Kalabo woman sentenced to 24 months for abortion

A 24 year old woman in Kalabo district has been sentenced for 24 months imprisonment with hard labour for abortion contrary to Section 152 (1) of the Penal Code Cap 87 of the Laws of Zambia.

Before Kalabo Class One Magistrate, Emmanuel Mukoma, was Nasilele Masiliso, a peasant farmer of Kakona village, Chief Kaongolo of the Western province.

Particulars of the offence were that on September 11, 2013, Edward Mwalye was at home in Kanchumwa Village around 07:00 hours when he heard dogs fighting and barking at an area where he went to and found one of the dogs with a suspected human thing of a baby.

Mr Mwalye informed other residents and with them thoroughly checked the area and in the process discovered a baby wrapped in a browse and partially buried in the ground.

The matter was later reported to police who made a quick follow-up at the scene where the dead baby was recovered.

One of the residents in the group identified the browse as being that of the accused Nasilele Masiliso.

Police then followed the accused and apprehended her at Malelekwa Compound in Kalabo Township. Masiliso gave a free and voluntary reply in admitting the charge.

She said she took a poisonous drink in order to abort.

    • No problem with pro-choice so long as its done with right facilities, not where health of mother, unborn baby and in this case the environment are all put in danger. However, as a christian, such mistakes are not corrected by another mistake. I respect the fact that the woman would love to have say over her body.

  1. Where is her husband for that matter to reach an extent drinking the so called poisonous drink. Some of these men are just shadows. Even if you dont know who the father is, why abort? anyway its sad reading

  2. Whatever happenned to condomising and being able to stand up and say no if the brother pull that trick of not having one, women carry your own condoms, you will not only serve your life but also someones life!

    • Sense Cindy it is also a responsibility of women to carry condoms and not always expect men to have condoms. It can protect one from unwanted pregnancy and STIs. Reminds me of one boss from Total called Margaret who always carried condoms in her handbag just in case you meet a rapist offer him a condom!

  3. God created man first in his own image, then after some days (in his eyes) but years later in man’s eyes, he created woman who came with all sorts of problems the world has ever seen. now wonder up to date the woman has remained to be the devil’s demons best friends.

  4. I an totally pro life and against abortion.However,It is of concern that we are treating the symptoms instead of the cause.Why did she fall pregnant and then abort in the first place?Did she have access to family planning
    methods.Sending her to jail won’t deter others from committing similar offences.

Abortion is sin and against the law, when i look at this it makes me realise that women still do not have freedom over there bodies, I tell you, in rural areas men do what they want and it remains your problem as a woman whether to keep that child. Most of women who do these abortions think they can’t afford taking care of in wanted babies.
    Women must understand that they have a choice, and there decision whether to abstain, use contraception or condoms. She pleased him and ended up sinning and locked up, the man will move on. Let’s wise up.
