Second Republican President spokesperson Emmanuel Mwamba claims that Dr Fredrick Chiluba had his immunity from prosecution automatically reinstated immediately he was acquitted on corruption charges last year.

Following his acquittal on six counts of corruption by Ndola Deputy Registrar Jones Chinyama sitting as Magistrate in Lusaka, the former president through his lawyers wrote to the Speaker of the National Assembly requesting that his immunity be restored.

Speaking on QFM’s the Public’s Last Say, last evening, Mr Mwamba said the former president’s immunity was lifted by parliament in 2003 on specific charges which have since fallen through following his acquittal and that he has automatically reclaimed his immunity.

Mr Mwamba said as things stand at the moment, anyone wishing to bring any new issues against Dr Chiluba will have to go and persuade parliament lift his immunity.[quote]

Parliament moved swiftly to remove Dr Chiluba’s immunity in 2003 on the instigation of his late President Levy Mwanawasa who brought up numerous allegations of corruption suspected to have been committed during Dr Chiluba’s ten year rule

  5. Mwamba, the London civil case registration is in the offing, the judgement is Chiluba stole and abused state resources. When we effect registration we shall enforce. Mr. mwanza’s relatives feared the time ka Kafupi was in power and was feasting on his wife. For security reasons they never took action as could have elliminated them, Now they are taking the small thief to court. Ti kaona.

There is no provision in the Constitution providing for restoration of immunity and any move to do so shall be void to the extent of its inconsistency with the constitution.Once immunity has been lifted, it can never be restored. The lifting of the immunity is never temporal but final. It is not even conditional on the outcome of the criminal prosecution.   8. #14 Smooth criminal, you are right and thanks for quoting the document. Where does this Civil Servant Mwamba get the idea that Immunity was automatically restored? And who said all FTJ cases fell away?

    By the way is this chap Mwamba a lawyer or just a mere civil servant. Does anybody know his education credentials or profession. He seems to be every where lately like Chiluba’s lawyer and his handling of FTJ’s PR is lousy at best. As somebody said, how come we don’t hear about KK’s spokesperson? Answer is simple, KK’s people know how to handle the big man’s PR and just see how they dealt with allegations of KK commenting on MMD issues and the story has died a natural death ..that is how professional PR know how to deal with issues. Not this amateur Mwamba. FTJ ought to fire him.

He knows he cannot interfere with this one(London Judgement) so the only way is to sneak in the restoration of the fake immunity. But it wont wash and FTJ will face the music. By the way FTJ was in the same school with me so the question of hating does not arise.

Mwamba, a timely call for you to get a much more decent Job. We know you need to fend for your family but get a Job where you will be expected to work and not just Yap at anything

People,dnt blame Mwamba,he is just a journalist from Evelyn Hone College,he is a civil servant,Kafupi doesnt pay him either,his salary comes from cabinet office,he is a civil servant,his job is to prepare press statements,take them to his boss for approval and go to the press,thats what he’s paid for,he’s just a small fish who happens to be swimming with an elusive spineless,toothless,woman grabbing shameless pint sized shark
