Noisy Churches to Face the Wrath of the Law

The Lusaka City Council (LCC) has maintained that churches contributing to noise pollution in residential areas would face the wrath of the law.

LCC Public Relations Manager Chanda Makanta told ZANIS in an interview that churches adding to noise pollution in residential areas would be slapped with a penalty fee.

Mrs. Makanta said the resolve by the local authority follows mounting complaints from some residents in the city about some churches being a source of noise pollution during worship and noisy overnight prayers.

She pointed out that it is not right to expect the council to ignore such complaints because they involve the church.

Mrs. Makanta said the law applies to all persons, groups or organizations inclusive of the church.

She said it is unfortunate that some churches have since issued statements accusing the local authority of malice against the church.

Mrs. Makanta said statutory instrument number 44 of 2007 under local government chapter 281 of the laws of Zambia states that public gatherings in residential areas, such as church gatherings and parties, playing loud music likely to disturb residents, will attract a penalty fee of at least K450, 000.

She added that the council is further concerned at the increasing number of churches in residential areas that are breaching the Public Order and Nuisance Act.

Mrs. Makanta has since appealed to churches to conduct their prayer sessions in harmony with the laws.

Meanwhile, Mrs. Makanta has refuted allegations by car dealers in the city that the council is giving preferential treatment to foreign investor car dealers who trade from show rooms.

She announced that the council is currently trying to identify a piece of land where the local car dealers can sale their automobiles.

Mrs. Makanta said the local authority would soon call for a meeting with the car dealers to chart the way forward.

She said the council is concerned at the congestion caused in the central business district adding that the council is not against the local car dealers.

Mrs. Makanta stressed that automobiles are supposed to be sold in recognized show rooms in accordance with the stipulations of the law.

Some peoples lives are changed due to worship and become good citizens.Some attended church for other reasons but even so the church is the right place for one to vist for at one time you never know what would happen in somebodies mind.We must be carefull when we talk about issues pertaining to God because everyone who do so starts from the point of possessing life which is a precious gift of God.It is from having life that we have the privillage to see Gods glowry,the earth itself where we attack him from.Amen

    Northmed is a residential area, they must also make nightclubs face the rule of law or make them relocate to the city centre.

  4. There’s just lots and lots of tuntemba churches mushrooming. Some houses have been turned into churches especially on sundays and other days of the week. What is all this? Is poverty or worship?

Where is it written in the bible that your prayers will only be heard if you all compete by praying on top of your voices at the same time? Its just the devil at work in most of these churches. No humility at all. They should shut up and get serious with the things of the Lord.

  6. #1, we all or most of us go to church and we know something about the commandments. 1 of them says “love thy neighbour…” And not “make noise to thy neighbour…” I totally agree with the council. Churches should respect residential areas if they are worth the salt or is it the scripture. There is no need for shouting when worshiping God. He can hear you even if you are repenting in thought. Church in Zambia has become big business where Caesers (spllng) collect even someones coins for kapenta or cibwabwa. The next day the same caesers are found in very expensive cars and suits. Build more schools colleges,and unis not church. Most churches are con venues.

  7. I wonder why churches flourish so much in poverty stricken african countries. Zambians have even misinterpreted worshiping. They attend church more than they should only to self-deliver themselves to be conned. Wake up Zambians you are being conned. God doesn’t need IMF. Hes got money more than its printed. God wants you to work hard to feed your family and worship him only regularly and not everytime, everyday. Zambia needs to develop. It cant develop when all energy and effort is channelled into establishing “utuntemba” (as someone put it) churches. They are more business opportunities in Z such as farming, and not only church.

  21. The City Council surprises me, who issued the permits for these churches to start operating or are they illegal, why let these things start and react, the council should be proactive. In good city planning, I have never been to UK, but I am told there is a place called church square where you find churches only. Surely this is one thing the council could used as an example. And instead of just concerntrating on the churches, what are they doing about Break Point a bar built next to a residential area and blairing music the whole night? We know zambia is a christian nation but turning every house into a church, I think that is pushing the envelope

  27. LCC should learn to plan and not blame the churches. Bars which make noise all night should be fines. Mosques which use loud speakers for their prayers should also be fined. My Aunt lives near a bar in Chaisa I was shocked when I visited her to find that the bar opens at 09.00 hrs with loud music up to 04.00hrs the following day, this has been going on for years, people in the surrounding areas have complained to the Police over the years but nothing has been done, if noise polution is going to be curbed then I say Bravo to LCC, they should not target churches only, can you imagine the damage being done to children in these areas where bars operate without following rules?

    as for the mosques, a religious establishment is a religious establishment, church/mosque so they should also be fined. i agree with that.

Am speaking from exprience and am on record saying one of my houses is used for prayers and it has been blessed. A lot of pipo have been delivered right in my house. I thank God fro showing me the way. It is no noise but prayer. I tell you that if prayers are stopped, we will have similar situations as Myammar(Burma) or China.     if churches continue to make excess noise they will be in breach of the law.

    if a company emits a certain amount of toxic emissions in the air, they pay emission tax. if a church or ANY OTHER INSTITUTION emits a certain amount of noise they pay noise tax. simple economics.

    churches must adhere to the standards set for everyone else in the economy, they can not have special exemptions and preferential treatment.

  50. It is a common trend in Zed that if you have a keyboard, big amplifier and big loud speakers.. and you can qoute a few biblical verses.. you can have your own church. While the bible commands us to go forth and preach the gospel to all corners – whole neighbourhood in this case, church leaders needs use God given wisdom and some integrity when glorifying GOD. I have seen some churches even putting speakers outsides the church to attract potential worshipers and hoping in the process to out-do or out-speak the ‘rivally’ church.     im very sad to say that most of the churches in the kombonis don’t even have windows or pews for people to sit on. most of them are acrually class rooms that are used for church on sundays.

  64. What about noisy funerals? Are they going to be monitored too? I mean like all night wailing and drumming before and after burial in some places like flats? It also disturbs others that need to sleep and go to work the following day, I mean life goes on. Noise Pollution comes from many areas of our everyday life, are they all going to be targeted?

I would like to draw some distinctions in this line of thought.There`s nothing wrong in churches that freely express themslves when they are talking to God because scripture supports such action.Where the Spirit of the Lord is,there`s liberty and the bible encourages us to make a joyful a noise unto the Lord.This though does not give us permission to turn our homes into churches because that`s against the public order act.Neither should shabeens nor clubs be allowed to operate in residential areas.
    I support the Councils position to apply the law indescriminately.Any public functions with the potential of causing irregular frequecy in residential areas must not be allowed.

Of course, they can acquire those sound absorbers, but for as long as they don’t, they will be breaking the law and penalties will be in order.

A few weeks ago I confronted the Church next to Longridge School in Chilanga about their totally irresponsible high noise levels, their total disrespect of the community in which the church was operating, a violation of people’s rights all in the name of God and frankly, a lack of understanding of Christian values by a Church!
    There was an assumption that because they are Christians, everybody in the community must be a Christian and must enjoy their ceremony.. a total misunderstanding of reality!

    So, yes the Council must take action because it is the one that has regularised the churches to be in places where they must not be in the first place!

  98. Dear all, yet I support reduction of noise levels, I don’t support the idea of fines. Suppose these churches continue making noise and continue paying fines, are you going to complain? Unless the council is just interested in making money. So what I mean is that let the council stop these churches from making noise and not concentrate on charging fines.   100. Our friends in the born again churches should not feel victimised by the council’s enforcement of existing by-laws. They are doing that which they shud have done long time ago.

    The problem the council will face with legal noise control is that there’s no one single piece of legislation which makes clear what noise levels are allowed. If these churches decide to sue the council, it will be difficult to establish what noise levels are acceptable as there is none at the moment.Then it will come back to victimisation. These churches will think they are being targeted 4 no reason.We’ll blame the council again 4 losing a case that cud easily have bin won with revised by-laws.

Firstly for health and safety matter, its dangerous to crowd 30 pipo in a 6x6m room with others occupying the passage, kitchen, even toilet because there is hardly air circulation and its easy to catch airborne disease.

    Such an assembly will effectively invalidate the insurance of the house in case it caught fire.

    Thanks for your clarity and enlightenment.What I personally have a problem with is converting private homes into churches,shabeens or any other gatherings that attract crowds constantly.When are innocent neighbours going to have their rest or their kids going to find quiete time to study.
    On an individual level,a person does not need to shout and disturb his neighbours for God to hear such prayers.A family can have their prayers at home without necessarily disturbing their neighbours.
    For those that would like to host once in a while a home fellowship or prayer meeting can inform their neighbours as a general courtesy.

  138. with all due respect to the institution of religion, I have to ask why we have so many churches in Zambia? Are churches taxed? If not, surely its the responsibility of the government to ensure that churches don’t become de facto business fronts run by pastors eager to make a buck. I have no doubt that there are legitimate churchs but surely we can’t assume that they are all infallible can we? as for the noise I more inclinced to think that the Council should plan better if its concerned that places of worship will be noisy because Pentecostal/Charismatic churches are vibrant and it would be unfair to expect anything different
