Kitwe Juveniles convicted of killing Bar tender

THE Kitwe High Court has convicted two juveniles for manslaughter after allegedly causing the death of a Kitwe man over alcohol, they will be sentenced next week after receiving a social report from the social welfare department.

High Court Judge Catherine Makungu convicted the two juveniles aged 18 and 19 after she found them guilty of manslaughter for allegedly causing the death of Mutale Makumba on November 25 last year.

The juveniles were charged with murder but the court found them guilty of manslaughter.

In delivering judgment, Justice Makungu noted that the juveniles were drunk, unruly and were angered by the deceased refusal to sell them beer.

She was satisfied that the accused persons had a common skim to attack and assault the deceased whom they left at the scene after killing him and died of internal bleeding and brain damage.

Evidence in court was that the juveniles, who are cousins were drinking at a bar in Mulenga Township and when beer was sold out, the duo decided to go to Twesheko bar where the deceased and his nephew Emmanuel Chansa were.

When the juveniles reached Twesheko bar they were informed that they could not be sold the beer and that was when one of them threw a stone at the late Mr Makumba.

The court heard that the deceased gave chase until he got hold of one of them who started calling his other colleagues for help and that was how they all started beating the deceased.

The deceased who was later found lying near Mulenga market was pronounced dead at Kitwe Central Hospital.

In mitigation, the juveniles through legal aid senior counsel Humphery Mweemba said they were still youths with a possible chance of reformation if given a chance.

They said they had been in custody since December last year and that the period had taught them a lesson as they had found themselves in such circumstances because of engaging in beer drinking.

The court will sentence the two on July 22 after receiving a social report from the social welfare department.

  1. At 18 and 19, it is shocking that these criminals are classed as ‘juveniles’? Hang on even when they committed the offence they were 17 and 18, juveniles?

  2. #2 – Go to the complex in Avondale and see what happens there over the weekend. Young girls and boys drink carelessly. Girls giving their bodies (sleeping around) excahange for beer for free. its shame.

  3. Ala moba is not for everybody. It makes you do things you would not normally do. I have great respect for alcohol. Just watch that human laboratory(Big Brother Africa) and see how characters change after a feel drinks of alcohol

  4. What do you expect the young Zambians to do, there is no recreation, people back home drink like hell, that’s why you find all guys at Young Age have tummies. Really sad, as they think it is a sign of wealth?

    Kaunda had encouraged sports not this new Government. All young boys will be in jail.

Take a survey in our compounds and see what’s happenning.Tarvens are open as early as 05:00hrs and mostly it’s the youths found at these drinking holes.Reason being there are no social amenities and no jobs..Most alcoholic drinks taken are Chibuku bulk.maWine,kachasu,tujilijili and whatever can intoxicate them. Govt please do something before tghis social cancer gets out of hand.

  6. These chaps will continue being a danger to society qnd a custodial sentence will be enough for them. At 18 & 19 they are big guys and thats why they enaged in heavy beer drinking. They knew what they were doing. If released back into society they will continue boasting and threatening others with death as is the case most situations. A snake is snake with same poison whether old or young.

  7. In the U.K. they are classified as adults. A 16 year old by law is juvenile even if they are mature in mind and body. 18 & 19 juveniles? maybe they are mentally deficient. Those guys should be held responsible for their actions, were they drinking with siliya when she came to Kitwe? lol

  8. 18 and 19 are adults.here when we go for the rides or the zoos the 13 year old pay the same as me and they considered as adults now these 18 and 19 they can even have children.its not only about jobs no i dont agree with that my brother’s son refused to go to college dispite his father having everything he neede for school.

  11. Iam not happy with their mitigation ati WE STILL AND HAVE A CHANCE TO REFORM What about the man they killed has he any chances atall such as seeing his children grow properly. LT thanx for taking us off politics for once though 2 chaps here have tried to put a political to this story.

Voting 4pf will distroy zambia hence peace lovers will toss out pf massively. Satan hated Levy it is well known fact! The yang man is misleading hinself 2join pf a party of insults.
