Sata sues TIMES for defamation

PATRIOTIC Front (PF) president Micheal Sata has sued the Times of Zambia for libel.

Mr Sata has also applied for an interim injunction to restrain the newspaper and its servants or agents from publishing any defamatory words concerning him.

Mr Sata’s lawyers from Ituna Partners have also filed a certificate of urgency claiming that the matter was of extreme urgency and required expeditious determination as the Times of Zambia had allegedly continued to write, publish and print defamatory articles concerning Mr Sata.

In an affidavit in support of an interim injunction, Mr Sata stated the Times of Zambia published articles concerning him in the editions of February 22, 23, 24 and 25 this year.

He indicated that the articles titled some ‘Sata leads polygamous life’, ‘Forget about presidency’, Sata told, ‘Sata is not credible’- Mumbi, Chimumbwa.
He stated that the articles were allegedly defamatory.

“The words in the said articles in their ordinary and natural meaning meant and were understood to mean that I am not a law abiding citizen, I have a criminal record, I am not a sincere Christian, I do not abide by the rules and teachings of the Catholic Church, and I am a dishonest person with no integrity,” Mr Sata claimed.

Mr Sata said he was a staunch Christian in the Catholic Church which did not allow people leading polygamous or polyandrous lives to receive Holy Eucharist.

That he was a politician and alleged repetition of false imputation of a criminal character would only lower his estimation in the minds of voters.

He stated that unless the defendant was restrained by law of a court order from repeating the publication of defamatory matters, he was likely to suffer irreparable injury as his political ambitions and standing in the Catholic Church could not be atoned for by damages.

Mr Sata was claiming for aggravated or exemplary damages, an injunction restraining the defendant from further writing, printing or circulating or otherwise publishing of the plaintiff the said or any similar libel.

High Court judge handling the matter, Evans Hamaundu has set March 15 as the hearing date.

  1. Well sone SATA. I may not be your support but you are talking sense. It high time Times of Zambia, Daily Mail and ZNBC stated reporting the truth by not always defending the MMD.

Yes Sata I usually support you but on this one I wish to differ in that what was reported was really said by the said persons, it was even covered on Muvi TV, and those guys just reported what was said. So I think you better sue the people who said those words. The other truth i need to know is that do you really receive holy communion at St. Ignitius were you congregate in that you divorced your first wife and married a second one which the church must not recognise only if the said first marriage was not blessed in church and the second is?

    But why does Mr. Sata suddenly want to stop THE PRESS from writing about him. The times reported the news as it was gathered. Did the Times make up these stories about the big man? Didn’t he agree on his own that he has kids with the woman? Didn’t he say he can’t hide behind Condoms and that the Church does not allow the use of condoms? Didn’t the Bishop confirm he knew about these matters as far back as 20 years ago? The heat is getting too much for the big man.

Is Mr. Sata developing a double standard where only he and his image builder are allowed to defame govt officials on a daily basis. Also the Times of Zambia just reported the stories. On Mr. Sata receiving Holy Communion, this is a matter between him and God. If he has not complied with the conditions then he will be judged. But be rest assured, no Catholic Priest will tell you whether Sata has complied or not because our ethics do not allow any one to reveal confidential matters no matter what.

  27. The State Owned and Govt., controlled Times of Zambia, Daily Mail and ZNBC should take a leaf from BBC, CNN, Aljazeera and other progressive media outlets. Watching these Govt., controlled programes really sucks.

    In Zambia the post has a wider coverage and sales figures. It speaks volumes in comparison to the combined Times, Daily etc.

  37. Obviously all those saying the Times just reported what they were given have exposed their ignorance of not knowing the basic definition of libel. The Times cannot give its defence as having just been “given” information. Libel occurs when you cause to be published information about someone that is either derogatory or slanderous. The more prominent a person is in society like MC Sata, the more damaging the libel is considered. He has a very valid legal position, and Times is legally in a weaker position because they will have to prove that they meant no malice in publishing which doubt they will be able to do.

  38. Firstly, Sata has every right to sue if he feels aggrieved. But, Sata should know that he is a public figure and he personally decided to do so. By doing so he has accepted that the way he leads his life should go public. Chiluba raised issues on Sata that need an honest answer from him. The electorate want to know the person fully that aspires to be their Republican President. Sata has fallen prey to the ‘political engineer’s’ antics. He has become defensive and now he is exposing himself further. Now we know what he will do to opposing media organisations including the post if he were president.   40. I saw this coming. Ba mudala ba Sata was supposed to be talking about the policies that they are going to implement once voted into Power but he was busy attacking Chiluba. And chiluba has been quiet for a long time before he reacted. Nomba ba Mudala ba amba fire fighting. This is a big leason to politician, they should concetrate on policies they intend to put in place and condemn bad policies and unworkable policies that the ruling part is implementing as opposed to being personal.   46. Can somebody let us know what the cost of suing and taking people to courts? It seems to me that the only people who are laughing are Ituna and Co solicitors. Where exactly does Sata get his money from? Is he able to fully account for the wealth the money that he has? Also, what exactly is he suing the times for because all the things they wrote about him are true?

If you repeat a lie said by someone else, knowing or not knowing it to be a lie, you are equally culpable of the same offence. It’s as simple as that. If what you claim was true, then newspapers and media entities would never be sued for libel or defamation since by their very nature of work they merely “report” what others say. Therefore your premise is false and should be dismissed with the contempt it deserves, to use a popular Zambian way of putting things. I rest my case.

    You are right, but what will be the problem here is whether what was reported was the truth or not. If it is established that it is true, then would it be of public interest? He cannot sue reporting because there is always the journalists, ‘efforts to contact … proved futile.’ This in journalism is always put in, in order to give a chance to refute the story. If you have been given an opportunity to put your side of the story, it is not libel or defamation.

If all is laid bare how will telephore mpundu face his flock in church? That is the real issue. This law suit by Sata seems to be tailored more to protect mpundu than Sata. And the suit will be funded by mpundu, Sata is too stingy to spend money on lawyers especially on a case that he is certain to lose. Didn’t he threaten to sue Chiluba, has he done it? NO!

  58. The judge should expedite hearing this case, possibly throw it out at first hearing. These chaps just want to buy time knowing that such cases take time. Meantime Times should publish as much as possible before the matter is ready for a hearing.   59. 61, that is the point. The evidence to be adduced by the Times should include quotes of what Sata has said in the Post so that the judge can compare. And what is Sata complaining about when himself and mpundu have admitted these sleezy relationships in public and they are on record: audio tape, video tape, paper and all.

    And the Times of Zambia with their political editor, Mr Davis Mataka, can only plead two things 1. Justification, and 2. Fair Comment.
    Forget about the person who uttered the words, it is the person who published, or caused them to be, published who faces the music. For the defence of justification to work, the Times must have very good reasons to publish the story such as privilege coming from the head of state, courts of law or parliament, not chilandelande. Fair Comment? Kaya. Alya money nafuti Sata.

I think if Winter Kabimba was as clever as he would like us all to believe, he would let his wayward nemesis boss know that before he engages in all this way too numerous legal battles of his, he should first consider subscribing to the doctrine of Equitable Estoppel.   77. When it comes to politics Zambian media is usually biased. The post post tries to demonize the government and government media try to demonize the opposition. All of them are wrong in the way they handle these affairs. Since they all report one sided truths/lies, it makes sense to read government and non-government papers to have a somewhat complete picture. I think what we as readers should do is ask these politicians to tell us the truth when these allegations are made. Zambians are so caught up in politics and in defending their parties. We should never side with politicians. Politicians should exculpate themselves before the national jury with the truth. Until we change this type of thinking, we will never have credible leadership and a progressive country.
