HH asks Kitwe High court to lift bench warrant as summons were never served

Lawyers representing United Party for National Development (UPND) president Hakainde Hichilema has asked the Kitwe High Court to stand down a bench warrant issued against him by Judge Catherine Mukanga.

It is understood that lawyers representing the acting Chief Justice Lombe Chibesakunda who is a complainant in the matter have never served the summons on him and that the last notice was published in a newspaper advertisement.

As a result of this, the UPND legal team was not aware of the dates and could not therefore inform Mr Hichilema who until yesterday was on a campaign trail in Mangango.

The lawyer are said to have pleaded with the court to lift the bench warrant and have undertaken to ensure that Mr Hichilema would be in court at the next hearing.

The acting Chief Justice has complained to the Kitwe High Court and charged him with contempt of court.This is in a case in which acting Chief Justice Lombe Chibesakunda has applied to commit Mr Hichilema to prison for allegedly commenting on an issue when he referred to her position as acting Chief Justice.

The matter was scheduled for hearing on July 9th this year but was adjourned to August 18th after the court was informed that summons had not been served because he was not found at a given address.
Ruling comes up today.

  3. These women, where are they taking the country. We can’t have this circus when the Acting Chief Justice knows that she is occupying the office illegally. If the Chief Judge and her girls friends bring kitchen mentality to high offices is a resp for disaster. We have the same problem with the lady cops. I think this was by design by Sata. Where is the Lusaka woman Judge who made that fake Malawian judge pack his bags at mid-night? That is a man in a woman’s body!
    HH has to be strong; all this is part of process to Plot 1.

  8. HH please consider Mangango as one of those loose. You have the whole future to make strides and make that difference. It’s still that future for young

    • HH will never have future in politics because his beginning was bad based of tribal. He entered on the ticket of “Only a Tonga” can lead UPND. So, only Tongas will vote for him and his tribal Taliban political party, UPND. Therefore, Muchinga, Luapula, Northern, Urban Copperbelt, Lusaka and half Central will never vote for such a bias political leader.

  9. And you say we all have to celebrate 50 years of freedom, serious? This is persecution. How many people talked about this lady that time and how many are in court today? Is this the way you [mis]use power? Where is the freedom of speech as guaranteed by the constitution? Are you sure we are actually free? You comment on something glaringly visible and you are threatened with committal to prison. Nonsense!
