Transparency International Zambia (TIZ) has advised stakeholders calling for the resignation of Director of Public Prosecutions Mutembo Nchito to follow the right procedure.

TIZ president Reuben Lifuka says the tribunal that has been set up by the president is for a specific cause, noting that it will be out of context to bring in another issue.

Mr. Lifuka however states that the setting up of the tribunal to investigate the suspended judges does not stop Zambians from advocating for another tribunal if there is any misconduct on the part of the DPP.

Speaking in an interview, Mr. Lifuka says it will be wise to first deal with the issue of the judges, and in the process of the tribunal if the DPP becomes culpable; he can equally be subjected to further scrutiny.

He has however advised citizens to follow the law and ensure that matters are not mixed.

And Mr. Lifuka says the institution of a tribunal to look into the alleged misconduct of the three suspended judges was legally done and within the powers of the president.

He says the only concern will be if the tribunal is the only way of reforming the judicial system.

Mr.Lifuka says government needs to articulate and implement appropriate reforms in the judiciary.

  1. Useless uncommitted comment Mr. Lifuka. Have you lost your back bone. The issue is not whether the President acted within the provisions of the law. The issue is whether he used the powers vested in him for the greater national interest or for a parochial and narrow interest of his campaigners and election financiers. It is also whether the effect of the suspensions will be to make the Judiciary more free and more independent or to intimidate the Judiciary into deciding the DBZ case in favour of Mr Meembe and Nchito. Mr. Lifuka stop waffling and addreess the issue of K14bm owed from the DBZ. People who borrowed a little money from the CEEC are being followed up to make sure they pay. What about the K14bn. Speak Mr. Lifuka if you still have any credibility.

    • In this case,Meembe and Nchito must not demand for a fair hearing,they are not intitled to it as long as Sata remains president.Whatever the accusation against them must be taken as gospel truth.IS THIS WHAT YOU ARE SAYING? Ask independent people in DBZ as to who borrowed the 14billion.Is it Meembe and Nchito or Zambian airways?

  6. Uncommitted comment indeed. With or without a commission of inquiry, those who borrowed public funds must pay back the money. Will the law ever be fair and just in Zambia where the rich steal from the poor masses with impunity?

  8. Lifuka is a nut. He is not even ashamed of himself. I am sure these chaps have been bought off. How can he say that Nchito’s issue is different from the judges’? Isnt Nchinto the reason judges have been suspended? These chaps borrowed from the state coffers and do we need a tribunal to establish whether they should pay back or not? If you borrow you have to pay back. This is a very simple and straight forward principle. This is utter nonsense and Lifuka, be warned. You will pay for this stupidity you have been exhibiting of late.

As is to be expected from the Bemba clique at TIZ, Lifuka’s statement is bespoke of a monomaniacal obsession on the alleged sins of the Rupiah Banda’s family and absolute silence about the misdeeds of his friends like Mmembe and Nchito brothers. The DPP is refusing to pay back US$30 Million he borrowed from the a public bank.

This issue is compromised because money was involved, however if the tribunal findings comes in favour of 3 suspended judges then DPP NCHITO should be fired by the president or amicably resign and payback the money that was borrowed. Its unfortunate that Zambian judicially is a big dissapointment to our identity as Zambians

  13. TIZ is just being objective and credible. They have been critising the PF where it goes wrong but where they feel tyhe action is correct, they commend Government, there is nothing like being bought. Indeed those who have credible reasons for removing the DPP provide them to the powers tha be so that the normal process can be followed, otherwise let the tribunal over the three judges do its work!!!

  14. Except for Mwiponta Mukabwela, the rest above have been blinded by there personal hatred for Mutembo. Give me satisfactory answers to these questions:-
    1. Why is Judge Mutunas issue the only one being echoed by bloggers? 2. How about Judges Musonda & Kajimanga, are they also connected to Zambian Airways Vs DBZ court case? 3. Why did Judge Phillip Musonda visit Mohan in Chimbokaila a day after he was suspended? 4. Did DBZ conduct a due deligence on Zambian Airways as an institution before granting them a loan? 5. What kind of loan and what was the security?
    As far as I am concerned, other judges need to be joined to this tribunal so that this tribunal serves as a springboard for judicial reforms in Zambia. Anyway ignorance is costly!

  15. Zeb Mpinganjira, you too man, you are objective. Rumour mongers have a way of feeding the public that which is of interest to them so as to twist the mind of most to think alike. In this case of a tribunal to investigate the 3 judges, the most talked about issue is one concerning Judge Mutuna and the case judgement against Mutembo. I guarantee everybody that the tribunal will not even look at the judgement, but at the handling of the transfer of the case from Judge Wood to Judge Mutuna. The judgement will still stand after this even if Judge Mutuna is found wanting. To get the judgement that states that Mutembo & Mmembe personally must pay DBZ quashed, Mutembo & Mmembe will have to apeal to the supreme court, if they have not yet done so!

  20. VJ Rigger, I agree. Lifuka and Lungu at TIZ must be replaced they have overstayed! To them corruption was about mmd, rb and chiluba etal. These morons must be moral and professional to leave this institution that needs fresh leadership renewal! NGO’s need to be changing leaders just like we change political leaders through tenure limits. When pipo overstay their welcome they tend to be complacent and arrogant!

Those that are calling for Mutembo Nchito and Fred Mmembe’s blood must wait until the findings of the current tribunal concerning the three judges, finish its work and let us the public know about its findings. The hatred of Mutembo because him and his brother single handedly took on the corrupt MMD, and Mmembe because the post single handedly wrote about all the corruption in the MMD and where warned by Rupiah Banda that he would fix them, needs to be seriously looked at. These two stood against the whole MMD machinery in government then. If they could lock up our current president on tramped up charges, what do you think the MMD in power could have done to these two if they knew they had a case. Lets wait for the tribunal to conclude its findings.

  22. This stance from TIZ on the matter gives the impression of being somewhat compromised. If tribunals be our new found mode for finding solutions to thorny or the table occurrences, we can expect a lot of tribunals to be set up yet! There is a whole “basket full” of matters for consideration by tribunals. One hopes the Finance Ministry did set aside adequate funds in the budget to take care of this expenditure!

Fellas don’t conclude I personally know that Sata has proved once too many that he cleverer than u think he is,there was a pressing briefing I saw when I still in Zed where RB was fuming and he said he would fix Fred and Mutembo so now its clear to me that he used the judges to get to these two guys and made sure that they became bankrupt so my advice let’s wait for the tribunal findings

  24. #35 You are implying that were it not for RB, DBZ would not have called their loan or sue to recover their monies which if you can use your mind for a second would realize the trio didnt qualify for the loan in the first place save for political influence from mangande and company. The whole saga is not even tied to RB but the web of divious characters that surrounded the late LPM. mhsrip

  25. Lifuka has said nothing of substance. He is just a PF cadre who sees nothing wrong in what Sata, M’membe and Mutembo are doing as regards DBZ.

  26. Lifuka for the first time you have dispointed me and many others I am sure. How can you set up a tribunal for a sitting in DDP. Who in their correct mind will testify against a sitting in DDP? How will such a person or institution survive? To make the matters worse how do you say a tribunal is part of reforming the justice system, but not the only way. For your own inform a tribunal to look into the conduct of a judge is not reforming, it is only to establish if a judge/s did any wrong, and does not change the way the system work. In this case the seperation of power, where the President intervines before other procedures are exhosted.
