RB warns against Parallel Voter Tabulation

President Rupiah Banda has said it was criminal for persons and organisations that are not confirmed by the Electoral Commission of Zambia (ECZ) to compute and tabulate election results.

President Banda said the Electoral Commission of Zambia was the only institution that was legally mandated to compute and tabulate election results.

He has, therefore, warned people and organisations intending to tabulate results of this year’s Presidential and Parliamentary elections without permission from the ECZ that they would be committing an offence.

“Any person who therefore computes and tabulates results other than those confirmed by the ECZ is not only usurping the power of the ECZ but committing a criminal offence,” he said.

ZANIS reports that President Banda said this at State House today when he swore-in Justice Ireen Mambilima as new ECZ Chairperson, Justice Timothy Kabalata, who is new Anti-Corruption Commission Chairperson and Edward Musona, who has been appointed Deputy Chairperson of the Industrial Relations Court.

The President explained that according to the Constitution of Zambia, the ECZ was an autonomous constitutional body allowed to supervise and conduct general elections.

Article 76 (1) of the Zambian constitution states that there will be established an autonomous Electoral Commission to supervise the conduct of Presidential and Parliamentary elections.

Mr. Banda further advised those who wished to support Zambia in conducting and observing the elections that ECZ was an autonomous body and the only constitutionally recognised institution to conduct elections.

“No other institution, whether public or private, is permitted to perform any function relating to the conduct of elections in the country, including computation of results,” he stressed.

President Banda added that organisations that would help in monitoring elections this year should exercise secrecy during voting and counting of results until the ECZ declared the results.

He was referring to Regulation 15 (6) (f) of the Electoral (Conduct) regulations which states that monitors shall maintain secrecy with reference to any matter affecting voting and counting of votes and shall not by themselves or through their organisations declare the results of any election before declaration by the ECZ.

“Further, Regulation 14 (1) of the Electoral (Conduct) Regulations specifically directs all media broadcasting election results to avoid unfounded speculation which may cause instability and prohibits the media from publishing unconfirmed elections results,” he said.

President Banda has meanwhile, restated his position on the Parallel Vote tabulation (PVT) and said no one should be allowed to conduct this kind of exercise in this year’s elections.

The President expressed confidence that the newly appointed ECZ chairperson would not allow anybody to carry out the PVT which he said was a recipe for chaos in the country.

“As you take up your position Justice Madam Mambilima, I have no doubt that you will conduct these polls to the latter of the law,” he said.

And President Banda assured the nation that he would, in accordance with the law, render maximum support to the ECZ to conduct the upcoming presidential and general elections in the highest degree of transparency.

He said Government has invited the international community to come and observe and monitor this year’s elections because his regime had nothing to hide.

He told Justice Mambilima that her reappointment to head the ECZ was testimony of how successfully she conducted the 2006 elections.

President Banda said the approval of Justice Mambilima’s reappointment by all stakeholders showed how highly regarded she was in terms of heading the ECZ and conducting elections.

“The proximity of Presidential and General Elections also left me with no choice but to look for somebody who was very familiar with the operations of the ECZ,” he said.

He pointed out that the ECZ was an important institution in Zambia’s democracy hence it required to be manned by people of high integrity.

The President said it was important that the ECZ should be headed by people of integrity in order for the public to accept the efficacy of the election results.

“I therefore have no doubt that in my mind that you have the nation’s support and that you will lead the ECZ to yet again successfully hold free and fair elections,” he said.

President Banda thanked Justice Mambilima for consenting to serve at ECZ for the second time in the space of four years.

Justice Mambilima takes over from Justice Florence Mumba who recently resigned after workers at ECZ revolted demanding that she leaves the Commission.

On Justice Timothy Kabalata, President Banda said he had no doubt the experienced retired judge would serve the Anti-Corruption Commission with dignity.

He said it was important that corruption was fought in order to foster the country’s development.

And President Banda described Mr Musona as a hardworking Zambian who provided his service to promote justice in the country.

He said Mr. Musona would continue to work hard even at the Industrial Relations Court.

And Justice Mambilima said she was ready to take up the challenge of leading the ECZ even in the midst of workers who caused the resignation of her predecessor.

In their oaths, all the three that were sworn in pledged to faithfully and truly serve in their positions without fear or favour, affection and ill-will.

The trio further swore to preserve, protect and defend the Constitution of Zambia as established by law.

  3. The MMD via a special State house monitored task force has spent K25 billion since beginning of the year on activities to disrupt cohesion in the Pact. The scheme seems to be yielding dividends going by the latest events in the Pact that is on the verge of collapse.
    This special task force is headed by the party’s chief whip Vernon Mwanga and assisted by state house presidential aid Austin Sichinga.
    The money has been used to pay chiefs in Southern province to threaten to disown HH if he remains in the Pact. The chief led by Mwanachingwala and Mukuni have netted about K500m each plus a car of their choice. Chief Mukuni is since ever in Lusaka driving past Arcades and Manda hill malls in his latest BMW 7 series.

The MPs that were paid K250M each mid February are Peter Machungwa (PF), Elizabeth Chitika (PF), Faustina Siyangwe (PF), Besa Chimbaka (PF),Anson Sinama (PF), Douglous Siakalima (UPND), Garry Nkombo (UPND) and Highvie Hamududu (UPND).

    The UPND troika have been promised another K2 Billion each if they can deliver UPND to partner with MMD. The exchange of cash usually happens at Arcades car park between 8 and 10 pm when Pajeros and Landcruisers park side by side.

Well well well, the die is cast, I wonder whether there is still any sane person with any semblance a mind akin to reasonable thinking who can still deny there this year’s polls will be characterised by VIOLENCE. We have known for a long time that it is at the point of ECZ computation and tabulation of election results that UNIP and the MMD have always rigged polls in their favour. It was so sad for Mazoka when all of a sudden the ECZ stops releasing results for 12 hours, while incidentally results were pouring in from all parts of the country and he was leading. When the ECZ started releasing them, the Cabbage was all of a sudden declared the winner. There is no way this will happen again, once beaten twice shy.

I strongly feel that PVT is not crimial but what is criminal is the result it brings when you have NGOs that have already shown their side tabulating.When you look at the NGOs supporting PVT they are all politically inclined.Already it can tell you what they are upto.So us people who like commentnig on issues we dont even understand or can not see,lets learn to ask.The NGO`s interest is money paid by donors of a named oppositon to give results they feel are desrved by the named opposition.but lets not forget that this is a secret ballot.It does not mean that the poeple who attend your rallies are the voters.So lets be objective and mostly carefull.We do not want problems simply because this old man will not have another chance to stand so he wants to spoil everything for this country.

Unless there is something they are planning.   13. You educated lawyers, LAZ and university of Zambia students, why are you confusing us. We engineers we talk what we learned at school. If it we are talking about ideal gradient it is the same language and same application every where and people are never doubtiful. But laws especially zambian laws, you can even start to think that a lot of people are wrongly sentenced, more especially the poor who have no capacity to be represented. Layers can you come out in the open if indeed you learn the same thing and apply the laws correctly so that we can have confidence in you. So now which is wihich? is it that law application can bend to suit the sitiuation and if so the career is a bad one.

    RUPIAH Banda and MMD are opposed to parallel vote tabulation (PVT) because they want to cheat their way to victory during this year’s general elections, says Dr Rodger Chongwe.

    And Dr Chongwe said the civil society organisations and Zambians should ignore the tantrums from President Banda and the government by implementing the PVT.

    In an interview yesterday, Dr Chongwe, a prominent Lusaka lawyer, said President Banda and his government should avoid unnecessary conflict over the PVT.

  33. I wonder whether some bloggers do it out of ignorance or just mare dishonest to themselves. You and I know the law and yet you insist on PVT. It is such criminal minds that bring chaos. If anything, i expect people to advocate changing the law to allow PVT. Otherwise just shut up and forget the PVT. The fact is and will remain that PVT has always been there but RB insists that it can be done with secrecy so that you do not creat chaos for nothing. Watch out for foreigners who are not happy with our peace and would do anything to finish it.

  34. There is a saying, once beaten twice shy. I wonder if our opposition are saying they are dull and can not use the means that MMD is using. Whoever cries of rigging is foolish and should shut up. The fact is there to see for all, that MMD can’t win an election against a strong alliance like the one we just had coz they are a minority party (less than 50%). Now that the PACT is no more, MMD will win it fairly and square. So do not give a blind eye to obvious issues. Whoever is thinking of violence after MMD wins this election should be punished severely with no remorse coz they have no reason.   48. This is what is putting the standing of ECZ as an autonomous body into disrepute. Why is the President giving orders to the Chairperson on how she must implement supervision of this year’s elections? I won’t be surprised to see many pro-PVT NGOs denied permission (accreditation) to monitor this year’s elections, & that will be a recipe for civil strife. Justice Mambilima must come out in open and protect the integrity of ECZ & personal dignity. She must read the public mood & be wary of making wrong moves that may cause chaos.   49. In the interest of the nation and fair play RB should be allow pvt to take place.All things being equal the results must be the same at the end of the day.If ten people vote you do not expect the results to be twenty.
