Former Ministry of Health Permanent Secretary Simon Miti has submitted a declaration list of his property to Law Enforcement Agencies.
This is in connection with on-going investigations into the K27 billion corruption scam at the ministry.
Dr. Miti’s lawyer Rabson MalipengaA confirmed to ZNBC that his client submitted the list at the Anti Corruption Commission (ACC) offices Friday morning.
Mr. Malipenga said the submission was agreed upon when a warn and caution statement was recorded from the former health Permanent Secretary.
Dr. Miti was Thursday interrogated from about 12:00 hours to 18:00hrs at the ACC Headquarters. The list has not been released to the public.
Meanwhile, Henry Kapoko has appealed against a magistrate court’s decision to deny him bail pending trial in the Lusaka High Court.
Kapoko, a former Ministry of Health Human Resource Manager, was last week denied bail by Magistrate Kenneth Mulife on grounds that he attempted to evade arrest and tried to flee the country.
Kapoko’s lawyer Kelvin Bwalya has argued in the high court that the trial court erred in law and in fact when it denied his client bail on the ground that he would run away.
Mr. Bwalya submitted that other grounds of appeal will follow at the hearing.
And High Court Judge Essau Chulu has set June 16 as the date for hearing of Kapoko’s bail application appeal.
Kapoko’s defence team had submitted before magistrate Mulife that their client deserved bail because he was of fixed abode and a civil servant.
Kapoko has pleaded NOT guilty to obtaining K1.9 billion by false pretences.
It is alleged that on unknown dates but between January 22 and February 28 this year, jointly and while acting together with other unknown persons and with intent to defraud or deceive the ministry of health, Kapoko obtained money by false pretences.

Declaration of assets then what ? Has Kapoko and the others declared their assets as well ? What is happening here ? Something we are not told and I now see Miti coming out clean. Law must prevail over opinion. If Simon has a case to answer, let him do so. If he is found guilty, let him be prosecuted. Miti should not be protected by anyone like Levy used to do. Everyone should face the wheel when they break the deal. This is the law! In fact, Sata and HH should face the law for their theft of public funds in the Merzaf and Luanshya Mine deals. The declaring of assets is very important for those holding key positions in the country.Mandatory declaration of assets should be imposed on all those holding constitution offices and key government positions.May the the following also declare their assets :

Corruption is corruption, whether it’s been committed by a PS or Fomer President law does not change towards this vice, in fact should be more tough than mere 3-7yrs in prison (at least 50yrs and above will do). He is a professional with seriuos intergrity among his peers. Declaration of the assests to the ACCA is routine for anyone who has been called for an interview concerning a particular issue. All those 32 who was questioned by the Plice, DEC and ACC were asked to declare their assets as oart of the routine procedure. For those of you who are in diaspora, trut needs to be told that as some of you rightly observe, Dr. Miti made a lot of enemies on his way climbing his professional ladder. There were those people who may have been senior to him and who got by-passed for promotions. It is natural that those people were very bitter indeed. Some of those people are the bloggers here.
As someone who is very close to the investigations, I need to assist a lot of you by saying that the ACC have recieved numerous annonimous letters about Dr. Miti. To be honest, all these letters and accusations have ended up being lies. What we have to be mindful of is that, Dr. Miti’s so called friends, some of whom are very close to him have been trying for years to have him implicated in some scam. So far, they have failed. With the latest K10billion scam, they came very close to implicating him. Indications so far are such that Dr. Miti was not involved because he was out of the country when these dodgy transations were revealed.
What bloggers need to understand is that Dr. Miti is not being accused of having a hand in the K27million scam. What is being investigated is his role in the K1.9billion transaction with a company owed by Kapoko. What has so far been revealed in that this transaction went through all the procedures that ensure checks and balances when Dr. Miti was out of the office and another person was acting in his stead. Whe Dr. Miti came back to the office, he was given a contract to execute to effect the deal. As normal procedure, he signed. 2 days later, he was transfered to the Ministry of Science and Technology. In other words, it is Dr. Miti’s contention that he was not involved at the time this deal was being discussed and he was also not there when it was finalised…..
Payment for thie K1.9billion was effected by the current PS in the Ministry of Health. In other words, Dr. Miti was not involved in the deal at the begining, during the checks and balances procedures, he did not chair the Ministerial Tender Committee (which is the superior decission making body), he was not the one who forwarded Kapoko’s compnay to the Zambia National Tender Board and so on. This is the reason why, over the weekend, six more officials from MOH were arrested because they are the pnes who were involved on the stages I have tried to mention. Whether you like Dr. Miti or not, it does not matter. But from my vantage point, he was not involved in the scam.
By the way, it is also believed by the people close to this investigations that the K1.9billion contraband which was supposedly not delivered to the Minstry of Health and which lead to this so called scandal has arrived and is at the MOH. If this ends up to be true, then it could just be that there was no scandal at all. My advice to the Auditor General, the Investigative Agencies, the newspapers especially the POST is that before we put information in the public domain, we need to make sure that the information is checked and checked again!!! We need to make sure that we do not do anything that may jeorpadise and/prejudice an otherwise good investigation.
As for Mrs Anna Chifungula, our Auditor General, her office is sacred in ensuring that there are checks and balances in the handling of public funds. Her job is not to be in the papers and to alarm the donors. This is not a time to be bringing such screaming headlines as K27billion scam or more lost at MOH!!!! The ACC and the Auditor General have done more harm to this country than good in alarming the donor community about supposed impropriety at the MOH. At the time when the world is going through a financial meltdown, you need people with cool heads at the top to ensure that the meagre resources available are harnessed and protected. Though I have great respect for Mrs. Chifungula, she has failed to keep her cool at very important times. This is most unfortunate.
Kapoko and the six others who have been arrested and charged of the offence of abuse of office and possibly theft were directly involved in the K1.9BILLION SCAM. Dr. MITI as much as many of you want him to be implicated was NOT involved. My advice is that we need to have some checks in the way the media reports certain things. The strikes by the Health workers in the country has also been fuelled by the supposed scandals at MOH. As much as I think the POST is a good thing for Zambia, we really need some lever of control on the way some papers do their reporting. The POST, the ACC and AG’s office may have done a better job by doing their investigations descretely and only making things public when they are absolutely certain of securing a return on the tax-payers money.

I feel it is corruption of the highest order where over Kbillion Kwacha is used to do the investigations to secure some conviction if any, over a K1.9billion scam. Lets wait and see how this whole so called scam pans out. But my hunch is that Kapoko has some things to answer and so are those that were directly involved in the transaction. However, if the goods in question have been delivered, then Kapoko also may walk. That will be an indictment on the part of the Auditor General, the ACC and the POST. Miti will still be found wanting even if he is cleared for theft. Incompetence!! With all those degrees a man of his ‘calibre’, let so much money slip out of the MoH? Thats why people are suspecting him of complicity in this matter. And yes, moreover this is the same man who was extremely arrogant with govt officials every time there was an audit querry. Let him face the music.

Ba Kabwe, i really thankyou for clarifying these facts, as you can observe, dispite these facts you have tabulated, some bloggers like Kambongolo still think the three law enforcement organs assigned to investigate the scandal are incompetent because they are not arresting Dr. Miti, make no mistake, these guys are professionals and read in between lines, they have seen that people just want to implicate him. This is a public forum and some people believe those finding time to contribute here have facts in their annonymity not mere jealous for Dr. Miti. GROW UP BA MOZE!!!
Ba Moze and Kabongolo – No need to be using abusive language on a public fora like this one. What I was trying to do is give some of you some real facts about whats on the ground. Maybe in the next life, try to do some Law as well so that you can have a fair idea of what is means to be criminal and negligent. Just so that I can help you, in the criminal realm, one os guilty is they commit an actus reus and they have the requisite mens rea. If one is found wanting in the criminal realm, the penalty is jail and/fine. What Kabongolo is saying is rather misplaced because, if Dr. Miti is found to have been negligent, he looses his job. Thats the santion is employment law. So there is no room for ACC or police…..
Ba Moze and Kabongolo – If Dr. Miti is found with a case to answer, that will be administrative and not criminal. If like Moze and Kabongolo are suggesting Miti was grossly negligent, he may have to be reprimanded by his bosses. But he is not going to face the music that you’re craving because his actions are atleast according to criminal law in both our Penal Code and the Anti Corruption Act. I wish to bring it to your attention guys that running a Ministry as big as MOH is not chicken feed. For Dr. Miti to have run the Ministry for close to 8yrs is no picnic. If Miti was negligent then it should be gross negligence.I would be more linient if money was stolen from companies like the ones running the mines whose sole interest is to deprive the Zambians of their own wealth.As a doctor Miti should have understood the importance of the oath (to save life).Just how many lives have been lost as result of no basic facilities at these hospitals?It is people like him who make life so cheap!One thing we know so far is that his conduct is below the expectations of a reasonable PS’s.

How can you blame the health situation in Zambai on Dr Miti, this is extremely unfair and stupid. whats facts do you have that the scandal at the ministry actually jeorpatized provision of basic medical help? Dr.Miti has been a professional health administrator who understands basic needs, its not up to the PS to come up with all the projects and provisions, he is the controlling officer of different activities. He is also a human being not a computer, Ba kabwe has again explained to bloggers the legal meaning of the activities at the ministry, those of you just against Dr.Miti, you will fail. Why are we cracking our heads, the whole govt is full of thieves and only God can deal with them. Miti has been tipped to be the next Minister of health, afterall he wrote to RB, who is as corrupt as Miti, they are as bad as each other. Next week Miti will be back at MOH. Mr kabwe knows everthing, thats why he is so confident, Miti is a free man. But God is God.cant remember that american who murdered his wife, was not found guilty, he wote a book about it entiled what if i did murder her. he was found guilty of another crime and now he is in jail. Justice prevails.
