Katele Kalumba sues DEC, AG, Barclays

Share

MMD National secretary Katele Kalumba has taken the Drug Enforcement Commission (DEC), commissioner, the Attorney General and Barclays Bank to court for placing a seizure order on his Barclays account.

In his affidavit filed in the Lusaka High Court on September 9 this year by his lawyer, Clavel Sianondo from Malambo and Company, Dr Kalumba states that the decision taken by DEC to seize his account was irrational and without justifiable reasons.

Dr Kalumba of Lake View House, Natende in Chiengi District also indicates that DEC’s decision was illegal, wrong at law and contrary to natural justice.

He is now seeking an order of certiorari from the High Court to quash a decision made by DEC on July 12, 2002 when it was decided that account number 1054382 belonging to the applicant held by the third respondent be seized.

He was also praying for an order of mandamus directing DEC and Barclays to restore the applicant’s account by removing the notice of seizure.

Dr Katele is also demanding a declaration that the decision by DEC was invalid and void and of no effect and that all necessary and consequential directions be given to other respondents.

He prays: “That all proceedings on the said decision be stayed until after the hearing of the motion or further order.”

  3. The failure and internal influence caused by this corrupt govt to the judicial system is a cancerous symptom which every Zambian regardless his/ her political affiliation must disannounce. Saturating and making the judicial so porous has deadly future calamity. The Judicial sysstem has entered into the worst stage where no one sees it fit for the purpose.
The traditional courts are better placed than courts which are so meaningless and has lost their values and principles to be just and impartial. There are laws for the govt, rich, political cadres and the ordinary or the poor of the poorest. Kalumba has seen and witnessed the demise of rule of law in Zambia. Keep it up Kaluba ‘ichila chansaka umo a chileta ngachaisa chindeni bonse. ‘

  8. #3 . Kambongolo.. Don’t u think that giving the money back will promote corruption? Katele and Chiluba should explain how they acquire that money if given from well wishers, who are they and why they give them that money. IT MIGHT HAVE BEEN GIVEN TO THEM OUT OF BRIBES. Chiluba’s acquitation was on 500,000 dollars. What about other amounts as tabled by the London court???? How did he use the money from privatalisation of parastal companies?? Why depositing his money in Zamtrop account as if he doesn’t have own account?? More question are there, Nkole knows much about these dirty tricks.
