MMD Lusaka Province Chairperson William Banda and his wife have petitioned the Attorney General over the decision by police to seize two of his vehicles and over One hundred million kwacha cash.
In a petition filed in the Lusaka High Court, Mr Banda wants the court to determine that the action to withhold his money and vehicles amount to deprivation of constitutional rights.
Mr Banda has lamented that the police have not complied with the request to release his money so that he could channel the same to the bail charge.
He is on a 60 million kwacha bail, while undergoing trial in one count for proposing violence.
Mr Banda was arrested in Chipata on September 28, 2011, and slapped with the offence of proposing violence contrary to the Laws of Zambia.
It is alleged that last month, in Chongwe District during the run -up to the tripartite elections Mr Banda unleashed MMD cadres to attack their Patriotic Front-PF counter-parts.

If this article is true then this amounts to witch hunting. Unless, the Police can categorically claim that they are investigating how Banda came to be in possession of K100m and the two vehicles, then these items should have been handed back soon after establishing offences. They have nothing to do with the charge against him and withholding it is definitely depriving him of his own property. He may have been behind the violence and should face the Law for that but again remove this witch hunting individuals to please the sitting head of state…then again it is sponsored by the head of state himself.

So all this hullabaloo around William Banda only amounts to one alleged incidence of ‘proposing’ violence? Why do I get a feeling this guy is going to be found with no case to answer, and then he is going to sue. The hunted will become the hunter due to questionable handling of the case.
At the end of the day William will ave more money in his pockets and yet he voted for MMD. Clever man from the east indeed!

Since Sata has vowed to have a government of laws in place..Banda will go scot free because I don’t think the police have anything against him. It will all boil down to hearsay. The police need to improve on their negotiation skills.
Is this what Sata meant when he said the Police should act professionally? What have the money and cars got to do with ‘proposing violence’? Is there such an offence as ‘proposing violence’? Did someone second this proposal? And was it finally adopted? William Banda may be a thug, but please our ‘professional’ police, charge him or drop the case already. It seems the police are still afraid of the reaction from the new politicians in power if they let him go. The ‘Banana Republic’ goes on!

In as much as he may have a case to answer, I would believe he has a point in trying to get those items not connected to his case back. Even if he has committed crimes that require trial and sentencing, there is no way auxilliary matters should be roped in without being directly connected to the case for which he has been charged. After all it is not unusual for anyone to have two cars and tens of millions of Kwachas in Zambia, now, is there?
