Supreme Court sets date ruling on Judge Chikopa’s tribunal

THE Supreme Court has set May 9 this year as the date for judgment in a matter in which the Lusaka High Court halted proceedings of a tribunal appointed by President Michael Sata to investigate the alleged misconduct of Supreme Court judge and two High Court Judges.

This is in a case in which Supreme Court judge, Phillip Musonda, two High Court judges Nigel Mutuna and Charles Kajimanga have dragged the Attorney General to Court asking it to quash Mr Sata’s decision to constitute a tribunal to conduct investigations of their alleged misbehaviour or incompetence.

But in her ruling High Court judge Fulgence Chisanga granted the trio leave to seek judicial review in the matter which operated as a stay of Mr Sata’s decision to appoint a tribunal and suspend the judges and any adverse measures against the applicants.

The State having been not satisfied decided to appeal in the Supreme Court against Ms Chisanga’s ruling which operated as a stay to stop proceedings of a tribunal to investigate them on allegations leveled against them.

According to a notice of judgment issued yesterday by the master of the Supreme Court, Dories Nambela stated that the appeal would be heard and determined by the Supreme Court sitting on Thursday next week.

“ Take notice that the above mentioned appeal will be heard and determined by the Supreme Court sitting in Lusaka on Thursday next week at 14:30 hours, for any reason if any part would be ready to attend file notices in advance,” she said.

  1. Finally! What took these judges so long? If this is the rate important national judicial matters are heard then its a travesty. Justice delayed is justice denied. Maybe as a nation we need to increase the number of judges especially at High court and Supreme Court as too many cases are taking long to be disposed of.

    • If you increased the numbers, you will dilute their importance and that my friend can’t happen.
      Judgement will be against the Gov.
      Why, because they have abrogated some rules and a message to the politicians just how they are but just one arm of governance.
      Cost i the least worries of the judiciary.
      Research on how the judiciary came about.

    • This hasnt taken long to deal with by the courts.

      Mention any one country where all court cases regardless of circumstances and complexity are heard and concludeded in record time?

      Mind you this was an appeal to the supreme ourt by the govt.

      In my opinion, this case is infact being given preferential attention by the court system

  6. Judicial review is obvious, those who do not know the rule of law thought they were clever, look at at how foolish your president is for listening to plunderers- Membe and NCITO

  7. Kambwili is busy insulting Bwalya for realising that this Govt has no direction. Has Kambwili just realized that they are responsible to ensure that there is medicine and more hospitals built among others. Has Kambwili also just realized that they need to build roads and schools? What Kambwili does not understand is the fact that the same money that is supposed to be used to improve the welfare of the people that put in in office is being used on stupid by-elections caused by his circus party. If these chaps cannot understand these simple things then Fr. Bwalya is right he cannot barry his head in the sand to entertain Kambwili and his boss’s comedy.

  8. By the way does Kambwili realise that it costs tax payers money to keep a foreign judge in the country for such a long time? Does Kambwili realisze that the same money spent on these PF circus decisions could be used to fund Link Zambia 8000 and other worthwhile projects?
