JAILED former Ministry of Health permanent secretary, Kashiwa Bulaya, has filed a notice of appeal in the Supreme Court against his conviction by Lusaka High Court for corruption and abuse of authority of office.Bulaya has also applied for bail pending his appeal in the Supreme Court.

According to the notice of intention of appeal filed in the Supreme Court by his lawyer Mumba Kapumpa yesterday, Bulaya appealed to the Supreme Court against the upholding of his conviction by the High Court on December 26, 2008.

On the grounds of appeal, Bulaya argued that the High Court erred in law and fact by not fully dealing with the constitutional issue of a fair trial under Article 18 of the republican Constitution.

Bulaya said he raised this issue before the trial magistrate High Court deputy registrar, Edward Musona, and it formed part of the grounds for appeal to the High Court.

Bulaya said the High Court erred in law and fact when it found that he orchestrated the supply of Elixir 9 to the Ministry of Health and approved payment for it as a controlling officer.

He stated that the prosecution proved the case of abuse of authority of office when in fact he had left the public service when Elixir 9 was supplied to the Ministry of Health, signed for by other officials and not him.

Bulaya also argued that Supreme Court judge, Marvin Mwanamwambwa, who sat as High Court judge, erred in law and fact when he upheld the order of the trial court of seizure of properties under section 41(C) of the Anti-Corruption Act.

He said this was without due regard given to the evidence on record that the said properties were acquired long before he was alleged to have committed the offences for which he was charged.

Bulaya said further grounds of appeal would be furnished upon perusal of the appeal case record and judgment of the High Court.

He also applied for bail pending his appeal in the Supreme Court.

Bulaya said he was a former permanent secretary with fixed abode and definite family roots and responsibilities in Zambia.

He said this demanded that he had no intentions of leaving the court’s jurisdiction as his appeal was being processed if granted bail.

Bulaya said on January 2, 2009, he filed a notice of intention to appeal in the Supreme Court and preliminary grounds of appeal against his conviction.

“I am, therefore, applying for bail pending the hearing of my appeal on such terms and conditions which the court shall deem appropriate and I pledge to abide by them as I have done before,” Bulaya said.

He said he had continued to abide by conditions of the bail and that when the case started, he availed himself to the Task Force on Corruption and the court.

Last week, the Lusaka High Court upheld a five-year sentence slapped on Bulaya by the Magistrates Court for corruption and abuse of authority of his office.
Judge Mwanamwambwa dismissed Bulaya’s appeal when he sat as High Court judge.

“I uphold the conviction and this appeal has no merit. I also uphold the seizure of assets,” Justice Mwanamwambwa said.

He said corruption was an offence in the class of crime for financial gain and the rationale for forfeiture was to make the crime non-profitable.
“He (Bulaya) must go to jail now,” Mr Justice Mwanamwambwa said.

On January 27, 2007, Mr Musona jailed Bulaya for five years with hard labour on three counts of corruption and abuse of authority of office.

  3. Somebody told me a story of a thief who broke into his house and stole his Stereo and on his way out he bumped into a bicycle that was on the floor and broke his leg. The thief decided to sue him for causing the injury. The question is who is the worse person: The thief that stole the stereo or the lawyer that represent this thief in the quest to sue somebody for causing the injury?

    I will leave it at that.

I have been wondering why kashiwa was not charged for a serious offence of genocide for importing traditional medicne that had not undergone clinical test and authontication. people surelylost lives for taking un proven medication that did not cure them.the rich get away with murder.

  15. Bulaya has already started crying foul hardly a week after being jailed. He just have to get used to the that kind of life. He never thought about the poor ordinary Zambians when he was stealing those millions. Its a pity! some people dont like reaping what they sowed.Bulaya should understand that there is time for everything! e.g a time to sow and a time to reap!

  18. Bulaya is just wasting both his time and money. The same Mumba Kapumpa abandoned him for non-payment of legal fees. Can somebody advise Bulaya to go in and serve. I have no doubt the supreme court will uphold Judge Mwanamwambwa’s verdict.

    @7, I think some lawyers have no morals, they are just interested in money and this is one such case. This is tantamount to scamming somebody. It doesn’t differ from the Nigerian 419

    Bloggers on the other thread were complaining about Tourist Operators in Zambia overcharging. I think even legal fees are too high pa Zed. Too much stealing by lawyers, that’s why many young people are joining this profession;to make quick money.

  21. This human being Bulaya knows that the ruling in the supreme court will be made in 2010 a year from now. The ruling at the high court was made in december 2008 from smoewhere in 2007. The problem is our judicial system, they take too long to dispose cases, so Bulaya is just trying to buy time so that he will be jail for a shorter period of time. this the trend all the other thieves are following.

    I hope we get to see more of these people sent to prison. May be it will stop people from stealing. What is annoying Pinkly is, simple buyers in government thought they were more learned than most people.

  42. I wish the Zambian Law had punitive provisions for time wasters like Bulaya who are not satisfied with the judgement from the lower court to the high court. In the English Premier League, an appeal that is thrown out carries additional penalties. I hope the supreme court can uphold the sentence and double it as well, a cool 10 years in jail with hard labour, to spice up things. A thief is a thief….

    This will show people that are dubious that it does not pay to be crooked.
    The resources of the nation are not for those that have been priviledged to manage them, but for all Zambians.
    And nobody is above the law, the president, the minister the PS, the MP, the CEOs, workers, unemployed, street kids and all; we are all the same. No one has superior blood to the other. The blood that passes through the vains of the president is the same as that through the vains of the street kid and you and me.

    I totally respect your view and I share it.
    But you see, these ‘numbera wanu’ people seem to be the majority on this blog and that is where the problem. They normally have no regard for the topics these articles carry, they just post whatever they feel, I emphasise ‘feel’. Normally they hate analysis of issues and the like to flow in their own world of feelings.
    May be what LT can do is to call people like ‘Dr Josee, bikiloni and difikkoti’ to help them choose some topics for these guys. May be this can help but I can guarantee because they dont even read these topics before they make their usual unchanging postings. So I dont think they will even identify their topics.

    North Miami Beach Police on Wednesday implored citizens to help find Npaka, 44, who is accused of stabbing his girlfriend to death last week.

    With a thick African accent and cuts on his forehead that were supposedly tribal marks, Npaka had charm — and exotic allure.

    In a publishing house bio, Npaka claims to have obtained a bachelor’s degree in French at the University of Paris before pursuing a master’s in England. He also said he was pursuing a doctorate in the United States.

    Police say Npaka had actually come to Florida about five years ago on a student visa to study at Miami Dade College.

Nevertheless, the guilty man has a right to appeal and we should be grateful that we have a legal system that allows the appeal process to run its course.
