Suspension of three judges shocks MMD

The movement for multi democracy MMD has expressed shock on the suspension on three high court judges by President Michael Sata.

MMD acting president Michael Mabenga says that the manner in which the decision was made raises serious questions on the judicial process in Zambia.

Mr. Mabenga says decisions regarding the suspension of judges are of great magnitude and are exceptionally rare.

He says that such drastic decisions are only fearfully entertained after thorough reflection and due consideration of all possible harmful effects they will have on the system of arbitration.

He says that while the MMD believes in an aggressive fight against corruption is necessary and that judicial reform is required, arbitrary and fragmented executive decisions should not be taken that give the impression that the president is seeking to protect certain stakeholder partisan interest in disregard of the integrity of the bench.

Mr. Mabenga says that though the MMD might not be privy to the full facts regarding the cases itemized as a term of reference for the said tribunal, the party believes that the hurried nature and timing of the action taken leads itself to suspicion that they are other fundamental wrongs and injustices that may be committed as a result of the presidential decision.

    Ubufumu busheta amenshi. Welcome to the club that you pricks engineered. You thought you were immune, bought a few judges and  prayed you could still win. After all,an elected president by zambians as we have been singing for so many years, has been endowed by God. Whoever wants to question the integrity of Jehovah, should start from Dr Kaunda, then Dr Chiluba, Dr Mwanawasa and finally Rupiah Banda.

    Hon.Mabenga you might not know indeed but the Almighty God in heaven knows exactly whats going on and he’ll vindicate the Judges Mutuna ,Kajimanga and Musonda.Zambians will come to know the real truth about the Devil’s hand in all this evil matter.God bless Zambia because we are bigger than one named retiree Ukwa.

    Mabenga, let Sata clen teh system so that convicts like you are properly loocked up. You have no integrity to question actions of non convicts who want to clean our justice system. Once cleaned, we will ask them to reopen your case and punish correctly. We are tired of you, senseless thieves.

    Bloggers you have all well spoken, everybody knew about the unprecedented corruption in the previous regime, so definately every sector need to be cleaned – questionable acquittals, disbanding of the Task Force for strange reasons, removal of the office of abuse clause, ZAMTEL SAGA, DORA TRIBUNAL quickly appointed Minister again.     This is very interesting. From the few messages posted on this blogg ,, my simple understanding is that very few of you followed the case of DBZ vs THE POST AND METEMBO NCHITO. First you should understand that it is true they borrowed the money in question and so they are not immotal. Judge Mutuna never errored when he passesd that judgement. You should also understand that DBZ is our Bank (Zambians). So what is the problem with our president?
    Can somebody advice him to appoint a legal advisor, political advisor and the economical advisor, maybe these can help “our” president do things with humor…..Awe bane TUKOSE

    The fact of the matter is that the Judgment rendered by Judge Mutuna was sound and the 20 Billion tax payers money just has to be paid back…. PERIOD! Suspending three Judges merely to protect ‘friends’ is callous considering that there are thousands of litigants whose matters were being presided over by those Judges whose fate is now on PAUSE much to the detriment and inconvenience the aforesaid litigants who in most cases are poor and desperate Zambians seeking justice!

    MMD top wigs started plundering through the intelligence agency falsely believing that nobody would open the can of worms! Well, somebody did and the pong therefrom shocked the world! Much later the same MMD started abusing the people through the judges falsely believing that nobody would investigate the judiciary! Well somebody has and all the corruption will soon be exposed! All those found wanting should be asked to resign so that the tax payer is spared the indignity of paying life pensions to corrupt judges!

    Bane, lets wait for the sitings to commence and make informed judgement. If they are innocent, they will be aquitted and if found guilty the tribunal will recommend what will happen to them. There was acomplaint against these learned judges from LAZ and individuals among whom are Membe and Nchito and what the President did was to follow the constitution and constitute a tribunal. @Gunner for life, ypur concern is not a problem, the Judiciary and indeed a system does not operate in a vacuum, the pending cases will be dealt with by other competent judges following a laid down proceedure. I rest my case

    I also know for sure that Judge Musonda is very corrupt.Criminal always get shocked when caught,You ain t seen nothing yet.We told you that the day of atonement for all those criminals will come,they ran but couldnt hide.They will be shall smoked out  one by one whether judge,army commander  or common cadre.

    MMD that is the reason why people voted you out of power, too much corruption in judiciary. How did Dora and Chiluba manage to get cleared by the courts? Ba Sata purge out all the corrupt judges, but we must also watch out for the cadre judges coz they might spoil the good cause of rooting out corruption.

    President is virtually a PRISONER of Mmembe’s modern version of BLACKMAIL for having campaigned for PF electrion victory. The President’s appointment of the Tribunal without recourse to laid down procedures where the Chief Justice is expected to recommend procedural steps to the President has created a thick misty cloud to hide the true evil intetions of the EVIL OF AXIS between Mmembe/Nchito as political sponsors and President Sata as the beneficiary of the election his victory. The folly of actors will very soon expose the true colours of the costumes that hibernate high level trickery of Mutembo Nchito and Mmembe in theri vigorous efforts to get away with the crimes of fraudlently stealing public money from DBZ and the peoples’ savings in Finance Bank.

    Since when is making a ruling that requires a debtor to pay back what he owes become a crime (corruption)? The corrupt elements are those that have used the law to try and get out of their obligations. I hope the international community is following this case closely, part of the money in question come fom their loans and they will be as interested as the rest of us to know where it eventually ended up.

    Ka Phillip Musonda brought this on himself, bu kamikaze corruption bwachilile mo! He freed both Dora and refused to register the London judgement against Chiluba without any legal basis whatsoever and his sudden promotion by Bwezani to the supreme bench was nothing but shameful stinking pay back!     It seems most bloggers here are far away from home and are talking without reality. Things at home are not okey, and we must face it. The president is governing with influence of M’membe, Nchitos and malila to attain their personal and selfish goals. We should not be supporting this. One day one of us or our relatives will cross paths with this clique or a relative to this clique, you think you will get a fair outcome if you take such to court? lets be reasonable. This clique of Lawyers are using the law to RAPE this country with its legs wide open in full view of all of us.

    Tukose seems to be missing the point here. Why didn’t judge Mutuna let Judge Wood deal with the matter and instead applied unorthodox methods to retrieve the case? there in lies the answer. Judge Chishimba was faced with a similar matter, but she refused to go ahead with a similar case until the case was properly before her, following the proper channels. To see justice, you must be prepared to stand up for yourself. Secondly, it’s not only in Court that you get justice.
