Forum for Democracy and Development (FDD) vice president Chifumu Banda has scooped the Chairmanship of the National Constitutional Conference (NCC).
Mr. Banda scooped the chairmanship after polling 320 votes against Lusaka lawyer, Patrick Matibini who attracted 106 votes.
The total number of votes cast was 427, only one vote was rejected.
After the voting process which kicked off at 14:30 hours and closed at 15:30 hours, returning officer Josephine Mubita, from the Electoral Commission of Zambia (ECZ), declared Mr. Banda duly elected.
Mr. Banda has since declared that the NCC has huge challenge lying ahead to give Zambians a good constitution which will stand the test of time.
He said all members of the NCC should work towards coming up with a constitution which will satisfy the Zambian people.
And Mr. Matibini, who conceded defeat, said being a believer of democracy, he was not bitter about the results.
He said he would continue being party to the NCC as a representative of the Law Association of Zambia.
Lusaka lawyer Mwangala Zaloumis yesterday went through unopposed for the position of NCC spokesperson.
Meanwhile, returning officer Josephine Mubita has since said because the chairmanship of the NCC has been scooped by a man, two of the three positions for vice chairperson of the NCC should go to women.
Nominations for the vice chairpersons are underway.
Josephine Mibita, it’s not about gender, but the ability to do the job. Let the qualified people, whether men or women, vie for these positions. The question of gender balancing should not entertained when it comes important functions.

CHIEF Government spokesperson, Mike Mulongoti has urged three Lusaka residents who have petitioned the National Constitutional Conference (NCC) to restore the Barotseland Agreement in the Constitution, not to prompt divisive issues.

I have no strong views about the current topic except to say that Zambia has been hijacked by lawyers. They seem to be everywhere. One cannot say anything without a lawyer popping up somewhere. I think it is time the country sorted out its priorities. We need engineers and scientists in power like they have in China and India. May be only then will we see Zambians economically empowered.

Since they are present in the NCC and all resolution are carried by a marjority vote, then they will have no legal or moral leg to stand on tom go against the final resolutions of the NCC. The current NCC boycott is ineffective by any measure. NCC has remained a nationally accepted cause with all the legitimacy. Political change is realized when unconventional political behavior is combined with conventional modes of political action and almost not effective when done by actors lacking voters’ mandate in positions of command if proved serving by virtue of self imposition.
The reason why many strategists have found unconventional political behavior to have little effect on government driven causes is because of the focus at the national level void in boycotts such as PF one to the NCC.Unconventional political behavior, or protest activity, is often thought of and analyzed as mass movements that garner national attention than cadres only the blunder PF has made.

This important body of men and women who have been carefully chosen to represent various levels of our citizenry are charged with responsibility to discuss and adopt a draft Republican Constitution for presentation to Parliament for enactment.
This is a solemn and privileged responsibility which must be discharged by all of you in a very responsible, objective, non-partisan and patriotic manner.Ruling political parties, governments and presidents come and go.We must make a document which, to use common parlance, will stand the test of time.I am happy to note that our people are increasingly becoming conscious of their democratic rights.
Ladies and gentlemen, the NCC is a democratic process in which Government seeks to consult its people.I support this democratic system of governance and in my view I can think of no better system.From time to time, the government should pay attention to the views of the people.
It is healthy to constructively criticise the decisions of Government but dissent must be reasonable and should at all times avoid to be malicious.A few days ago, I said: “In Zambia, the collapse of strongman politics of the One Party State and ushering in of multi-party politics with the express licence to speak our minds freely, has not translated into a sudden positive embrace for politicians and political institutions.
“To the contrary, ladies and gentlemen, a careful reading of our local media leaves one with the disturbing impression that a new elite ideology is emerging. This is the ideology that is nurturing the view that politics itself must not be given the capacity to lead.

Ladies and gentlemen, initially Government took a position of Constitution review which basically was that we did not support amending or repealing the Constitution by way of constituent assembly and by way of holding a referendum as these were expensive processes which this country and the financial resources which it had at its disposal could not bear.
We felt very strongly about this view and we would rather have preferred that such financial resources if they were avalaible should be used on other projects which directly benefit our people and help to bring relief to the majority of our poor and the unemployed.
The resources could be used to build schools, hospitals and purchasing books, equipment and drugs. This view was vehemently opposed to by some of our people especially some opposition political parties, some sections of the church and civil society.
Ultimately at a summit of party presidents whose political parties are members of the Zambia Centre for Inter-party Dialogue (ZCID), a compromise was reached that we as a nation should go the route of the national constitution conference which although still expensive
was far much cheaper and would be created by statute and so enable it to draw financial resources from the national treasury. the national constitution conference (ncc) was conceived under these circumstances and appeared to be supported by all the major political parties who attended that summit.
I am unable to understand therefore why sections of our community should raise vexatious dissent and critcise the huge, reckless exhorbitant use of tax payers money on the NCC which could best be spent on poverty reduction projects.Let us not go over this issue, it is now history. We have given in to the people’s will!
You will see from the provisions of the Act that I play very little role in this process. This again is more in line with the wishes of the people.The composition of the Conference under section 4(1) of the Act conforms to and in fact exceeds the composition which was recommended by the Mungomba Constitution Review Commission.
The conference has a total membership of over 450.It is representative of all the various social interests in the country, is inclusive, broad-based and promotes gender representation as stipulated in subsections (2) and (3) of section four.
I want to end by emphasising that the function of the NCC is to debate, adopt and recommend a draft constitution to Parliament for legislation.It must always be remembered that the legislative power in this country is vested in Parliament under Article 62 of the present Constitution of Zambia.
Members of Parliament are made members of this conference so that we can seek to reduce the amount of dissent when the bill is presented for debate and legislation in Parliament.May God bless you all and may God bless our nation.

Your history is twisted, the Luyi are not Lozi. People who speak the Lozi language are descendants of the Kololo who came into Zambia in the 1850s onwards. Technically there is no tribe called Lozi. The group that came into Zambia as early as the Tonga or before that is most likely the Nkoya groups. There is no one to dispute that fact. All Zambian groups where running away from some other neighbouring groups. In essence we have all evolved into Zambians.

Historian, get your facts correct. When the Kololo came to Zambia after 1835, they conquered the Luyi and ruled for a few years. The Luyi people, who ran away to the outskirts of the province, regrouped and reclaimed power in 1864. In effect, the only thing that changed was the adoption of the Kololo language, now called Lozi, but the people effectively remained Luyi. The few Kololos remaining were assimilated.If you consider 90% of all Lozi names (error margin of 10%)they are all Luyi names

The Kololos conquered all the Luyis but the Nyengos in Kalabo who ensured that the ruling lineage was preserved and the throne recclaimed in 1864. You will be interested to know that the famous Lozi King Lubosi Lewanika, who was born in the Nyengo area at the time of the Kololo occupation, is not Kololo but Luyi.

When one studies various individual histories of each group in Zambia, like I have as a historian, one would find for example that the history of the neighbouring Nkoya who are all over that region before the Kololo arrived used to refer to the early Kololo groups that were coming from the south as Luyi which means according to the Nkoya language Visitors i.e. Luyi = Visitor. It means therefore that there was no group called Luyi as a tribe. Part 1
The Luyi according to the Nkoya were just an earlier Kololo breakaway group that came to settle in the South Western area of Zambia in the 1820s just before the other Kololo group came to conquer them. The Nkoya had settled around the Kalabo – Mongu area as early as the 8th century onwards and it is written in a history manual called Likota Lya Ba Nkoya which is readily available online for both academic and historical inspection and reference to give historical facts of that part of history.P2
Many historians ask the question, why is it that the Kololo only conquered the so called Visitors (Luyi) and not the Tonga who the Kololo first encountered when entering Zambia from the South or why did they not conquer the Nkoya (not Nyengo) who they found giving refuge to the running groups including Lewanika and his exiled group in Nkoya areas?

We seem to be in a cage of dependence on the West hence reducing our selves to beggars rather than striving to become our own masters. We stand in the scorching heat every 24th October celebrating our independent but deep down each and every Zambian soul, ask your self, “are we really independent, are we really free”.
