Judgement in the appeal case involving former Health Permanent Secretraty, Kashiwa Bulaya, has been set for September 30.
Dr. Bulaya had appealed to the High Court against his conviction by a Lusaka Magistrate court.
Bulaya 54, was last year sentenced to five years imprisonment with hard labour on three counts of abuse of office and corrupt practices.
The sentence was metted out by then Principal Resident Magistrate, Edward Musona.
In his grounds of appeal, Dr Bulaya submitted that the trial Magistrate erred in law when he held that the prosecution had proved the case beyond doubt.
He said the findings did not satisfy the requirement of the law in view of the appellant’s insistence on his constitutional rights to a fair hearing.
He said the magistrate erred when he held that there were some buildings and motor vehicles that could have been purchased using public funds without laying foundation or producing any supporting direct link.
Dr. Bulaya also argued that the Magistrate erred when he held that he and his business partners where directors in the companies, BUTICO A1 and ANBUL Investment when they supplied drugs to the ministry of Health.
He further submitted that the Magistrate erred in his finding when he held that at the time of supply of Elixir 9, a herbal product on HIV/ AIDS, the drugs were not tested.

Why spend so much time and money debating.I wonder then, the purpose of our prisons. If they are for the poor only, make it known to the world so that we begin pushing the seccession motion forward, to join another nation that has respect for the law and whose prisons are for everyone be it rich or poor.

big man just serve your prison sentence!by now you should be remaining with 3.5 years then being a firt offender may be reduced to 2.5 years, so save the remaining money for use after your jail period

Prosecution of Chiluba (as former preident) was in bad faith.
Its a pity that this man is still trying to fight this case, this is all because cases take so long to be dipposed of in Zambia, making it easy for criminals like Dr. Bulaya to go scotfree and or alter evidence. This case is long overdue and we need to move on and arrest the rest of them. See now, they are trying to come back into the system of Govt to plunder even more. Dr. Bulaya should be ashamed of himself for the death of many Zambians who used the fake Drugs he supplied with his fellow conmen. I hope he gets more jail sentence next week. He really disgusts me!
