Court throws out Zamtel bid to nullify DEC’s move to freeze accounts

The Lusaka high court has thrown out a bid for Zamtel to quash the move by the Drug Enforcement Commission-DEC to freeze its accounts saying the action was done in the course of criminal investigations.

In his ruling Lusaka high court judge Evans Hamaundu said he could not stay the execution of seizure notices as this will allow ZAMTEL temper with the accounts which are intended exhibits.

Judge Hamaundu says freezing of ZAMTEL accounts was done on suspicions that there was money laundering involved.

Zamtel requested the court to grant it judicial review which would automatically evoke a stay the execution of the DEC seizer notices.

Meanwhile, various stakeholders and members of the public have welcomed the takeover of the 75 percent stake owned by LAP Green of Libya in zamtel.

Transparency International Zambia says the takeover was predictable.

TIZ executive director Goodwell Lungu says civil society organisations and members of the public who opposed the transaction have been vindicated.

He has called on the PF government to exercise caution when managing the operations of the telecommunication company to avoid a repeat of transactions marred with illegality.

And former Finance minister Ng’andu Magande has also welcomed government’s decision to take over the parastatal.

Mr Magande however says it remains to be seen what move the managers of Lap Green will take next.

Meanwhile, UNIP president Tilyenji Kaunda says the reversal of the ZAMTEL transaction could not have come at a better time than now.

He said the takeover of ZAMTEL will send a message along the political corridor that people ought to make decisions in the interest of the public.

Mr Kaunda says it is clear from the government decision that no politician should think og oneself at the expense of public interest.

And former Bankers Union of Zambia president Lucky Beene says the takeover is in the best interest of the nation.

In another development, several Lusaka residents have praised president Sata’s government for taking over the management of ZAMTEL, saying it was long overdue.

Wilbroad Mulenga has observed that the measure will sustain economic development, while creating more jobs by empowering Zambians by owning shares in the company.

  2. this is great news, even oposition has commended the government over the move. and the appointment of the C.E.O thumbs up. the man is well educated and is the ryt man for the job, this is progress, just an innovative board missing 
    As uneducated as he is sata has made very good appointments and decisions and his standing firm unlike banda with Economics no matter how mach people criticize, the majority is not always right, when things start turning positive the majority become minority.
    the slashing off of zeros was a brilliant ideal. now we can know what our true inflation rate is to a real figure and try hamonise the currency rather than have hypothitical figures.. inflation fell to 7% at one point but it couldnt reflect economic imrovements.. MCS is trying but his not perfect.

  4. Can someone explain Why Chinese don’t pay PAYE tax but they work on Zambian soil? Check ZRA payroll system, Check Huawei, zte and chambishi mine payroll systems at ZRA. Its unfair.

  5. I must say, I have been following a lot of developments since the PF take over with a lot of interest. It is like all of a sudden, we have a new Zambia with decisions made in the last 120 days to the betterment of the nation than we saw previously. This is really funny coming from me but I really like what I see … another good move. I had almost given up on my native homeland but I am revived knowing we can make our nation another a glorious beacon of hope it once was. The jurists make yet another great decision here, everything rises and falls on leadership – Jon Maxwell was right … kudos to you because Zambia Is Greater Than Any Single One Of Us!!!

  6. @Pondomona, It would be wonderful to raise the quality of our debates on the blog to a level that shows that we are intelligent and rational human beings. Please let us keep away from derogatory or vulgar language. BBC Have Your Say has such excellent house rules we can do well to adopt. Having said so, reposessing ZAMTEL is welcome news. My plea is with government and management of ZAMTEL to run the company so well that critics will be silenced. We want after 5 years to look back and say that it was a good decision to reposses ZAMTEL

  8. Its a good news. I now have a confidence in our leadership and our country. I must be thinking of going back to my country and help develop it. My Thumps are up to Michael Sata to be the president of that rich nation. God brought him there at a time when we needed his couragious stand. God was preparing him for a work like this. I don’t think HH would have handled the heat our president is going through. We need Sata now but he was given to Zambia by God.

    I don’t know about Sata being sent by God. To me, politicians are politicians! We have good ones (like Sata seems to be) and we have bad one (like Chiluba and RB where). Nonetheless, good move by PF!!! Time to save up for those Zamtel shares soon to be offered to the public. Who knows, in 10 years I might become a real milionier, unlike fake kwacha billioniers like Liato, LOL!!!!!

  10. Sata is a patriot and a true son of mother Zambia. He has put country first before self not the foreigner who wanted to enrich himself and his children together with his minions and bootlickers. I guess it is pay back time and we await to see how smart Dora will outsmart sata since she outsmarted RB. This is a great lesson to our leaders, real power belongs to the people and not positions that come with political appointments. Next move is to Cage all those who were involved in this rotten scam. Musokotwane must be suffering from diarrhoeal together with Dora. Remember what goes around comes around. Careful you who are in PF its a timely warning. Don’t say you were not told.

  14. I think its better for the PF Govt to sale the company in a proper manner….we all know that government can not manage to run a telecommunication company….This might bring the down fall of PF….

At least we are now moving ahead as a nation.I used to feel experience pain, being away from my motherland, and hearing how our nation was disintergrating, and the lives of people being shattered.At least, I can afford a smile, and will surely contribute my part when time comes to go back to my motherland.Congrats, our new govt.U have made us proud.

This is a very good move which has been taken in the best interest of the Country, but my appeal to the appointed auothrity is never to consider those guys who worked with the former ZAMTEL- MD Mukela Muyunda coz those guys contributed to the mess which was done at ZAMTEL.We have alot of guys who are capable of running that company profitably.The top management which was there prior to the sell of ZAMTEL were all dull pipo who did not understand a single thing.

The previous top management was useless, so useless that all they knew was to tell lies to the employees.Can you imagine up to this time some former ZAMTEL employees have not received their pension from ZSIC.Bushe ba ZISC are they untouchable for them to be paying pensioneers at they own pace.No wonder these parastals have now gone to dogs who can’t work with the sense of urgency can the PF govt overhaul these parastals.Why should we wait to act when pipo are crying day and night.ZISC can you pay the remaining ZAMTEL pensoneers now.

True Mwanamayo, parastals will not improve for as long as we the same dull managers continue to hold those offices.Why should the PF govt allow ZSIC to be working on one assignment of paying ZAMTEL pensioneers for over a year, These people were contributing to the pension scheme every month,but here comes a time to pay them it becomes an issue.

NOW THAT THE SELL OF ZAMTEL HAS BEEN REVERSED ON THE INTEREST OF THE COUNTRY BECAUSE IT WAS ILLEGAL, ARE WE GOING TO SEE THOSE INVOLVED IN THE ILLEGEL SALE OF TELECOMUNICATION COMPANY BEHIND BARS I MEAN IN PRISON NOT EVEN HOUSE ARREST OR BAIL PENDIND APPEAL TILL ALL THE WITNESSES DIE??????
