Explain judgement- FODEP

FODEP has urged the Task Force on Corruption to explain the contents of the Judgement in the case where former president, Frederick Chiluba, was facing theft charges.

The Lusaka Magistrate court on Monday acquitted Dr. Chiluba who had been facing six counts of theft by public servant, involving $500,000 US dollars.

This is on grounds that the prosecution team failed to prove its case beyond reasonable doubt.

FODEP Executive Director, Stanely Mhango, says simplifying the judgement will allow ordinary Zambians to understand the ruling and end unnecessary debates.

Mr. Mhango told ZNBC News in Lusaka that FODEP is a firm believer in the rule of law and hence respects the court’s decision.

He also said the Task Force on Corruption has competent lawyers who should decide on whether or not to appeal to the high court on behalf of the Zambian People.

  1. To put it simply ‘ The judge was not impressed with the mountain of evidence’. The only way chiluba would have been convicted is if he tattooed guilty on his forehead and came in with a wheelbarrow of money, even then zambian judges would have said it’s not enough.

  2. FODEP has misdirected their question. May be LAZ is better placed to explain. Otherwise all Zambians know what WASHOUT means. There are unfortunately no solid grounds for appeal. The best that Levy, the Post and Nchito had on the matter was exhausted during the trial. It failed to secure a conviction. What they may have remaining is obviously cabbage. Just disband the Task Force. Period.

The London judgement by the now fired racist Judge Smirth is null and void.It was a racist act by white prejudiced supremacist judge whose racism has no boundery.He worked with desperate black accomplices with self identity crisis. His racism was without respect for constitutional jurisdiction.He is the same class of white supremacists that took our brother Martin Lurther King and now working restlessly to take the life of our dear brother Obama.Abash racists Africa need them no more but those with mutual respect.Let him convict his brother Blair first with more sins than African head of state.

    PHOENIX – About a dozen people carrying guns, including one with a military-style rifle, milled among protesters outside the convention center where President Barack Obama was giving a speech Monday — the latest incident in which protesters have openly displayed firearms near the president.

    Gun-rights advocates say they’re exercising their constitutional right to bear arms and protest, while those who argue for more gun control say it could be a disaster waiting to happen.

    Phoenix police said the gun-toters at Monday’s event, including the man carrying an AR-15 semi-automatic rifle slung over his shoulder, didn’t need permits. No crimes were committed, and no one was arrested.

  5. The man with the rifle declined to be identified but told The Arizona Republic that he was carrying the assault weapon because he could. “In Arizona, I still have some freedoms,” he said.

    Phoenix police Detective J. Oliver, who monitored the man at the downtown protest, said police also wanted to make sure no one decided to harm him.

    “Just by his presence and people seeing the rifle and people knowing the president was in town, it sparked a lot of emotions,” Oliver said. “We were keeping peace on both ends.”

    Last week, during Obama’s health care town hall in Portsmouth, N.H., a man carrying a sign reading “It is time to water the tree of liberty” stood outside with a pistol strapped to his leg.

  6. Fred Solop, a Northern Arizona University political scientist, said the incidents in New Hampshire and Arizona could signal the beginning of a disturbing trend.

    “When you start to bring guns to political rallies, it does layer on another level of concern and significance,” Solop said. “It actually becomes quite scary for many people. It creates a chilling effect in the ability of our society to carry on honest communication.”

    He said he’s never heard of someone bringing an assault weapon near a presidential event. “The larger the gun, the more menacing the situation,” he said.

  7. In the first place how did the ignorant understand chiluba’s charges.if the cant understand let them **** off.who stopped them from attending school when it was infact it was free in kaunda’s time.

  8. Too much deceit pa ZED. The grounds (alleged crimes) on which Chiluba’s immunity was lifted (and they were very convincing) have never been used to prosecute him. Why?? Is it because the conspiracy was enveloping so many people and institutions? Probably this is why Chilu is crying for his immunity to be restored as prosecutors may decide to go for it. Again, if you analyze backwards, things look …………..!!!!! Iliko tricky, kwati…!!

  14. Imwe Ba FODEP, what explanation do you want. The Task Force lost the case PERIOD. Justice should not only be seen when you win cases. Emotions are not points in law. What M’membe says in The Post is not law and neither is it all truth and nothing else but truth.

  15. though it is behond resonable doubt that chiluba stole money there was no proper evidence to bring a resonable charge against him as the evidence that was brought before the court was punchured with so many holes and the verdict could have been the same even if it was mwanawasa in power ,a typically similar case could be that of oj simpson

  16. #4. I conquer with you. In the first place, this case was a non-starter. Levy wanted to use Chiluba to make himself a name on the international platform, especially in the face of whites in the western world. Which of course he managed. In fact on the other hand it is probably ok that it has ended in favour ‘slippery’ Chiluba as Zambia became a laughing stoke whose legal system is so basic they had to contract a london lawyer. So, FTJ, have a good time as a freed man. There’s sleepiness in Zambia.

  17. Even when the Postnews may fairly report on certain issues, they went after chiluba because the felt he should be imprisoned. this case was about rivenage on the part of the Post. The all issue was a Chiluba Vs Post case. the Post editrols on Chiluba have always been inserting hurt ba Zed. This could have been avoided had the Post toned down their personal vindater towards Chiluba. Fred must be crying!!!

  18. This case is not straight imwe ba supporter bakawa FTJ. 1) The State always rushes to appeal whenever it loses acourt case. 2) Nkole says Chiluba will not get his size 2 shoes etc. If he is innocent why keep his Liliputian attire. Who is gonna wear them considering the small size?

  20. # 11 Chapwa, you are dead right. People should concentrate on looking after their families. They will follow the corrupt Zambian politicians at their own peril. Donors too should be wary of the current Zambian politicians. Otherwise their money will always end up in the pockets of the top politicians. Apply stringent conditions.
