PF threatens legal action against ECZ over by-election

The Patriotic Front (PF) has warned the Electoral Commission of Zambia (ECZ) and Mansa Town Clerk of legal action if they do not declare the PF candidate an unopposed victor in the Chilyapia ward by-election of Mansa Central Constituency.

PF Spokesperson, Given Lubinda told ZANIS in an interview today that by 17: 00 hours, the close of the nomination time, the Town Clerk only announced the PF candidate as the sole valid candidate as the MMD had allegedly not settled on which candidate to field.

Mr. Lubinda said confusion in the MMD camp arose during the nomination exercise last Wednesday when the MMD fielded two candidates to contest the Chilyapia ward by-election.

He said according to the laws of Zambia, candidates not announced after filing in of nominations are deemed unfit for election hence the ECZ should declare the PF candidate victor by virtue of being unopposed.

“The MMD filled in two candidates but the town clerk did not announce who was picked between the two, but he only announced the PF candidate so that makes it illegible for MMD to stand for this ward by-election. And if they decide to run the by-election what will ECZ put on the ballot papers because there is only one candidate who was announced ” he said.

Mr. Lubinda has since challenged the ECZ and Mansa Town Clerk to declare the PF candidate as Councilor for Chilyapia ward.
He warned that failure for them to do so will result in the party taking legal action against the ECZ and Mansa Town Clerk.

Meanwhile, the Patriotic Front (PF) has accused the MMD in Mushinka ward in Mansa Central constituency of buying voters cards in the area ahead of the ward by-election.

PF Spokesperson Given Lubinda said the PF had allegedly caught MMD cadres in Mushinka ward with voters cards bought from people in the area in a bid to influence the by-election outcome.

Mr. Lubinda said the PF has since written to the police command in Mansa on the matter.

  6. 3 Matworld greetings. On your “Why by-election did the Mp for the consittuency died?” The elections are for a Councillor and not MP please. A councillor represents are ward as in this case Chilyapia ward.

    As for by-election, I am not aware as to whether the former councillor died or just resigned from his/er political party in turn causing the seat to be vacant. I hope LT will beef up on this one, so that there is clarity on what happened on the ground. Did you meet the Physicist?

  8. Can someone educate me on this issue of buying voters cards. How does it give someone an adavantage, I mean do people remove the photo of the cad-holder and put somebody’s there or they withhold the cards not to be used in the election? I really don’t understand the mechanism of rigging when cards are purpoted to have been bought by a party.

  10. Police in Lusaka have arrested Post newspaper news editor Chansa Kabwela.
    Mrs Kabwela has been charged with circulating obscene material.
    She has been released on police bond.
    Her Lawyer Sam Mujuda told journalists that Ms Kabwela will appear in court tomorrow (Tuesday).
    The allegations are that Kabwela has in her possession pictures that were circulating on the Internet of a mother in childbirth.
    If convicted, Ms Kabwela faces five years in prison or a fine.edited

  14. When are we going to mature like Ghana where an opposition leader wins presidential elections? ECZ should lead by example if thats what the law says. If the position of Councillor is leading to vote-buying,then MPS & Presidential ones in 2011 will mean bloodshed.It will take monkeys to teach us pure democracy.These greedy leaders must accept defeat .If they cannot accept now ,2011 will mean confusion.

  15. # 12, Dongo Na Sundu, people buy voters’ cards from the other oppositions’ would be voters. By so doing they defranchise members of the opposition. It is the tactic of making sure the opponent’s votes are reduced.

  16. We most of the times blame the politians especially those in the rulling party, but the biggest problem is with the voters especially the rural illiterate voters! This one man one vote thing is not fair. We need to design a weighted system that takes care of education, economic size and other crital variables so that even if they buy the votes as they are doing now in a general election they should count less!

So the MMD has a machine which detects who is a voter for the opposition, then MMD goes and convince the cardholders to sell tMMD their cards which the MMD withholds thereby reducing votes in favour of opposition. So it has never occured that even MMD would reduce the number of votes in their favour just in case someone was going to have a change of heart to vote for them at the very last minute. Well, ba WE CAN, I’ve heard of that explanation but it is cheap in that it is skewed at leaving out opposition party’s from doing the same. Or are we assuming opposition are too clean not to engage in that practice but they can afford to buy chibuku and ifitenge? I am sure even the opposition laugh at themselves on such an excuse coz it doesn’t advantage any side

  18. # 24,tightjeanszambia, I agree with you. The indiscriminate giving of the right to vote to everyone has not helped us. This is because most Zambians are illiterate and cannot make national decisions such as “voting wisely” for a national leader. This is the biggest thorn we have in our flesh of democracy- lack of education. We must define our democracy in a more helpful manner.

    I for one believe that only educated people – at least up to college level – should be allowed to vote and only educated people should assume national leadership positions.

  19. This voters card buying is all crap by opposition. Who said if I am PF, MMD UPND then it is automatic I ll vote for the party. This is how these politicians are insulting our intelligence. In the last electons I voted for an MMD MP but for president I went for Miyanda. So this noise about vote buying is all nonsense and it is not helping us. And since when did PF become police officers. In chingola they beat an innocent man who had cut out a ticked news paper ballot saying he has already cast ballot for RB.

  20. #26, Dongo Na Sundu, That is really the explanation, however absurd! . The buyer will normally do so at beers. He asks people who they support and then offer to buy their cards if they are for the opposition. The poor uneducated villagers will easily get the money or beer for their cards. It is open for both the opposition and ruling parties! I have never head any better explanation than this.

  21. Rigging rigging……. a voters card is a card that gives citizen the right to vote. On the card there is no identity to show that you belong to any political party. WHen a card is stole/bought or otherwise find in wrong hands, any person can use it to vote for a candindates of their choice hence reducing the gap on thee oponent.

I hope this is the real case in the Mansa issue. I will wait upon the Police to give a stance over this matter although the Zambia police’s conduct has been put to question in the recent news.

    The problem is that the MMD leadership doesn’t condemn such acts even if they are claims.

  24. Just a suggestion, could some journalist(s) ask President RB Banda to give his views on US Pressident Barrack Obama’s message in Ghana. Since President Obama is just about the age of president HH, leader of the UPND-PF PACT, I hope I will not read about the word insults from a son should such an interview take off.

    These are difficult times for the MMD GRZ but there is life even in the opposition if they will be removed from governing Zambia.
