NCC concludes reports adoption

THE National Constitutional Conference (NCC) yesterday finished adopting all the committee reports.

NCC Chairperson Chifumu Banda, in his closing remarks, said the conclusion of the adoption process for the committee reports was a milestone in the Constitution-making process.

“As I indicated at the opening of this session of the NCC, the next activities which remain to be accompanied are the following (i) preparation of the intial report and Draft Constitution Bill from the decision that you have taken in adopting the reports of the committees,” he said.

He said after the preparation of the initial draft report and Draft Constitution, the two documents would be adopted and published to facilitate public debate and comments.

“Thereafter there will be facilitation of public debates and receipt of comments and memoranda on the intial report and Draft Constitution Bill and then preparation and adoption of the final report and Constitution Bill and their handover to the Hon. minister of Justice,” he said.

He said members of the public would take keen interest on how their views and comments would be taken by the conference in terms of incorporation into the final report and Draft Constitution.

Mr Banda said the public would also be interested on whether the entire constitution would be submitted to a national referendum.

“The general public will take keen interest on how the conference adopts the final report and Draft Constitution Bill, whether only those parts of the Constitution which require the holding of a national referendum before they are altered should be submitted to a national referendum while the rest of the articles should be submitted to Parliament for immediate enactment,” he said.

He said the General Purpose Committee would meet to finalise the preparation of the remaining activities.

He urged the members to take keen interest in the public discussions, which would be held.

“You should endeavour to explain to the members of the public whenever opportunities arise, the rationale for the decisions that the conference has taken,” he said.

  1. Another form of corruption at work. You rejected all our submissions and you want to fool the public that they are part to this MMD censored constitution. You openly rejected to include people’s basic rights and termed it as a laughing matter. Count yourselves lucky coz you have become richer for nothing, but days are number God will free Zambia one day. Zambia will never see development unless we first see a people driven constitution.

  2. Whose report is this for? As far as the Zambians are concerned this sham does not in any case qualify to be a draft constitution. Let him say whatever he wants with his book. Just wonder why it took so long to go through and understand what should be in the book.

  4. We made submissions to the commission and you totally ignored them instead you opted for the pro-MMD twists and manouvres. Why should we comment on your so-called draft? And the so-called Minister of (IN)Justice is the red-lipped snake who was also part of the manouvres against popular submissions, what sense are you trying to make. There is only one comment to make and one comment only…this has been a total sham, waste of peoples time and plunder of national resources. True raping and subversionof the will of the people in order to keep an inept and corrupt regime in power. One thing for sure, there will be another constituiton re-writing commission before the sun even sets!!!

  5. This is a very vivid and very sided constitution making process on which people sitting on NCC they dont consider the entire people of Zambia. Why should this constitutional making process take so long to conclude? why did they ignore people/public submission to NCC and today they wanna involve everyone? May the good lord help Zambia to develop.

Since NCC has now concluded their work, I thought it is a good time for those who were called upon to assist in this vital National Endeavour to seriously reflect on what it is they have, or not have, accomplished.     Ans: The question is not as straight forward as it might sound. The Constitutional Convention made many drafts and many revisions to the Constitution. Better, perhaps, to note when the Convention started, May 25, 1787; and when it adjourned, September 17, 1787, or 116 days.

    Why has the [USA] Constitution endured the last two hundred years when many other countries’ don’t?

    Ans: There are lots of reasons, not the least of which being that the Constitution established a government that has served the people well and has protected the rights of the people. If either of these two goals had not been met, the Constitution we have today would have been replaced a long time ago. Now, obviously, our government has a lot of room for improvement, and there are lots of issues that we face, such as Presidential power and campaign finances. And the rights of the people are not absolute, in law or in practice.

    Over time, many changes have been suggested, though in the end, few actual changes in the Constitution have become amendments. But when you look at the revolutions in nations since our own, it is clear that the people of America have led a relatively quiet existence with a relatively benign government. There have been times of unrest, to be sure, such as the Civil War, Reconstruction, the Depression, the Red Scares, Desegregation, etc., But even so, there has been no reason to drastically change the Constitution.

    • I must admit that this is one great insight. It surley gives a company the opportunity to get in on the ground floor and really take part in creating something special and tailored to their needs.

    1) It reflects the ideals of the American spirit.
    2) It recognizes human nature.
    3) It establishes a strong government.
    4) The rights of minorities are protected.
    5) And finally, it is not reflective of any particularly radical ideal or viewpoint, but rather a melding of many opinions and philosophies.

    How I wish Zambians who are called upon to perform important national duties, such as the WRITING OF THE CONSTITUTION can learn something from such enduring sentiments as expressed above. For as long as us Zambians don’t put notational interests and duty above all else, instead continue to try and please the political powers of the day and for personal financial gain at the expense of our collective good, we will always lag behind other nations and civilizations. And a good Constitution is a bedrock for any “nation-society” to endure and develop. It says a lot about a nations VALUES and ASPIRATIONS!!!
