Task Force wont hand back FTJ’s executive designer suits and shoes-Nkole

Share

Former President Frederick Chiluba’s executive designer suits and shoes seized by the Task force on corruption will not be handed back to him despite his acquittal on Tuesday.

And the Task Force says it will soon consult its prosecutors on whether or not to appeal against the acquittal of Dr. Chiluba.

Task Force executive Chairman, Maxwell Nkole, says the agency will hold on to Dr. Chiluba’s expensive clothing until the registration of the London High Court Judgement is determined by the high court in Zambia.

Mr. Nkole told ZNBC that the Attorney General, Mumba Malila, is trying to register the London judgement in the high court so that it can be enforced.

In 2007, London High Court Judge, Peter Smith found Dr. Chiluba liable of having embezzled public funds and ordered him to pay the government in excess of $50 Million United States Dollars.

Dr. Chiluba’s lawyers John Sangwa and Robert Simeza are challenging the registration of the London judgement.

The Lusaka magistrate court has cleared Dr.Chiluba of all six counts of theft by public servant, involving $500,000 US dollars.

  1. What is the point of holding on the big man underpants when you have congratulated the courts for acquitting him and praised the Zambians for accepting the verdict. All mockery! Give him his underpants, and stop mocking us. RB and MMD fought the Nchitos who were prosecuting this man. Do not expect the Nchitos to work to earn credit for the MMD talk of fighting corruption. We know that MMD is corrupt and cannot fight corruption. A blind man cannot lead a blind. This is it. Why keep the cloths and shoes. Wht the heck. Just f give him.

  2. This Kafupi needs to go in. The $500,000 being talked about is translating to K2.5 billion. Thats not that only money this criminal stole. Anyway all these are RB’s works.

  3. Give them to Chanda Beu and send the rest to Ituri forest for the pygmies to wear. AT least the pygmies can match the bizarre colours of the forest with chiluba’s tacky clothes. What right man in the head wears blues shoes on a blue suit. It seems chiluba is not only a physical midget he is a mental midget as well.

  4. Too much deceit pa ZED. The grounds (alleged crimes) on which Chiluba’s immunity was lifted (and they were very convincing) have never been used to prosecute him. Why?? Is it because the conspiracy was enveloping so many people and institutions? Probably this is why Chilu is crying for his immunity to be restored as prosecutors may decide to go for it. Again, if you analyze backwards, things look …………..!!!!! Iliko tricky, kwati…!!

  5. Give him back because not even selling them by auction Zambian will buy them may b ba General Mulilo “Chanda behu” can get them

  6. Just give him back the underpants. God will mate punihsment on Chiluba and Rupiah for the corruptions going on. Us the people are now frustrated with this RB givt. We wait for 2011 where we shall decide through the pact.

  7. Zambians, meek and subservient, have no say in the fate of Chiluba’s designer suits. They are voiceless spectators of a game beyond their faculties.

  8. What nonsense is this? Let’s not waste any more time and money on FTJ. Holding on to his stuff is a contradiction to the rendered judgement. As a nation, we have to move on. Our judicial system is now completely broken. It is SANGWAPO. If you have to steal government money, just do it. The message is very clear that even if you collaborate with others, you will not be found guilty.

  9. BaTask Force, this is just grandstanding. You know that these cases have already been pre-determined. These judgments are written elsewhere and just read in the courts. Mupaseni chabe vovala mwini wace. Don’t waste any more tax payers’ money. It will be needed to take another politician to Morningside and Milpark Hospitals.

  10. which law school did our Judges (lawyers) go to kanshi? and the chaps are making money out of nothing pa zed. our legal system needs to be overhauled, its damn rotten. these so called learned colleagues are learned for bull, and they are over protected. now i understand even more clearly what Sangwa is talking about (IN HIS PETITION AGAINST C.J. SAKALA)….these guys must be held accountable in one way or the other for passing outrageous judgments….

  11. The task force should be taken to task instead. They made us believe there was a case that Kafupi needed to answer and waisted a lot of our tax payers money. RB is the greatest deceiver Zambia has ever had

  12. Iwe chi Nkole ulichipuba sana, are u trying to fool us? In the first artcle of today you said task force has welcomed chiluba,s acquittal, now u are turning around saying u ar holding to kafupi’s green and oranges shoes. Please dont think zambians are stupid, your days are numbered. Give kafupi what belongs to him, you task force you failed to perform your duties full STOP.

  13. The reality of Chiluba’s points to the unreliability of our government. On one hand, Regina was found with a case to answer by the courts for receiving stolen property, on the other hand, the person where the property came from has been acquitted. Shameful isn’t it? What kind of judicial system is this. Help me understand this mess

  14. #15 mo taim – u cracked my ribs kunseko!!! hahahaha…..isha yellow and all the crazy colours you can think of…ala bwafya!!!

  15. # 18 actually those crazy colours aya kwa chiluba are also used in mental institutions to test ishilu nganalipola if for example ngalifwele insapato sha yellow and he is asked ati “what colour of shoes are you putting on “ngalwalanda ati black or red ninshi baishiba ati talilapola ninshi kulibwekeshamo ngalyala ninshi lyaba discharged

  16. No 19 the courts know no tribe but ‘Evidence’ Chiluba was not a civil servant but president.

How can some educated lawyer categorise him as a civil servant? Law yapa great east campus….. desk lawyers indeed!

  17. But this ***** was saying something else earlier on. Just when you thought you have seen enough! Mubutafye ku Zed!

  18. Give him back the his clothes and shoes. Just because you have no swag does not mean that every body is the same. I am not a president but my shoe collection is to die for!

  19. PULUKUTU,
So you agree that what SATA was propagating during the rallies then in 2006 that chiluba was being persecuted by mwanawasa because he was bemba was utter nonsense coming from a wicked mind.

  20. Oh c’mon! This is ridiculous! Give the man back his items! Ama politics ya pa Zed ya bu senshi! If somebody took my Louboutins and designer gear, they would have hell to pay! Ma jealous fye! After all, teti fi mu kwane no ku mi kwana, mwe ba kapalala mwe! Nonsense!

  21. Slumdog, I’m in Oil & Gas! Have been for a long time, and can afford high end rig, EASY! FYI, the few years that I was a kid in Zed, I wore Clarks to school. Not that I have to justify myself to you. The fact is Chiluba has been acquitted, rightly or wrongly; and the items should be given back to him. End of!

  22. Mr Nkole dont steal more money from Zambians any more……..what nonsense are you talking about? You praised chiluba’s aquittal now you have turned 180 degrees to inflict more pain on us?? Give him his clothes bane,,,,,,,just know that Task force and the judiciary are a laughing stock of Zambians. Who can trust and believe you thieves?????

  23. #31 Slumdog Shalapungu Bata in America? SMDH! The thing is some people love to buy a lot of cheap stuff so when they look at all the rubbish, they feel content. My friends closets have so much junk they call clothes, its a shame. However my closet is modest. I go for expensive and quality designer stuff because I know I will have them for a long time to come! Quality beats quantity my friend!

  24. Dalitso If you think chiluba has swag from those zoot suits whcih were cool in the 50’s and pimp like gaudy gators then really I wonder what you know about style. Maybe you nederzambianese come from a brood of ‘nouve riche’ that think designer pricetags are synonimous with quality. Clothes expensive or not do not make a person , a person makes the clothes, if you think buying expensive clothes will give you instant class you will end up unknowingly showing your ‘combonicness’ . I find it silly and extremely tacky to name drop name brand clothes because I was on that level 7 years ago . Chiluba thousands spent money and ended up looking like a leprachaun , class is not something you can buy .

  25. Am puzzled beyond repair here or am i missing something. Of all the assets this man has, the task force just went for his clothes. Who would want to become the center of attraction by putting on those suits if at all there were to be auctioned. Thats africa, you dont just put somebody’s clothes on, you will dance without music. bwafya

  26. #35 To each his own. I don’t know how many men can pull off Chiluba’s colors. Also the man is 63y/o. You don’t expect him to sag his trousers. And by the way, there’s never been an instant when I had seen Chiluba and thought he was dressed like a pimp. I like clothes, expensive ones for that matter and I have no qualms about it. I also know that clothes don’t equal class. Class is something one can’t buy and I find it ridiculous when people claim they have class!

  27. @ #35 Whatever! I’m not going to go into a slanging match with you. People might not notice the difference!

  28. #38 You are worried when you are telling me about your job and name dropping brands as if you to impress when I haven’t asked LOL. Remember obama’s quote if you put lipstick on a pig what is it, a pig!!! moral of the story you can wear designers but if you combonic you negate your aura. #37 So you mean to tell me if something is of high quality and cheap then you don’t buy it just because you like expensive. Have you ever been to a clothes factory? If you ever get the chance visit Guangzhou in china and visit and interview the factory owners. The difference between a gucci polo shirt that costs $300 and a nameless brand shirt that costs $40 is the extra 8 minutes to stick on a namebrand because they know theres designermad consumer driven people

  29. #38 You are worried when you are telling me about your job and name dropping brands as if you to impress when I haven’t asked LOL. Remember obama’s quote if you put lipstick on a p.i.g what is it, a p.i.g!!! moral of the story you can wear designers but if you combonic you negate your aura. #37 So you mean to tell me if something is of high quality and cheap then you don’t buy it just because you like expensive. Have you ever been to a clothes factory? If you ever get the chance visit Guangzhou in china and visit and interview the factory owners. 30. #39, I know the tricks of the trade. Am an educated consumer. But hey I still think Chiluba should be given his clothes and shoes back. Who can fit in those any way? Thats why he had to have his wardrobe custom made because he is not an average sized male! I mean he was president and you did not expect him to go to a corner tailor to have his clothes altered!

  31. Nkole boy, dont justify you failure to convict Chiluba by trying to hold on to the suits and shoes which were suppose to be presented in court as evidence.Unless if you tell us that you want to establish a new case against him, which will be a waste of resourses and time.Give Chiluba what belongs to him there is no evidence to suggest that the suits were bought from stolen money. That is why the court did not find him guilty… ATOLELE FYE TAIBILE….

  32. Following “… Task Force says it will soon consult its prosecutors on whether or not to appeal against the acquittal of Dr. Chiluba… executive Chairman, Maxwell Nkole, says the agency will hold on to [Honourary] Dr. [Mr. FTJ] Chiluba’s expensive clothing until the registration of the London High Court Judgement is determined by the high court in Zambia.

Mr. Nkole told ZNBC that the Attorney General, Mumba Malila, is trying to register the London judgement in the high court so that it can be enforced.” I would like to mention that all the issues surrounding Mr FTJ Chiluba’s acquittal will be cleared when the London judgment is either registered or not registered in our Zambian High Court. As of now, let us hold on as we look upto the State.

  33. 20 Akapondo greetings. On your “CHILUBA HAS BEEN AQUITTED BECAUSE HE IS A BEMBA.” I am not sure whether you are right by the whole statement since the court of law has done its good judgment according to Migistrate whoever but I am interested in the truth that Mr FTJ Chiluba is BEMBA.
Indeed Mr Chiluba FTJ is a BEMBA speaker just like the Kaponyas we have in most parts of our country although Mr FTJ Chiluba is not a BEMBA tribe person as argued by some bloggers above.
The CSO statistics prove that Mr FTJ Chiluba is a BEMBA and hence the numbers that indicate that BEMBAS are about 1.2 or more million in Zambia which accounts to about 46% BEMBAS. Otherwise the actual Bemba by tribe people are fewer in percentage in our country Zambia.

  34. Wats so wrong wit u akapondo and 45,so tribalistic in yo thnkn.U nid 2change yo behaviour coz its bcoz of pipo lyk you datwe hav RB as the president of dis nation.

  35. AWE KULA KUTIKAKOFYE, FELLOW BLOGGERS, YOU KNOW VERY WELL THAT OUR JUSTICE SYSTEM IS FULL OF OF CRAP. LETS START A NEW CHAPTER

  36. Dear zambians, i think its unfair to say RB had a hand in this judgement. If you look at it critically, you will find that the case was messed up by the task force from the begining. Kabolala nipakuboko. Chiluba stole a lot of money more than 500,000 dollars but the task force chaps are so dull that they only charged him for stealing half a million dollars. Government has spent millions of dollars on the task force just to recover underwear. What happened to all those accussations levy read in parliament? Which way forward for zed? My heart bleeds.

  37. BA LT moderating what? Imwe na imwe lyonse tulemikalipila.there are people who have churned out shit on the blog muletambafye.ifwe tukalipileko akamuntu yakosa.yashani?

  38. MAESTRO,
Mr bro’.i cant be so naive to believe so.chiluba was aquitted not because he is bemba but may be to some defficiencies in the prosecution.i brought this up because this is the tool sata was using to campaign in all bemba speaking areas in 2006.and that if he ascended to the presidency he was going to drop all charges against chiluba.i knew that when i post this statement just to echo what sata said some halfbrains will jump on my neck who didn’t have the guts to condemn loud mouthed sata when he was uttering that nonsense because they either hate rupiah or they are desciples holed up in the blind sailed ark “ubwato”.so my bro maestro it’s not true that chiluba was aquitted on tribal grounds.

  39. SCORE LINE ……………. KAFUPI CHILUBA 4 Vs NKOLE ZAMBIAN 1.AT FULL TIME.. meanwile the ref. has praised ZAMBIANS for accepting defeat.

  40. #47 MAESTRO 1st Good afternoon. Point of correction. FTJ is not a Bemba by tribe, he is a Northern Lunda(pronounced LUUNDA). I can confidently say so because we come from the same district and happen to have been at the same primary school where FTJ was some years back. We speak a dialect of Bemba in Luapula but we are of the following tribes USHI, CHISHINGA, LUNDA, NGUMBO, UNGA and some LAMBAs. Just as we call all people from Southern province Tonga, so are we also mistaken for BEMBAs. Infact our Senior Chief is very well spoken in Lunda which is just slightly different from that which is spoken in NWP. I hope I have satisfied all those who are calling FTJ Bemba.

  41. For anyone debating the Peter Smith judgement, it may be worth reading this thesis http://www.alastairhudson.com/trustslaw/Persistent%20problems%20with%20the%20objective%20dishonesty%20test.pdf

It discusses the “Attorney General of Zambia v Meer Care & Desai6? which case was initially conjoined with the Chiluba case but who subsequently won on appeal.

Pay particular attention to this paragraph “Peter Smith J constructed a peculiar test for dishonesty to the effect that it “is essentially a question of fact whereby the state of mind of the Defendant had to be judged in the light of his subjective knowledge but by reference to an objective standard of honesty”7 and that “[t]he test is clearly an objective test but the breach involves a subjective assessment of the person…

  42. Task Force give back Chiluba’s belongings. You have taken all these years to investigate the case and you have come up with nothing. You have wasted a lot of tax payers money and you are the only ones benefiting from the case.

Forget about appeal as you will be wasting more money. God has decided Chiluba’s case.

  43. Wait for the civil london judgement, you will ask me chiluba will cry, and zambians will have the last smile. we have lost a lot of money on this kafupi man

  44. please give the old man his clothes. You haters what is the problem, you don’t trust your own courts of law. whats up? the man is free there is no need of holding to his belonging. Clothes lot easily you might end up buying new ones for him. Be fair surrender his goods. Imagine if it were you being treated like that.

  45. Clearly Nkole was not acting within the confines of the procedures of his office. One could almost confirm there was another force operating within that environment. It is the corruption that most would want to be blind themselves to. I have always believed among the many professions that are meticulous in the excution of their dutie, one of them lawyers. The operations of ba Nkole left one wondering as to whether they were involved in a genuine cause or were just being used to settle scores. This man droped his guards for umuchanga it would seem to me. These are some of the issues I have trouble with when people say Levy was fighting corrutption . I can only hope for a better tomorrow. The present is not inspiring.
