Court rejects Chiluba’s application

A LUSAKA magistrate’s court yesterday rejected an application by former Republican president Frederick Chiluba and two others requesting the Director of Public Prosecution (DPP), Chalwe M’chenga to testify as a defence witness.

The magistrate also threw out another application by the defence to seek constitutional reference to the High Court following the rejection of the earlier application to determine whether the DPP was competent to testify as a defence witness.

This is in a case in which Dr Chiluba is jointly charged with former Access Financial Services (AFS) directors, Aaron Chungu and Faustin Kabwe for theft of public resources.

Ndola deputy high court registrar Jones Chinyama, in his ruling declared Mr M’chenga as an incompetent witness because it was improper for him to testify as a defence witness in the matter because he was the accuser.

Mr Chinyama who was sitting as a magistrate said all criminal cases were brought to court by the DPP in the interest of the country and that it was not in the public interest for him to testify on behalf of the defence.

“The DPP can not be allowed to address the court from the dock or testify as a defence witness in this matter as it is not in the interest of the public, the defence is at liberty to call other witnesses”, he said.

  2. Chiluba’s case has dragged on for some years now… when are they going to lock him? the case is getting on my nerves now!!

    • Sorry Baby C, Chiluba is the cause of these delays…adjournments, SA for treatment, judicial reviews and other unbelievable requirements (how can you ask the DPP to stand in the witness box)

  3. First the sentecing, then the appeal if convicted. This will be followed up with the feigning of illness to take another 6 yrs. This man has crooked responses to all his dilema’s.

  4. Just jail the thief and his gang of plunderers. Maybe we’ll move forward as a nation. Right now we’re cursed with all these thieves manipulating us.

  5. That guy with a blue shirt is he the lawyer? So things are not that bad in Zambia, the guys looks obese.

    • That is a GRZ chauffeur driven car. He has not yet been sentenced so he is still enjoying the previledges of former president just like Dr. Kaunda. He used the same vehicle when visiting Regina at the prison. It will be the same vehicle that will drive him to Chimbokaila when he is sentenced. Only then will the driver handover the keys to Govt for safe keeping of the vehicle whilst he is in prison.

  6. It’s not as bad as it is potrayed. There are pipo who can make it and others who can’t and are really struggling but not Chiluba. Time will tell. But remermber vengence is not ours but God’s.

    • I hear you but God has also given given the ability to distinguish between right and wrong, a thief and a non thieving person etc. In God’s scheme of things sin including stealing, depriving the poor, corruption, lying is punishable. And so i am confident that the allegation against our brother will be proved right

  7. we waste so much time blogging about when he will finally pay for all the crimes commited against our beautiful country that its just so stressful, let’s leave it to the courts, whether the courts do their job or not, really doesnt depend on us. its time to think of constructive ways to help restore prosperity and dignity for every zambian person.

  8. Chiluba will not be jailed. Not in this life. The same reasons that K.K. wasnt jailed will apply to Kafupi.
    Its a wait and see game now….
