LAZ president Mwenye officially relinquishes his position to avoid conflict of interest

Law Association of Zambia (LAZ) president Musa Mwenye has resigned from his position following his recent appointment as Solicitor General.

In his resignation letter dated 29th December, 2011 addressed to LAZ Honorary Secretary Paulman Chungu, made available to QFM today, Mr Mwenye who was sworn-in yesterday by President Michael Sata says though he has anxiously perused the Law and found no provision that obliges one to resign his position as LAZ president when appointed to public office,he has decided to resign as LAZ president with immediate effect.

Mr Mwenye says this is so because staying on as LAZ president would conflict with his long held belief in the independence of LAZ.

He adds that although there are barely four months before the LAZ Annual General Meeting, he is persuaded that the avoidance of even the appearance of a conflict of interest between the office of LAZ president and that of the Solicitor General necessitates the decision he has made.

Mr Mwenye has commended the Council of LAZ for the resilience shown in the most challenging times.

And LAZ Honorary Secretary Paulman Chungu in a statement released to QFM says the resignation of Mr Mwenye will be tabled at a meeting of the Council of the Law Association of Zambia which is scheduled for Friday 6th January 2012.

Mr Chungu explains that it is anticipated that after the formal process of accepting the resignation is completed and the position of president declared vacant, the Council will then proceed to elect a replacement for the position of president in terms of Rule 10(6) of the Law Association of Zambia (General) Rules of 1998.

He says LAZ wishes Mr Mwenye all the best in his new appointment and reiterates its belief that he will serve the office of Solicitor General of the Republic with Diligence and without fear or favour.

  1. This is an honourable act. All the best in your new appointment Mr Mwenye. I hope other people in Zed can learn from this.

  2. May God guide you in your new appointment you people spoke the truth without fearing the ruling regime then, we want such people in Zambia. And for those critics of HE MCS that he does not want to work with born- agains, the new Solicitor General and the new DPP are sound born again christians. God bless HE MCs and our blessed nation.

    • Really?, they are BAs. What about Sata is he a BA too?

      Do you think DPP will think good of his Zambian Airways deals, when it comes to confessing his sins or?

  3. Jealous people – Musa is a respected lawyer who called for justice during the corrupt regime of ba Banda. I’m sure many of you would die for the position of Solicitor General – if you work hard you might just get there yourselves!

    • Really??????????? Calling constitutional breaches as lapses and he is a damn good lawyer; well aspiring for SG, PRIVATE lawyers who make money do not want such positions; only those that a close to bankruptcy.

  4. Our collegues in LAZ have never played their role in Zambian democracy with rooted princiles of their profession. We have had conficts of interest spurned above their call. The former VP in MMD is such one who never advised govt in accordance with laws of the land. Mr Musa Mwenye exhibited indecisions on number of issues and yet boldly wanted LAZ to sue a govt institution not based on principle but partisanship that has eventually paid off to his current appointment. Zambians expressed as LAZ president was siding with an opposition party then. The perception created on lawyers to most Zambians is disgraceful.

Anyone who has problems thinks his problems are shaking the world when the world does not care about his problems.Mwenye’s problems originates from his failure to strike the balance between the law and politics.In the end, he has given out his weakness and decided to resign and join sata and his aka temba government.

    • Musa is not Bemba he is Soli. He served LAZ dutifully and diligently and there is no doubt in my mind that he will serve the nation with distinction. To our friends who think he is a cadre etc please be advised that  he has left a thriving law practice to serve in public office, which is the true meaning of patriotism, he is not in it for gain like most of our brothers and sisters who have had an opportunity in public office, I sincerely belive pubic service in whatever form if well intended is a mark of a good citizen. Therefore folks let’s not focus on narrow misconconceptions but look at the bigger picture and the greater good of this great country! 

  6. In future lawyers that fail to declare interest of the party they belong have to be scruitinised regourously by Parliament. These lawyers speak in the name of LAZ hiding their true colours. They are so impotent to contribute effectively when their fellow lawyers in government throw mud at them. They bring shame to their profession while others even mismanaged and stolen their clients monies. LAZ has to come clean on its members. “He who seeks equity must do equity”. To be respected lawyers have to be honourable and not only be seen, but do and act above board.

  7. This is a noble and ethical stand. This is a clear demonstration of the sort of leaders Zambia should have. I hope LAZ will elect lawyer with the same caliber of integrity.\:d/

  9. Musa has been a PF cadre from inception . He is LAz’s worst presidents . It’s pay back time from post workers to LAz I love sata

  10. Musa Mwenye, a well-known PF-cadre who abused his position as LAZ President to get into marrieage with PF, must accept the adage that **ONLY DEATH WILL DO US PART**. Mwenye as a Lawyer could not have known that some fatal illnesses can usher-in a new President with consequent change in the structure of the Cabinet. Bad luck to greedy persons.
