are a farce and only serve as puppets for any sitting administration. I can’t remember an MMD activist being sent to jail by a court of law in Zambia during MMD reign but now even pub brawls will inevitably lead to MMD incarsarations. I do not envisage PF activists being convicted of my politically motivated offences for as long as PF are in power. The looters and criminals who looted and caused substantive damage to William Banda’s property will never be brought to book and I suspect the whole episode is front desk conversation only. Zambians need to learn to put the nation above political parties.

Am jailing william banda to 9 days in prison with soft labor being the 1st offender and having shown little remorse. hh starting counting the remaining days (90-?). we are working and have no time to waste………..dont argue. Alaaaa!
