Task Force’s appeal against Chiluba’s Judgement is illegal-CC

The Committee of Citizens (CC) says it is disappointed with the manner Task Force Chairman Max Nkole has continued to mislead the nation over second Republican President Fredrick Chiluba’s judgment.

CC Executive Director, Gregory Chifire says the CC is dismayed with a story in one of the tabloids purporting that Mr Nkole has appealed against the judgment in Dr Chiluba’s judgment.

Mr Chifire explained that the Task Force has no legal right to sue on any Government Legal matters and that according to article 56(4)(6), the constitution only mandates the Director of Public Prosecution with such matters.

He said this in a media statement obtained by ZANIS in Lusaka today.

Mr Chifire said Mr Nkole cannot attain these duties using whatever methods as that would be illegal and could amount to an attempt to create constitution anarchy.

He said he is disappointed with the manner Mr Nkole has been misleading the nation on many legal matters and has since urged President Rupiah Banda to relieve the Task Force Chairman of his duties before embarrassing himself on matters of law.

Mr Chifire further said calls by Mr Nkole that the Task Force now wants to pursue the Carlington maize saga and the arms deal should not be entertained as it is only meant to justify their existence.[quote]

He wondered why the Task Force on corruption did not want to pursue the above named cases together with the other cases if they were very important.

The CC Executive Director said if the Zambian people wanted to pursue these cases , there were legally mandated institutions such as the Anti Corruption Commission (ACC) and the Drug Enforcement Commission (DEC) that could pursue the matter and not the Task Force.

He has advised Mr Nkole against using blackmail in order to justify the existence of the task force.

He said time has come for the Task Force to be disbanded so that the already existing investigating and prosecuting wings of Government can be empowered to enhance their operations.

Mr Chifire further charged that claims by Mr Nkole are only driven by the huge allowances he and his colleagues in the Task Force were getting and not by the desire for service to the Zambian people.

  6. Gregory Chifire must know that this is a case involving public funds and therefore any citizen has legal right to sue or appeal against Chiluba, who is accused of stealing public funds.

    Mr Gregory Chifire must not mislead us!
    If he has a personal vendetta against Mr. Nkole, let him vent it through some other channels.

    The Task Force is Zambian and has the right to say something and anything in Chiluba’s case.

  8. #3, Max Nkole can file an appeal under the mandate of the Task Force as set out at the time of creation, if he thinks there was miscarriage of justice. As for Rupia’s comments on accepting the judgement, it is the duty of the President to support the Judiciary and he can not be seen to undermine the independence of the Judiciary. The only draw back in this saga has been the failure of the Chief Justice to support his magistrate. When a magistrate is under attack it is the duty of the CJ to defend him and his independence. This is what Skinner had to do when he defended a white magistrate who freed Portugese soldiers who entered Zambia illegally.

We analyse and look at issues critically if you are convinced that FTJ is innocent why are you DEAD scared of an APPEAL? Let him prove his innocence in the High Court again coz that’s what the laws of the land demand. So Nkole is on track and don’t misled us. Nkole doesn’t need anyone’s permission to appeal Bwana! He heads the task force so he is mandated to appeal against any judgment he is not agreeable to. We know the law so don’t fool us with George Kunda’s propaganda.

  14. No. 10 Nkole Wamapembwe.Yes when Judge Skinner freed fellow whites (soldiers) from Potuguese Angola. There was an outcry by nationalistic Zambians condeming the judgement. Zambia Youth Service recruits were mobilized from Mumbwa camp and there was total disorder at the Supreme Court builings. One of the lions head was damaged and the learned judge was forced to resign and he ended up in Malawi. I dont think its right for CJ to pass comments. This who thing will not go any where the politicians have taken over now that the courts of law have passed judgement in favour of FTJ. As for Max Nkole, wait the man will have his fingers burnt. Its very difficult to determine how far the apeal will go as at now pipo are divided with the likes Gregory Chifire, etc alot of guys ve bin hired det weki

What has happened to the Mwanawasa legacy? How will the Mwanawasa legacy help MMD in 2011? While the message makes sense, the manner in which Mr Chifire is coming out is suspicious. Firstly, Mr Chifire appears as if he is from Eastern Province from which Chief Mpezeni who just supported President Banda on the Chiluba judgement comes from including President RB Banda and Chief Justice E. Sakala.

  19. Number 13 you have no right to insult Nkole like that. You are also speaking from ignorance you dont really know what happened. What if there were other forces influencing the judgement in favour of Chiluba would you still say that Nkole was incompete?Just argue with credible points and not insults.

  20. The Main case has been lost and we have lost a lot of money through allowances of the task force, therefore Let us forget about the task force and concentrate about development. Let the ACC who are mandeted to investigate and prosecute continue their task. No one can win this kafupi case. There are forces shielding him so that there in future come and escape the wrath.

He is just a shemeless failure who failed do finish his studies at C.B.U.
