Bring it on- RB dares Sata and Hichilema

rb_arrivalPRESIDENT Banda says he is not worried about plans by the Patriotic Front (PF) and United Party for National Development (UPND) to impeach him.

Mr Banda, who was speaking to journalists at City Airport upon arrival from Eastern Province yesterday, said the two political parties can go ahead with their plans to impeach him.[quote]

“Let them go ahead. Do I look like someone who is scared of their plans? The Zambian laws allow that,” he said.

The President said the political parties involved have a democratic right to go ahead with their plans in Parliament.

Mr Banda arrived at 17:30 hours and was accompanied by his wife Thandiwe.

He was received by Minister of Foreign Affairs Kabinga Pande, Lusaka Province Minister Charles Shawa, and Secretary to the Cabinet Joshua Kanganja, other senior Government and MMD party officials and cadres.

MMD Lusaka Province chairperson Cleophas Chimembe has warned the PF and UPND to stop inciting the people of Zambia to rise against President Banda.

He said the PF went to court to challenge last year’s Presidential by-election but withdrew.

Mr Chimembe said the fight should have ended there after the court case was stopped.

He said it is sad that the opposition have resorted to desperate ways of diverting people’s attention from real issues affecting their lives.

“I would like to tell the nation that this evil scheme will fail, but only succeed in dividing the nation and scaring away potential investors,” Mr Chimembe said.

He reminded Zambians that President Banda was democratically elected and deserves respect and support from well meaning Zambians.

“Politics of comedies should be discarded. There is a lot of comedy in the ranks of some opposition political parties, at the expense of the politics of development. While we appreciate the freedom of expression, we should be aware that there is no absolute freedom, it is relative,” Mr Chimembe said.

He said President Banda and his government are working to ensure that they tackle the challenges the country is facing.

Mr Chimembe said impeachment calls are desperate attempts aimed at dislodging President Banda at all costs.

“This is a recipe for confusion in the country because President Banda has not failed the nation in his nine months rule.

“Zambia’s young democracy and unity of purpose is at stake and risks to be derailed if the disgruntled behaviour is going to be used as a yardstick to settle old scores,” he said.

Mr Chimembe said Zambia will only benefit if all citizens come together in unity.

Christopher Zimba, Lusaka-based youth said it would be immoral and insensitive for some opposition leaders to go ahead with plans to impeach Mr Banda when there are a lot of sectors in the country that need attention.

He called on Mr Sata to have a critical look at article 67 of the Zambian constitution to learn more about what it stipulates regarding impeachment.

“The article states that two thirds or 53 MPs need to pass a vote of no confidence in the President for him to be removed,’’ Mr Zimba said.

Mr Zimba said Mr Sata should inspire youths and citizens by talking about issues that are development-oriented.

He appealed to UPND president Hakainde Hichilema to dissociate himself from the PF-UPND pact to retain his integrity.

“I urge Mr Hichilema to analyse the pact critically. I believe Mr Hichilema is a man of integrity and he is able to analyse issues,’’ Mr Zimba said.

  4. There are a lot of issues that may lead to successful impeachment. Other than the Dora Zamtel, Airport saga and there is now Justice Sakala’s illegal stay in office. What we have to findout now is the time he attained 65yrs. Was it before Mwanawasa’s demise or after. If it was after LPM’s death and before RB was sworn in then we must question the authentic of that ceremony.

  6. Sata can’t debate positively. Asked by UPND MPs to give reasons why RB should be impeached, he answers by asking the MPs to resign. The man can’t positively debate. The Zambian voters in general must subject Sata to a litmus test by bringing him to both radio and TV phone in programmes to debate the matter. We will check him against a score card. His answers and the level at which he will fair on the score card will give Zambians an informed way forward. For now we are violating and abusing each other.

  7. Have PF-UPND joined the MMD circus? I do not like MMD for obvious reasons but what are Sata and HH doing? They are losing my confidence.Do they even have the numbers in parliament.I have not heard one decent agenda of how to sort out Zambias economic woes from these two.They just react to RB no proactive plans, no proactive statements no proactive strategies always reacting.Please we need some youthful intelligent leader to rise up.The people on the stage right now just want to go to state house to enjoy.Otherwise I foresee MMD winning again!   11. Great response. Infact, if I was RB, I would instruct Teta to STFU. This impeachment is not going anywhere. The pact doesn’t have the numbers to do it. This man is a liability but we need to face facts. He is unimpeachable. Let the pact concentrate on campaigning in the rural areas. 2011 is not that far away. Failure to gain traction in the rural areas has been the major stumbling block to removing the MMD. The twons people have been won over as they have shown in the last 3 elections. Haven’t the opposition learnt their lesson?

When Mluzi defeated him and he was hoisted before the courts, judges were shocked to realise Banda was clearly Dementiated (deprived of mind). For ten years, Kazamira and John Tembo were ruling by proxi. I honestly believe Mulongoti, Teta and Shikapwasha know their man is senile but would like to retain the status quo because it benefits them.     The puzzling things is that those against the impeachment plans are the ones who are inciting lawlessness in our great country by not following the Constitution.

  17. the impeachment issue is a non starter for obvious reasons. the reasons advanced for impeachment are not good enough, secondly, the procedure to be followed when undertaking this process is trick, thirdly, Sata and HH do not have the numbers in parliament and lastly, the judiciary is in RB’s pocket. Maybe Sata and HH are just using this as a way of secaring the enermy, to make MMD panic. if they are serious about this then they are not the type of leaders we are looking for, they are just wasting time instead of going out there and meet potential voters in villages where they performed badly last year. they should be concentrating selling their manifesto and am sure most of us dont even know what these two stand for in terms of policies.

  18. In the meantime, let Mr President act on the issue of Chief Justice who comes from the Eastern Province like him including Justice Chitengi case. Failure to act on that issue must be including on the impeachment points by the UPND-PF PACT as a failure to defend and protect the Zambian Constitution which Mr President swore to do on his inauguration to lead Zambia as number one man at State House — that was done at about night time according to newspaper reports.

The only adherence to democratic value it adheres to is elections every 5 years. PF-UPND should stop this impeachment nonsense because it won’t go anywhere.
    Mazoka tried to to take MMD to court over rigging, Sata tried the same after losing the presidency. These are advanced democratic procedures which can work only in a conducive democratic environment. Zambia is still a baby in this area. Just focus your efforts on 2011.

  25. Even if the impeachment does not hold water it is good politicking. It puts MMD under pressure and its under pressure that people hurry and make mistakes before long it becomes a movement that Banda must go. Remember the Mbeki Zuma saga, it started small until it became an unstoppable force, soon Mbeki was kicked out and Zuma ushered in. So all the best to those in charge of the political maneuvering!

He is even failing to understand simple and self-explanatory issues. So we need to start educating less educated and old politicians like Mr Sata on how government programmes work”.

    Following MP N. Magande’s message in the POST that Zambia doesn’t need a universit degree educated person as presidential candidate and subsequently President of Zambia, MMD is appearing to be trying hard to break the UPND-PF PACT and nothing else by showing probably calculated disunity among its top leadership.

He has money for his travels, visitors, MPs and MMD campaigns, but has no money for majority Zambians. It is these few beneficiaries that are saying positive things about him. King Mswati praised RB because he was given land and enjoyed the confort that RB provided, and wish to reciprocate to RB in Swaziland. The two are the lazy leaders in SADC that enjoy tax payers’ money without remorse. That is the reason our only hope at the moment is the PACT.

  45. Where impeachment of the president is concerned, I think for Zambians to even air our views, we first of all have to understand the propress and what as breach of constitution is. What kind of breaches can lead to impeachment. Can one answer this question. I don’t think we zambians know what can be considered as a breach. Another problem is, even if those Parliamentarians knew that RB has breached the consitution, they are not courageous enough to take him to book. Who doesn’t know that MMDs are bootlickers.

    There’s a letter written by somebody entitled “Rupiah’s constitutional breaches”. In his letter this person has given a concrete example. I hope HH/ Sata look seriously into all the breaches which RB has committed and inform the nation about them. They simply need to make…

    On another not following the former President Chiluba cases, I appeal to Mr President to use his executive orders to pardon Mr Chiluba FTJ of the London judgement ruling. Mr President needs to ask the Task Force and sitting judges on Mr Chiluba’s other cases to conclude their work by December 2010 as we can not afford to wasting development time.

  47. Sorry forgive my english errors, but I am saying dilsike or dissaproval are not grounds for impeachment. Impeachment is a long drawn out process that has rarely worked even in countries where Genocide has been taking place. So the Banda knows it is going nowhere …..

    And of course if you know anything about politics, any politician worth his salt will always show strength when his opponents are throwing their punches and thats just what he has done

  48. To all those worried about impeachment cases, read the Times of Zambia for today on the PF leader’s telling off UPND MPs against the impeachment plan to send Mr President back to normal Zambian Citizen life.

    The brother claims he has 27 counts of Mr President’s breaching the Constitution of Zambia. So instead of analysing things from without let Parliament sort out the impeachment plan as there are guidelines to follow as Mr President himself as said the opposition PACT has a right provided for in the Constitution to effect impeachment proceedings.

We don’t know if he has breached or not, but I’m sure there’s something to what Sata and HH are saying which zanbian citizens may not know. Another problem I wrote about is that even if RB had breached the constitution, the Parliamentarians would not react and we as zambians would not know about the breach. I did not mention that I know what he has breached. So, #61 read and understand before you air your view.
    Instead of you writing what you wrote, which does not make much sense, you could have answered my question: What kind of breach could lead to impeachment? Maybe, you are the one who needs a neutral lawyer to answer the question.

  54. Shikapwasha’s comments on Sakala’s hold on to office citing that these are Judicial matters that must be left to the judiciary is madness. This is a constitutional matter. Chief Justice is a Head of Judiciary and in this case an interested party. Therefore, No one expects him to be a respondent & Judge on his own case. Only the President sworn in to defend the constitution can move a motion to retire the CJ. RB’s silence is tantamount to breaching the constitution making it a fertile ground for impeachment. I support those wishing to impeach RB as ignoring this is a serious constitutional breach. A Judge shall retire at 65 is because one’s mental capabilities cannot cope post this age. CJ’s hold on to power is jeopardizing the prudency of our judicial system.

  55. You see john doe, there re very few cases of succesfull impeacments but the grounds have to be either gross misconduct or violation of the constitution. Even with the right numbers in parliament you need a tribunal set up with by the chief justice, and evn if they find the president guilty he can only be removed with a two thirds vote. Now do you honestly think there are any grounds

The impeachment motion will be presented to Parliament in the next 14 days and so let us wait and see what will happen to Mr President and those that fell nothing will happen showing that they are not scared.

  58. #65, Listern to wisdom. the issue is not about one’s mental capabilities, judges can be effectives even after 65 yrs. the issue is about want the constitution says, if a supreme court judge attains the age of 65, then he’s supposed to retire otherwise he has to be given a 7 yrs contract by the president to be ratified by parliament. with the current CJ, we are not sure if he even has a contract, assuming he has, we all know that parliament has not ratified it and so his not fit to be CJ. he has to vacate the office. Read Prof. Hansungule’s article in ystday’s post. as for constitutional breaches for which a presdo can be impeached,. its any contitutional breach big or small. its like a question of sin that leads to hell!! big or small?

  59. When it comes to misconduct, I’d say yes. To engage in corrupt practices or engage in abuses of power are gross misconducts. About the constitution, I’m sure it’s just a matter of time. We’ll get to know it. Fact is, the zambians know that RB is abusing his powers and he’s corrupt. By the way, gross misconduct can be a very long list. And I’m 100% sure RB has committed some of them, including the examples above. I repeat: If the Parliamentarians were not scared of RB, which by the way, shows that he’s a dictator, 2/3 would be a walkover.

  60. We talk about getting rid of the old folks in GRZ and bringing in new blood when we are the same pipo who put them in office.We are 12 million Zambians, are we sure that we only have 2 or it 3 potential presidents for 2011? All these guys have some serious skeletons in their closets.

  61. Why are we wasting time discussing this issue when it is a non-starter? The numbers dont add up. 18 PF MPs are against the process which means that PF/UPND are only guaranteed 44 votes when they need 53 to get past stage 1. Please King floor polish and your crown prince go and speak with the Zambian people so that you can come up with credible policies for 2011. Even if the thing was to succeed it would take up to 2011 anyway to get rid of Banda as the process is so long .

  63. Ba Kelvin, you don’t need to HATE people. Be more mature. We can do politics without having to hate each other and calling each other names such as FROG etc.
    No wonder the young people of Zambia will remain spactators in your own game. The reasons are many. You are cowards despite your high education, exposure and availability of information in this age. But for all this, you can only go as far as complaining in the newspapers and anywhere you find space to show off your good English. This is obviously the easy way out. This is not what you went to school for. You went to school to LEAD. So if those that are in government are useless, go there and do the right thing. But I know that you wont coz you are coward and thats the reason we still have RB, Sata, VJ, Munkombwe in politics today.

  64. Wait a minute, I noticed something, I wonder how many of you guys have seen the Zambian Constitution in your lives and better still how many of you own a copy or have consulted it in the face of issues such as death of the President, Impeachment, Tenure of office of Chief Justice, etc. The problem I see is that despite us having access to these documents these days (compared to the past), we are either too lazy to read these or are not interested at all. Instead, we choose to listen to people that are equally ignorant about these issues and allow ourselves to be misdirected – NEEDLESSLY! ..and some of the people we listen to about these issues are people we should actually be educating about the same. What a shame?
