A political activist has disputed claims by the Anti-Corruption Commission (ACC) that it does not ask for permission from anyone when instituting investigations on senior government officials.
Dante Saunders said the ACC should stop cheating people that they don’t ask for permission when republican President Michael Sata publicly denounced them before instructing them to seek permission from him before they institute any investigations on senior government official.
Mr Saunders noted that though the ACC has the constitutional powers to investigate, it is finding it difficulty to do so under the current constitution which gives the president too much powers hence control over all the institutions of governance.
“My question is, why didn’t the president allow the ACC and DEC investigate Kabimba? When it came to Kabimba the President put his foot down and said no investigates my Ministers till I say so” observed Mr Saunders.
And when told that the ACC clarified that the president is only informed and not asked for permission Mr Saunders laughed off the clarification saying:” what am reading from the newspapers and issues coming from the radio stations it is clear to me what Mr Sata’s instructions were, we all know that no ACC, DEC, Judiciary or Police can act with out his instructions, in short he is the one who controls all these institutions.”
He further said these are some of the issues which should be addressed with the enactment of the new constitution hence the need for the government to release the draft document without any delay.
“That is not what we want, that is why we insist on the constitution were all institutions are given the right to do their work, were every is equal before the law,” he said.
ACC Public Relations Manager Timothy Moono told a press briefing today, that informing the president that one of his Ministers is being investigated should not be misconstrued as seeking permission because the institution does not need anyone’s permission to probe anyone.
Mr Saunders said this in an interview in Lusaka yesterday

This was my comment yesterday when the LT first posted the ‘Kambwili Probe’ entry. ACC HAD TO GET PERMISSION from the head of state. Kambwili is feared as another contestant for the PF presidency. I have no idea what qualities makes them think that anyone can waste their vote on him.
But Sata said ACC needs his permission for them to investigate his ministers. Do you remember when ACC summoned Kabimba? Sata made a comment. Where was Moono to have corrected Sata on his sentments?
What do you want in life Saunders? This is the only sitting Government in the History of this Country were we have seen serving leaders is being questioned. The only sitting leaders being investigated are those perceived to be anti Kabinga. Saunders is right, why were the corruption charges against Kabimba dropped. The president stooped the investigations.

The question ought to be: What does the current Constitution say when it comes to the independence of the ACC, DEC or the Police? Like Mr. Sanders has correctly put it, if the current Constitution allows or does NOT prevent such interferences by the executive branch, the President will keep abusing his authority. Again, I agree with Mr. Sanders that these are the issues the new Constitution should clearly spell out.
It is said that “Power corrupts, and absolute power corrupts absolutely!” This is the danger of giving too much Constitutional powers to one man/woman or Constitutional office—naturally most Presidents the world over tend to use it!
Nonetheless, at least Sata is allowing some investigations to go ahead. Unlike what we witnessed in some previous administrations.
That is the procedure when ACC has to investigate a sitting Minister or head of “sensitive” government wings. The President is informed before the investigation is conducted. He can say no if he feels the investigation is too sentitive. That happens all over the world. The only difference is that in Africa Heads of State are the law unto themselves. Both Moono and Saunders were right except Moono could not afford to add that the President can say no to some investigations as was the case with Hon. Kabimba.
Ladies and gentlemen, that is the truth. We do not have to use foul language against each other.
Each time Gen posts a comment I get injured. The man is so evil. If indeed this person is a PF cadre then he is working very hard to distance some of us from the ruling party. Yes, those with ears head when Mr Sata said that any investigations concerning his ” useless mini stars” should firstly ask him to allow it or not. I too love my history.
