Stop debate on 2011 presidential and convention elections, Katele orders MMD

Movement for Multi-party Democracy (MMD) National Secretary Katele Kalumba has directed all party leaders to desist from debating the 2011 Presidential and Convention elections for the sake of the party.

In a letter addressed to all National Executive Committee (NAC) and provincial leaders yesterday and copied to the party President and the party’s National Chairman, Dr Kalumba said the continuous debate within the ranks of the MMD leadership on the subject posed a great danger to the integrity and survival of the party.

The MMD National Secretary said it is unfortunate that the party leadership has continued debating the 2011 elections when it was barely nine months of President Banda’s mandate given to him through the MMD.

He has since advised all MMD party leaders curtail debating the 2011 elections and channel their energies toward helping Government to deliver on the challenges facing many people in the country.

“President Banda’s mandate given to him through the MMD is barely nine months. It is imperative that MMD’s energy be focused in helping Government deliver on the challenges facing our fellow citizens”, he said.

He said the party will have greater opportunity at some opportune time next year to allow NEC to signal debates regarding the 2011 elections.

He said it is wrong for the party leadership to continue debating the issue when the President expressed his disquiet regarding the 2011 election debate during his last Press Conference.

Dr. Kalumba warned party leaders that shall fail to abide by his directive that they shall attract the sanctions of his office.

  9. ok seriously i am tired of hearing about who will stand for the 2011 elections bla bla bla. We can’t always live for the next elections. After the elections then what? another debate on the 2016 elections? Time for the election debate will come, but this is not the time. I agree with Kalumba on this issue and this must not only go to the MMD memebers but all Zambians. This is the time to debate issues that will put food on the zambian tables. Lets put our brains together and see how best we can improve our country. Lets put our political affiliations aside and get totgether to push our country out of this recession and come out stronger than before. Maybe our very “intelligent” and “educated” bloggers can help us with some positive economic ideas.

    How does aspiring for presidence make the prof to be power hungry?if you had a culture of reading then you would have at least come across imformation where the prof was spelling out his vision for zambia.an example of leaders who are power hungry if you may wish to know are SATA who does not practise democracy in his party and RB who wants to cling to power foregoing his earlier pledge.the prof my bro’ belongs to a new school of leadership.he wants to change goverment from a cadre driven one to an interlectual driven one.so if you are agitating for change as you put it then prof chirwa is the person you should be looking upto.he is the right man.

  11. I also want to agree with Kalumba on this one, There are more serious issues at hand that need our time and energy to deal with other than this issue of 2011 elections. The problem in Zambia is that politics are now a means other than a service to the people. Everybody wants to be the president, MP and so on in order to enrich themselves at the expense of the majority poor.

  12. Sangwa wants Chief Justice out of office: Lusaka lawyer John Sangwa say Chief Justice Ernest Sakala and Justice Peter Chitengi are not fit to hold office.
    In a petition to the Attorney-general, Mr Sangwa argued that the the two are not competent to hear any appeal case in Zambia.
    He said the two are past the retirement age.

[1] On 29 April 2009, we lodged the above-stated appeal and because of its urgent nature it was heard in Ndola on 2nd June 2009, by a Bench consisting of the Chief Justice, Mr. Justice Peter Chitengi and Madam Justice Chibombo. We understand that Madam Justice Chibombo is acting Judge of the Supreme Court in line with the provisions of Article 93(5) of te Constitution. On 9th July, what was described as the “judgment” of the Court was read by the Chief Justice and our client’s appeal was rejected.

  17. [2] It has now come tour client’s attention that the time of hearing the appeal on
    2nd June 2009, both the Chief Justice and Mr. Justice Chitengi had already passed the retirement age of sixty-five stipulated in Article 98(1) of the Constitution, hence not qualified to hold the office f judge of the Supreme Court; consequently not competent to hear and determine this appeal or any other appeal case.
    [3]Article 98(1), omitting the parts not relevant to the issues at hand, reads:
    Subject to the provisions of this Article, a person holding the office of a
    Judge of the Supreme Court — shall vacate that office on attaining the age
    Of sixty-five years: (Emphasis ours)

  18. [4] We are aware of the proviso to Article 98(1), which omitting the parts not relevant, reads:
    Provided that the President-
    (a) may permit — a judge of the Supreme Court, who has attained that
    age to continue I office for such a period and may be necessary to enable him to deliver judgment or to do any other thing in relation to proceedings that were commenced before him before he attained that age;
    (b) may appoint — a judge of the Supreme Court, who has attained the age of sixty-five years, for such further period, not exceeding seven years , as the President may determine. (Emphasis ours).

  19. [5] These provisions did not allow their Lordships to hear and determine this appeal or any other appeal after reaching the retirement age. If their Lordships are in the office on the strength of proviso (a), it is our view that that proviso only empowers that President to permit their Lordships to continue in office, after reaching the retirement age, only for such a period as may be necessary to enable them to deliver their opinions in appeals, which they heard before reaching the retirement age. It does not allow them to hear and decide appeals after attaining retirement age.

  20. [6] However, if their Lordships are in office on the strength of proviso (b), we admit that under that proviso the President has power to appoint a retired judge of the Supreme Court to another term not exceeding seven years. This is a fresh appointment which must be ratified by the National Assembly in line with the provisions of Article 93.

  21. [7] So far as we have been able to establish there has been no ratification by the National Assembly of their Lordships’ appointments after retirement. It is our position that the Chief Justice and Mr. Justice Chitengi are holding their offices and performing the functions of the judge of the Supreme Court illegally. They are doing so in violation of Articles 93 and 98 of the Constitution. They were not, therefore, competent to hear and decide our clients’ appeal.

  22. [8] The allocation of or clients’ case to a Bench made up of the Chief Justice and Mr. Justice Chitengi also violated our clients’ right guaranteed under Article 18(9) of the Constitution. Under that Article our clients are guaranteed the right to a fair hearing before and independent and impartial Court. A panel dominated by retired Supreme Court judges, but in office in violation of the Constitution, cannot be independent and impartial as required by the Constitution. The situation is aggravated when the following factors are considered,

  23. (a) although the President has the power to appoint a retired judge for a further period not exceeding seven years, the circumstances in which the Chief
    Justice and Mr. Justine Chitengi were appointed and the period they are expected to serve are not known;
    (b) their appointments after retirement were not ratified by the people’s
    representatives in the National Assembly;
    © without such ratification the judges are serving at the pleasure of the;
    President;

  24. (d) given the low life expectancy in Zambia, there is a presumption that
    once one has served up to the age of 65, one has given his best both physically and intellectually;
    (e) given the high level of unemployment in the country those who have
    reached retirement should vacate their officers and create room for
    others; and
    (f) after all a retired judge is entitled, until death, to 80% of the serving
    judge’s emoluments;

  25. [9] Other than violating the Constitution the panel that heard our clients’ case also violated Section 3(2) of the Supreme Court Act, which provides:
    The determination of any question before the Court shall be according to
    The opinion of the majority of the members of the Court hearing the case.
    [10] The Court hat heard and determined our clients’ appeal was made up of three judges of the Supreme Court, the minimum number of judges that can hear and determine an appeal as stipulated in Section 3(1).

  26. However, only one opinion was read by the Chief Justice as representing the opinion of the Court. This is in violation of Section 3(2) of the Act. The said Section requires each of the three judges, working independently, to deliver his or her own opinion. It is only after reading the opinion of each judge will it be possible to determine the majority opinion of the Supreme Court cannot, therefore, be pre-determined by the judges in secrete chamber and one opinion delivered. It is for the parties to the appeal and other interested parties to read opinion of each judge and from there deduce the majority opinion of the court of the.

  27. Our clients have the right to know the opinion of each judge that was part of the panel that heard their case. The said provision is meant to benefit our clients and is designed to enhance the independence and impartiality of the Supreme Court
    [11] The departure by the judges of the Supreme Court from the provisions of the Section 3(2) of Act;
    (a) undermines transparency and accountability within the Supreme Court;
    (b) stifles diversity in legal thinking and creativity;
    © violates Article 91(2) OF THE Constitution, which enjoins judges to observe
    the Constitution and the law;
    (d) curtails development of the law and the legal system; and

  28. [12] If your interpretation of the constitutional and statutory provisions we have referred to is different from ours we have instructions from our clients to move the High Court so that the issues we have raised can be adjudicated upon. However, if you share our interpretation of the said provisions, we would like to know what you propose to do to correct the constitutional and statutory violations we have outlined above.

  29. [13] We would be grateful to hear from you within seven days from date hereof. If we do not we have instructions to move the High Court.

  32. Katele there is something wrong. Make it clear to every one when campaigns for the positions in NEC are supposed to start. There is no point in keeping everything close to your chest. Zambia is a free democratic country not a “DICTATORSHIP” . Why are you prorecting RB to be the sole candidate for Paty Presidency. Is he going to stand against a frog or Hyna like UNIP days. I dont what has gone wriong with DR KALUMBA KATELE. It appears after using those chienge.com gagets our man is no longer the same.

  33. I don’t think anyone should be suprised with Katele attitude of supporting RB. He supported Levy and was spared of corruption charges… now he has no option but to do the same with RB… The simple take on this that Katele will never be presido … but will continue to support those who can shield him from prosecution…As a matter of facts Katele knows all the Presido hopeful in MMD … but he can only go with the majority and not moral or principles.

Since then the Presidents of the time, . firstly FTJ, then the late LPM have manipulated them RB is surely taking a leaf.   44. I think choice of leadership should not be based on how loud one can speak or how educated one is. In a developed democracy, what we should strive for is to vote people on the basis of their plan of management of the country. We need to assess this plan for its feasibility and long term impact. In this regard, populism should be viewed with skepticism/caution and academia should be assessed for practicality. Clive Chirwa is a good candidate, but he needs to earn the right to lead us by convincing us. If he is serious, the first step would be to give up his job in the UK and return to Zambia to dedicate his time and energy to his campaign.

    As for non-party members barking about the MMD presidency and their interest, just ignore them but do actions that will leave them in the cold, but give chance to all MMD members to exercise their right to attempt any office they want to serve the party.

    MMD has assigned thugs to attack The Post Newspaper reporters whenever President, Rupiah Banda is travelling and likely to meet the media in the country.

    The MMD accuses The Post of reporting President Banda negatively. Quoting anonymous MMD insiders, the newspaper alleges that the youths are present at every public function attended by the Zambian president. It reports that one of the vigilantes tried to harass Edwin Mbulo, Livingstone based correspondent as he was taking pictures of Local Government Minister Benny Tetamashimba.

    And ZNBC Director of Programmes, Maxwell Ng’andu says he is saddened by the MMD cadres’ attacks on journalists. Mr. Ng’andu has called on all political parties to exercise maximum restraint when dealing with journalists.

On your “It is nice to see camaraderie between Akapondo… “, it is real nice when insulting characters desist from bad behaviour and I believe this AKAPONDO can change for the better. His/er problem thinks that I am on here to compete with others, when the truth is that I am here to provide my independent standpoint on things.

    Banda is old and should go peacefully after his accidental stint as President. This is a given and should therefore not be a debatable issue. However, knowing our country, ambuya will try to go on until we tire of him.
