
THE Lusaka High Court has granted United Party for National Development (UPND) an application to commence contempt proceedings against Lusaka Division Police Commissioner Dr Solomon Jere for stopping its political rally on September 9, 2012.
Lusaka High Court Judge Justice Chasi granted UPND permission to commence contempt proceedings against Dr Jere, the second responded in the judicial review proceedings against the Attorney General.
This is in a matter in which UPND through its deputy general secretary Walusiku Lyambela of house number 30 Mpulungu road, Olympia Park has dragged Dr Jere for contempt for refusing the party to hold a rally despite a court order which gave the party powers to go ahead.
Judge Chashi however ordered the UPND to file a motion within 14 days failure to which the leave granted would be taken away.
The court this week joined Dr Jere in the judicial review proceedings in which the UPND had sued Attorney General Mumba Malila as the second respondent to the proceedings.
UPND which earlier had only sued Mr Malila, applied for Dr Jere to be joined in the judicial review proceedings on grounds that he had issued separate instructions to the effect that even with the Court Order in force, he would not allow the rally to be held on September 9, 2012, and as such, he was party to the proceedings.
UPND also applied for leave to commence contempt proceedings against Dr Jere for disobeying a court order.
The UPND contended that Dr Jere acted in contemptuous disregard of the Order of the court by defying its directive and enjoying a media campaign of disparaging the court.
“In the premises, I crave for leave to commence contempt proceedings against the 2nd respondent,” submitted UPND lawyer Chad Muleza.

Thank God for the rule of law. These policemen had better be wary of being used by piloticians because the separation of powers means that the politicians wont be there to defend them in court. Today even Ms katanga is facing contempt proceedings.
‘Custodial sentence’ should be the minimum target for this boot licking fool, pursue him please .

THIS CASE OF UPND WILL NOT WINN DUE TO THEIR WRONGLY WAY OF SENDING THE COURT ODER. 1 IT WAS GIVEN AT THE WEEKEND, 2 IT WAS NOT HANDED TO THE RIGHTFUL PERSON, 3 IT WAS LATE IN THE NIGHT, 4 THE POLICE WERE SUPPOESD THE GET THE PERMISSION FROM ATTORNEY GERNERAL WHO CLAIMED THAT HE DID NOT RECIEVE IT DURRING WORKING HOURS AND IT WAS DELIVERED IN THE NIGHT AT HIS HOME ARROUND 21:HRS. AND OBVIUOSLY EVERY ONE KNOWS THAT SUNDAYS THERE ARE NO SERVICES IN THE PUBLIC SECTOR.
PEOPLE SHOULD KNOW THAT THIS DECISION BY THE COURT TO THE OPPOSITION IS JUST A COSMETIC TO FOOL UPND. THEY KNOW THAT IT WILL NOT TAKE THEM ANYWHERE.

I agree with your analysis. However, the police would, in the future, not like being dragged in the courts of law and as such will become more flexible in dealing with the opposition or indeed any groups that government perceives as their rivals. I know the court will remind the ‘Zabwino Palibe (ZP), that they are operating in a democratic dispensation which requires them to operate as a Service rather than a Force.

Why do you tolerate nay encourage day light robbery through cops (pairs or three some) mounting road blocks and pocketing money. Madam Libongani, I urge you to appoint a Commissioner of Revenue from the ZRA to streamline your porous revenue ‘uncollection’ bribe and corrupt ridden roadblocks and get rich quick schemes of the Police Service. Frankly, the levels of corruption within the Police have not reduced even by an inch. It is so embarrasing the brazen chutzpah with which these cops steal. The corruption that you are talking about is well known even by Libongani herself, that money does not end in the pockets of those guys you see at the road block. They too will have to go and give an account to someone above them who will in turn give an account to someone above him. I am sure that cash fall on her feet too. These cops now behave as if corruption has also been included in their syllabi at Lilayi. When you tell the guy that you are sorry and you are asking for pardon, he or she will tell you that they are not allowed to forgive sins. When you give him or cash he or she will be all smile.
I heard of one cop who decided to resign from the services because he was removed from the traffic section. What a rotten lot is this police or ours.
Why can’t these our cops be like the Scottish Cops in Scotland or the English cops in England. These are serious cops who will let you go or ask you to report to the police to pay a fine. Ours collect for themselves. They exaggerate the amount due and threaten you will jail or dention so that you can be scared and give in to their wishes. They are well taught at doing this with very good skills that is why I have begun believing that they are somehow taught by whoever sends them to collect the cash. Anyway in our country and Africa in general corruption is part of our life. Go anyway in Africa it is the same story at least the few countries I have visited. I did not see it in Mauritius at least not to the extent I saw it in Uganda, Zimbabwe, South Africa etc.
