Government lashes out at HH over Constitution

Government is concerned that UPND president Mr. Hakainde Hichilema, as reported in media has given his Members of Parliament express instructions to continue disrupting the Speaker and proceedings in Parliament.
Mr. Hichilema has never been a Member of Parliament in his life and should, therefore, desist from meddling and misleading his Members of Parliament on issues he least understands.
Parliament has its inbuilt systems and procedures to unlock and resolve any impasse between or among opposing parties in the House.
It is, therefore, worrying that Mr. Hichilema is disregarding parliamentary etiquette and ordering UPND MPs to continue with their protests on the constitution making process.
Mr. Hichilema should, therefore, not escalate the MPs’ protest beyond the confines of Parliament.
The position of Government as stated by the Hon. Minister of Justice Mr. Wynter Kabimba is that the document is yet to be handed-over to His Excellency the President, Mr. Michael Chilufya Sata who is the appointing authority of the Technical Committee on the Constitution.
It is a well known fact that under the MMD, there were attempts to come up with a constitution but this could not materialize.
This Government is determined to give the people of Zambia a constitution that will stand the test of time. This can not be achieved by rushing the process. The constitution is a very important document that requires all Zambians to examine with rational minds.
It is strange that parties like the MMD who understand the process very well and spent colossal sums of money on the National Constitution Conference (NCC) can now want to rush this Government to quickly enact the new Constitution.
We are also aware that a good number of UPND Members of Parliament were also part of these failed attempts.
The Patriotic Front Government is mindful of the need for a good Constitution hence the reason it revived the process immediately it came to power in 2011.
It is not the desire of this Government to embark on a process where huge sums of money will be spent but fail to yield any tangible results.
It is, therefore, in this spirit that we urge all Zambians, political parties, the Civil Society and all stakeholders to give Government time to do a good job in coming up with a roadmap towards enacting the new Constitution.
Political expedience on this crucial matter will not help the country in any way. It is important that as politicians we rise above board and objectively help the process as opposed to a partisan stance witnessed in the past few days.
Political party leaders have a duty to restrain their members from doing anything that will jeopardize the Constitution making process as opposed to leading the way in fomenting anarchy and disunity.
It is important that at times such as now, all political players genuinely support a process to which not only are they beneficiaries but that which will benefit many generations to come.
It is not time for selfish political maneuvers but for the great good of the nation.

I forgot, you want it to be officially stated by the head of state, ” I Micheal Chilufya Sata officially hand over the original copy of the Governing statutory Laws of Zambia commonly known as a Constitution to you the people of Zambia”! I think this Government is breaking away from tradition in so many ways and by now you should all know better! Just assume the leaked copy was given to you the traditional way.

May be its true you are obsessed with him. Stop mentioning MMD in this process because that is immaterial, this process is now in your incapable hands. No one is rushing the process but you have stalled it on your own…you have issued contradictory statements on your own like animal constitution! People want development not Constitution!   1. What we want is the constitution and not intimidation. It is clear that under given circumstances, were citizens cannot hold peaceful demonstrations, the only extraordinary measure to take is to use our MPs to demonstrate in parliament. If disrupting parliamentary business is what will move your Sata let it be so.

    • Let the process take it’s course, we have been demanding for the constitution for along, even PF came into power, and it’s only proper we came up with one that will stand for as long as possible. HH is an opportunist who has not brought anything on the table except lame criticisms, why does he not tell what he has to offer the Zambian masses, he is busy looking for mistakes without offering any solutions, if not he busy at war with Fred or chasing Sata, if HH wants my vote, then table your manifesto, we don’t eat Fred or Sata, what we want is more food, more work and a better life for our masses, i understand that silence is golden but sometimes it’s betrayal.

  2. Hikainde is just an opportunist and likes playing to the gallery.There is no need to rush as long we will have this document ready before 2016.Why this has failed to sink into him is beyond me.

    • We want it this year. There are all the reasons to rush. Who is not in a rush? Only those few eating from RDA and the like. The masses are in a hurry.

    • @Saulosi it’s not about HH, it is people of Zambian demanding for the delivery of a document whose process has gobble huge amounts of resources, financial, human material, time, etc. What people need is a clear road map supported by a requisite legal architecture, full stop. We cannot continually be yielding to the whims of politicians; governance is beyond individuals and parties. We are asking for a constitution.

    • Come on,this is not about the people as such.It is just the opposition trying to create a mountain out of the mole hill.This document will be released ,but it will only be done,once the proper channels have been followed.Why rushing to release it and have a half baked document when they have all the time in the world to make all the necessary corrections ?       There is no one on the Zambian political scene who goes by the name “Hikainde”. However, it’s important to examine these issues with level headedness. This is not about Hakainde, but what the country needs. Be serious.

      I wonder what proper channels you are talking about. When the committee was appointed they were given a time frame. When they asked for an extension there was noise from government and they ordered to conclude their work immediately. Upon concluding their work as ordered they tried to hand over the doc but govt (the President) has been dodging. Mind you, the hand over of the doc kicks off the process only, and does not mean the doc is a constitution!

So letting us read a concluded document can be a detriment to the nation? how? if you dont mind, could you explain it to us sir? But if ba Chilufya Sata beka babelenga ninshi elyo fyalalondoloka? The whole nation, just waiting for one man to have the time to be given a document, then later wait again for him,alone, to read it? This is unfathomable,its insane!!

    • @St Jude yes i agree that it is what the country needs but it doesn`t mean that it must be rushed.Zambians need a document that that will be error free and not an error prone one.We still have about 2 years to go before the next elections.This whole thing has come about because the opposition is trying to create a storm in a tea cup.Trust me if PF doesn`t release this document by 2016 there will be chaos, but it doesn`t make sense for the opposition to start making the situation chaotic this early.Give the government time@Jude there are always channels whenever such a document is being prepared.You have to take a look at your old junior high school civics book and understand how the government executive is structured and works

    • Not so long ago wasn’t it one Michael Chilufya Sata who was doing exactly the same thing and had the same position of “Constitution now” and harassing Levy Mwanawasa at every opportunity. Fast forward 2014, anyone calling for enactment of the draft constitution is an opportunist. What has changed? We have become more tolerant and I guess the speed of time has slowed down hence the request for the Zambian people to be patient. It very few politicians who practice mature none confrontational politics. Mr Sata should just accept that that office requires a woman/man with broad shoulders

    • The thing you have to understand is that this Constitution will come no matter what.What i`m not agreeing with is this issue is starting to politicize the whole thing.This thing has now turned into political capital for the opposition more than anything.Lets have patience ,no need to be whiny babies.

  3. Banama! The revolution is on. No spin doctoring will work until we have our people driven constitution. we already saw it and all that remains is referendum and then we have it. Soon the masses will join in the boycott in all sectors. Sata will have no choice but dissolve parliament and himself and then we will have a new election.

He said in Mansa that the country does not need a new constitution because the the current one was adequate and needed only minor changes. Secondly he said during one swearing in ceremony that Zambia does not need a people driven constitution, since there was no animal driven constitution. Thirdly your President said those who are talking about a new constitution should from now be ignored.

Michael Sata is on record saying Zambia does not need a new constitution as it already has a valid one.     • Kudos its true the President was called back by HH and he complied. Its on record. That aside, ZEC through its pastoral letter demanded for the release of the draft before HH. Again this is not about HH but about Zambians including you and Sata. It is for that reason and urgency that Sata promised us a constitution within 90 DAYS!

      I like that! But you do realise that one can always make time right? Time flies, passes us by, thats how we atleast experience it, but it actually does nothing.
      The important thing about time is what and how we do with it! As humans we are always fighting with time, with good times we want it to stand still and with bad we want the opposite!
      Time is an illusion which has made us caught up in a mystery that can never be outlined biblically or scientifiacally nomatter how much we try!
      Kudos, I realise this maybe out of the topic but coincidentally I just dealt with the topic on time a few days ago.
      As for the 90 days motto, I bet it was a marketing tool to scoop the elections by the then opposition party, I wonder why people always bring it up, every political party has one!

The 90 days we all know it was a tool used,i equally wonder UNDP keeps talking about it,what was a classic though was the don’t kubeba, it won recognition in Africa and still taught as a success at a university in Ghana school of political science . Sata is clearly an outstanding politician.

    • @ Mr Real You are right it is just the 50 + 1 they are interested in. But UPND does not know is that PF is more likely to work with MMD in an alliance in the near future. This will make it easy for PF to come back while UPND will continue where they belong THE BACK BENCH.

  16. With due respect we the people of Zambia we voted for our MPs to go to parliament and represent us either in running party or opposition party. Therefore we expect our opposition MPs to be present in parliament and represent us by debating on these important issues such as on going constitution debate. shunning away from debating on issues by UPND and MMD MPs just shows that they are incompetent to do the job we voted them for, or they not bald and ready to run the affairs of our country. Absconding parliament sessions also give PF enough time to keep manipulating Zambian people over the constitution. In these case Mr HH should be bald and encourage his MPs to stay in parliament and put pressure on government through parliament debates. UPND kosenifye unlike inciting anarchy but dialogue.

It has become a trend to gather people through social media and throw the legitimate governments and install new government and calling them Arab Spring (that now West itself understand is Arab Autumn). It has become very simple to throw any legitimate government with power of social media, western media and NGOs. Who will be the next?

Is it not this same former Ifyabukaya radio drama presenter at ZNBC who told the nation some weeks back that Government had received the draft constitution and was studying it. Mwansa kapeya you can fool some people at times but you cant fool all the people all the time. Am sure you are one of those PF useless MPs as your boss refered to you. Give us our constitution…kwasila.

  19. Honesty will help our govt in this regard. Stick to what u said earlier and treat the Zambian citizens as equal partners in this constitution making process. Otherwise, the strange silence the govt has exhibited to so many possibilities, one of which might be the dissatisfaction and rise in tension, in the country.

  21. The MPs are simply reminding the PF of it’s campaign promises, and the PF are trying to run away from their promises using trickery and subterfuge. We need a clearly laid out programme that outlines a a series of steps to be taken until the constitution is enacted. To suddenly say that we don’t need to rush, we have a functional constitution gives the impression that it is no longer a necessity, and we can continue being ruled under the existing bad constitution. You cannot wish this matter away. Deal with it.

    You see, if you are not prepared to make honest statement and try to bully minority in to submission, what other means minority has to protect their rights?
    Your Speaker does not allow expression of alternative opinions in Parliament, your Police does not allow peaceful demonstrations, there is no press freedom and radio stations have been limited in theirs transmission coverage and to add insult to injury, your cabinet colleagues are constantly threatening very same peple which they been elected to serve.
    If you do not want new Constitution, be honest and say so.

  28. We are tired of oppossion MPs behaving like fools with no reasoning capacity. If they want their message to stick they need to debate issues rather than walk out. They are playing in the hands of having a party state government and they will get it soon. Their voices will never be heard, so stop wasting time.

  29. The whole statement frm Hon. Kapeya stands hollow, HH has never been an MP but he’s sincere 2n make excellent head of state. Chiluba was never an MP b4 he ascended to presidency with landslide majority vote never recorded b4. Sata a former MP, minister got less than 40% meaning 60% zambian pipo rejected him. Let him call for new election if he’s not a dictator.

  30. One thing is true: HH factor in all this narrative is being felt by PF and causing them sleepless nights. Opposition parliamentarians and other progressive PF MPs have gotten on board of the national constitution debate that has become an issue of urgency.

  31. If HH resigned from politics today, would the demand for the constitution come to an end? Would opposition parties cease? Would the challenges the nation faces be resolved?

  34. Mr Kapeya says Kabimba’s statement is what stands; namely, that the Constitution document has yet to be handed over. But below, is what he said on the 2nd of January, 2014:

    ” Information Minister Mwansa Kapeya says government has received the draft constitution and is studying.

    Kapeya’s confirmation is in conflict with Justice Minister Wynter Kabimba who said government was yet to receive the document and so could not spell out the next step.

    The Information Minister said the draft constitution was a good document after he had read it.

    “Government is studying the document, it is a good document. I don’t know it will be ready for the public I cannot tell you right now because we are studying it,” Kapeya said.”

    • He gave it back to the technocrats for amendments before it comes back to Govt for second proof reading.meantime projects are progressing well all over the nation.

HH is a dreamer and will not win the 2016 elections even if the new constitution is enacted now.Tribalism,selfishness coupled with childishness will not HH president of Zambia.HH does not understand how governments are run,not even at local level because he has not been a councillor to know the procedures in the council chambers let alone in parliament.HH thinks he will win the presidency if the constitution comes now.HH lives in dream land,full of illusions and unrealistic dreams.Keep dreaming HH you ate entitledto dream but please spare us the political snoring,you are making too much noise for nothing!!

    KK AND CHILUBA WERE NEVER MPs AND WERE MUCH BETTER THAN SATA WHO WAS AN MP. The list is endless Obama has never been a councilor neither has been Mp before and there are countless such leaders world over emanating from background who have and are doing much far better than this Councillor “chumbu mushololwa”.
    You see PF is at again just like their tribal song such statements will not convince majority Zambians why you are dearie darling to release the long awaited constitution.
    NOT LONG AGO SATA called Levy (MHSRIP) names over this document that all of the sudden has become useless like his MPs.

  38. What is surprising is on the terms of reference the document was supposed to be released to the president and public simultaneously but again this old man mwansa kapeya is saying to the contrary and pls why do u always say its HH and UPND what about MMD and Nevers Mumba?

  39. The ministers are not honest about the Draft Constitution. The Chief Government Spokesperson Mwansa Kapeya always tells lies about the Draft Constitution. The Honorable is insincere and not trust worthy about the Draft. He has been giving conflicting information on the Draft Constitution from time to time. How can we trust his government. Although I belong to PF I support opposition MPs action.

  40. PF has just run out of breath and cluttering for a straw to survive. Dull Mwansa Kapeya need not be reminded that when he says MMD failed to give Zambians a constitution in 20 years the statement includes his paymaster, Micheal Chilufya Sata. When the MMD manipulated the constitution in 1996 to bar Kaunda from re-contesting the Presidency Sata was very much part of MMD and Government. So what’s the ifyabukaya comedian telling us?

  41. the imaturity of our dear PF Government has cost us too much. With their tongue they have decieved, with their deeds they have destroyed, with their time they have hurt us and with their arrogance they have enslaved us; They have prostituted themselves with corruption and extensive borrowing at the cost of the poor; Their ministerial clawns have danced and pranced around gaily with out-of-tune music; blaming everyone and everything they can imagine, telling lie after after lie without shame; swirling in riches like pigs playing in the mud, talkless of pearls thrown to the pigs, dressing themselves like white washed tombs drenched in a stinch of rotting flesh that will not last to 2016. Oh what cochroaches have infested our dear land… someone once sang.
