PACT members question the conviction of Katele Kalumba

The Patriotic Front (PF)has described the conviction of former Finance Minister Katele Kalumba as a political gimmick by president Rupiah Banda.

PF National youth secretary Erick Chanda says though the conviction is welcome,Dr. Kalumba has been used as a sacrificial lamb to pay to for former president Dr.Frederick Chiluba’s sins.

Mr. Chanda accused the MMD of engineering the conviction of Dr. Kalumba in order to neutralize competition at the forth coming MMD convention.

He said president Banda is jittery of Dr.Kalumba’s presidential ambitions.

Mr. Chanda questioned why the former president Chiluba has gone scot free when his aides have been jailed.

He told QFM that if the MMD government is committed to fighting corruption they should appeal against Dr. Chiluba’s acquittal.

He noted that the MMD will never fool Zambians that they are committed to fighting corruption.

And The United Party for National Development (UPND) has questioned the judiciary’s fairness following the jailing of MMD national secretary Katele Kalumba on corruption charges.

In an interview with QFM, UPND Secretary General Winstone Chibwe said the Judiciary’s jailing of Dr. Kalumba and six of his co-accused is questionable.

He said the charges the former Finance Minister has been convicted for are the same charges Second Republican President Dr.Chiluba was acquitted of.

He said there is need for the judiciary to pull up its socks especially when it come to the way it is handling corruption cases.

Mr. Chibwe has since described as unfortunate for a man of Dr. Kalumba’s caliber to be jailed for corruption.

The Lusaka magistrate court on Wednesday jailed the former Finance Minister for 5-years after finding him and his co-accused guilty of corruption involving US$20 million.

Dr. Kalumba has since filed the notice for bail pending appeal to the High Court.

  1. Typical of foolish PF leadership thinking. Please understand that the judicialy is independent- The principal of serparation of Powers and has done its work. Those of us who love Kaka we pray that his appeal succeedes. if it fails then tough luck.

  2. Were KK and the others charged jointly with Chiluba? Were they charged with the exactly the same offences? Otherwise the statements made by the opposition are rather illogical as you have to examine every case on its own merit.

These pipo have been charged as public servants who used a public institution-OP which manages a public account- ZAMTROP- there by making it illegal for private or individuals to use it as their account yet Chiluba by virtue of his office being a public leader was acquitted by one Jones Chinyama who refused to recognise chiluba as a public servant and so he was aquitted. Zambian judiciary is and has never been a fair place to be as we see poor people slapped with extreme heavy sentences e.g. the boy who stole energizer cells from shoprite in western province was slapped with a 2 or 3 year jail term and we see here some wizard getting a paultry 5 years with 100% chance of bail and another 101% chance of being aquitted by JONES CHINYAMA

  8. If it is not a political gimmick, then the government needs to register the “London Judgment” and then appeal FTJ Chiluba’s acquital.
    This is how the MMD government can convince the People of Zambia that the jailing of the tandem of thieves is not a political gimmick.

    And by the way, does Katele Kalumba, a convicted criminal, continue as MMD National Secretary?

  15. My take is that within the judiciary, there seems to be a mix of officers – those who are maleable and follow expedience, and those who are upright and uphold justice and the law. The magistrate in Katele’s case did his job honourably and I salute him! The one who dealt with Kafupi’s case trampled on justice and the law – like a beast!

    Nambala 4 Nsalama is right, some people need to get their facts right before commenting. This may be an open forum but we need to lay down properly examined arguments, not just emotional sentiments driven by malice. So far, most of the comments I’ve read about this conviction are just as vague as the details surrounding the vedict itself.

    For instance: what exactly transpired with the US$20? And IMO the US security companies Systems Innovation and Wilbain Incorporation should also be persecuted and charged since there are always 2 sides in a corruption case. We need more answers, not questions.

  17. #17 has raised a very interesting issue! you jail a possessor while quitting the giver! so its either Regina is equally aquitted or chiluba shud go in the gaol. we are tired of some of these judicial jargon of over turning rulings and also having some judge being told he/she overstepped his/her authority etc. why cant we have a clean up in the courts of law so that they speak with one solid, sincere and just voice

  18. Hmmm. Hasn’t the country been crying for convictions of plunderers. The thing is, whether or not this presents a political advantage to RB, Katele has been found guilty by a competent court. Of course, it would have been nice if FTJ had been similarly convicted (I would have been delighted personally)but the courts let him go based on the evidence (or lack thereof) presented by the prosecution. If one commits a crime, it is folly to say that he/she is innocent because another alleged criminal has been acquitted on similar charges.

  21. it remains to be see whether Katele actually goes in, it’s on appeal. Chi luba was on appeal for many years and finally acquitted so don’t start celebrating too much ma bootlickers

  22. If he was acquited, they would have said it’s Bwezani’s interference with the judiciary. He’s convicted, they say it’s a political gimmick. Very imposible group of people to deal with!!! This is how the opposition derail progress by opposition anything and everything.

If the govt engineered the FTJ acquital – why have they been silent on this one? It is a valid question. Why engineer one judgement and not all the others – it is not because RB now cares for justice – there is another reason. This is the point PF are making. Ok, perhaps the chap wasn’t very articulate.

  25. All of you are saying the same thing but in different toungues. Yes KK is a thief and should not even be granted bail.Political gimmick? Depends on how you want(note want)to perceive the whole comical judgement. Releasing some body just because he has returned the loot is wrong. By returning the stolen property one just stregthens the evidence against that one.In my opinion RB wants Luapula very much. He allows KK to go to prison. He then rings Chief Mununga uncle of KK and asks him to assure him of the vote in exchange of KK’s release. KK appeals and allcharges are dropped and continues as MP for Chiengi.This not a James Hardley Chase Thriller it is a reality here in Zambia.But just as FTJ’s meeting flopped this one will not sell. We are alert in Luapula. We are not Salaula for cheap…

  27. Katele’s jailing is welcome, Yes as other people have indicated, a THIEF is a THIEF, a LAZO. So katele is a thief SO IS FTJ a small arms man that dug deep. We give a lot of money toour politicians but they go ahead and abuse us by stealing our wealth.

    Zambia should turn into a political-less, Party-less democracy, were the citizens decide what to be done. maybe but I shudder to think Kabonde as the head of the Police.

  35. If the Zambian Judiary was free, Chiluba and mabenga would be behind bars. So, don’t fool yourselves; Chiluba will never be found guilty for as long as RB is in power, just like Sata has been spared over Merzaf, the Chibesakunda MMD funds saga, the electioneering violence in one Lusaka shanty compound when he was MMD zealot, just like William Banda, etc.

  36. Five individuals can get together and commit a crime. When they are charged and presented before the courts, it may be found that there is not enough evidence to convict one or two of the group depending on what role they are alleged to have played in the act. A court is never there at the time a crime is committed – it listens to, and assesses the prosecution’s evidence. The burden is mostly on the prosecution to make their case against each individual. We should refrain from assuming that because one person has been convicted, it follows that another person alleged to have been acting with that perason, should also have been found guilty. Sometimes the prosecution’s case is not convincing enough in relation to some individuals. Admittedly, politics do also occassionally have influence.

Our comments are as aresult of the funny manouveres by MMD.If your father tells you 2 different stories about one subject are you going to trust him the third time? Iam in Zambia like you and I have seen how cases are manuplated. Right here in Kitwe there is an MMD official who is involved big in money laundering and all the DEC have done is to invite him to assist them with investigations. He has not respondended and the case has lost some its momentum

    As for MMD convicted National Secretary Dr Katele Kalumba, I believe he still has a chance to help Zambia get rid of Mr President RB Banda lead MMD because I believe he is a good chess player. Dr Kalumba can help destroy the MMD even from a jail cell if bail is not granted him. I therefore look forward to his helping Zambia get real progressive leadership in 2011.

    Harold M- Those given suspended sentences were as guilty as Kalumba. The only reason they are out is that they returned the money.To me this just edified the evidence against them, while Kalumba’s guilty can be desputed since he did not directly or indirectly admit any thing.If me as poor man steals and returns maize, I will still go to jail.

  40. The degree of the independence of the judiciary varies from country to country. While in some nations it is almost completely compromised, in some, it depends on the justices hearing a case, and the influences of the politics of the day that may bear on some of them. It is not a secret that sometimes judges will weigh the consequences of making a particular decision against the need for stability in the nation. They make a decision blatantly in that regard, or hide behind some acrobatic legal jargon. In my opinion, though, all corruption cases should be dealt with comprehensively through truly independent professional bodies and the culprits severely punished. The consequences of corruption are actually largely underestimated. They lie at the foundation of a lot of a nation’s misery.

    Let’s seek to entrench a fair and independed judiciary. It’ll be good for all of us. No good to politcize everything they do.

  43. I can’t understand what PF guys are compaining about concerning the conviction of KK. I thought ‘The Cobra’ had promised to release all these crooks once elected into State House. Infact we should praise the MMD guys for at least making those guys nunsha the inside of a prison. PF promised to unilaterally release them and immediately abolish the Task force on corruption. That’s why I have always insisted that real change can only happen if we got rid of this breed of perpetual politicians such as MC, RB, VJ, Sikota Wina, and the like. Reading through the lastest Auditor General’s report for 2008 it would appear everything has brokendown and it would take a real revolution for this country to move forward.The imprest mode of doing business in Zambia has killed us. If what has been written about Hon.G.Mpombo is true, then we are in trouble as a country!

  49. This is simply the maintenance of the status quo…hegemony in other words! Whether strategically/timely done is not the issue. The fact of the matter is that Katele et al., will never see the insides of a jail cell. The scandal involving these n-m nuts includes the sum of $20million of public funds…this is nothing compared to a car thief or somebody caught with a few grams of weed! Current evidence in relation to the Zed judicial system shows that if you still a car, pick pocket or get involved in something small time, you will get a lengthy prison time with hard labour. Sill $500m plus…no problem…as seen!
