Attorney-General’s decision to take MMD de-registration case to the Supreme court is an independent one-Shamenda

GOVERNMENT spokesperson Fackson Shamenda rubbished the accusation by MMD President Nevers Mumba that the PF Government has taken “a personal stance” to bring down his party despite the High Court quashing Registrar of Societies, Clement Andeleki’s decision to deregister the former ruling party.

Mr Shamenda said that the PF was not interfering in the affairs of the Judiciary and that the Attorney-General’s decision was an independent one. Mr Shamenda said that the MMD should not start crying foul over the decision and that the Attorney-General had the right to appeal if he felt it was the right position.

“We are not running issues the way the MMD was running them. The Attorney-General is free to appeal if he feels it should be so. Why should the MMD cry foul just because the situation does not suit them now, as PF we are just making sure we clear the mess they left,” Mr Shamenda said.

On Friday, Dr Mumba Dr Mumba said that Attorney-General Mumba Malila’s indication to appeal to the Supreme Court to challenge the ruling was a clear indication that the PF was after deregistering the MMD.

Dr Mumba said the Registrar could have made other efforts to meet the MMD to address matter on the alleged defaulting instead of filing an appeal in the Supreme Court.

“By appealing against the judgment of the High Court to the Supreme Court, this alone confirms our earlier concerns that the PF Government is moving towards creating a one party State in Zambia,” Dr Mumba said.

Dr Mumba said during a media that it had become apparent that the deregistration of the MMD, “was meant to wipe out the opposition in Zambia”.

He alleged that his party had been furnished with a photocopy of a Certificate of Registration of a Youth League in Mumbwa District which had been misconstrued to be a branch of the MMD but that such were structures that did not exist.

“A letter attached to the Certificate restated that reports should be submitted to the office of the District Secretary which is non-existent. Why then should the MMD Secretariat be required to submit such returns.

“The MMD is hereby appealing to the International Community to prevail over the PF Government to stop their manoeuvres to turn Zambia into a one party state as there can be no other reason for appealing apart from wanting to wipe out MMD,” he added.

The MMD leader said his party was ready to fight to the latter efforts to deregister his party.

  1. I thought the AG is part of gvmnet. This pf gvmnet does not speak with one voice.it is difficult to run a country like this.my biggest question do they consult each other before they meet the media

    • Iwe you forgot your civics that Govt is the peopele of Zambia. It is MMD vs the People, Not MMD vs PF. The AG can act for the people of people of Zambia (Govt)

    • @ Theologian: What you say is nonsense. The issue is not who against who, but where the AG got his instructions from. The AG works for the President so this statement is either a clear and shocking indictment against the lack of organization in the PF to say that the “AG didn’t consult his boss” or a bold face lie to say that Mr. Sata (who swore to defend Zambia’s democracy) is not behind the move to de-register the MMD and disenfranchise all of those who voted for them. Take your pick.

  3. International community know nothing about laws governing the registration of institutions in Zed. So Pastor, JUST PAY UP before you go into oblivion!!

    In a story in the Post, Seb Zulu seems to be trashing the constitution by suggesting the “Acting” Chief Justice – Chibesakunda, DOESN’T NEED TO BE APPROVED BY PARLIAMENT becoz the Constitution doesn’t refer to a person in an “acting” capacity – so in effect, PF HAVE TOSSED THE REAL CJ & HIS DEPUTY INTO THE LONG GRASS, & WILL MANIPULATE THE JUDICIARY USING CHARACTERS THAT ARE SIMPLY ACTING!!! What a RAPE of the constitution!!!

  4. AG Dont waste our time…MMD can you pay please! Pipo who the people of Zambia dont want to pay back..eeh ? MMD pay! Is PF uptodate with payments? 2016 ili pafupi pay! And those fat chaps who owe DBZ 14 bn pay! If every one pays then moremoney in our pockets!!!!!

  5. If the CPNs have appealed the case to supreme court, let them continues until the matter reaches the Hague. I know that they feel that its an achievement to deal with the MMD instead of dealing with poverty, closed UNZA and hundreds of ETCs.

  6. MMD just pay they money you owe the state and this issue will come to an end, dont be careless just respect the rule of law period. Ba Mumba if I were you as new MMD party president I would address this issue within the party and solve it quick, simply by paying what MMD owe and attck PF on their poor policies. so sit down with your senior party members and figure out how best you can pay this money. if it was in America MMD CREDIT REPORT WOULD HAVE BEEN MESSED UP BIG TIME.

    • Imagine. I don’t understand why they are so arrogant over an issue they created themselves after failing to settle the bill even after constant reminders. If they get registered, good for the country, after all the majority of them are a bunch of criminals with pending cases before the courts. One less very selfish and self centered party, would not do no harm to the democracy of the country. There are other opposition parties (not UPND until it cleans out its house) ready to step in and take center stage. If common Zambians pay taxes, what of a political party that was once in government. If it gets to the supreme court, they will have to deal with the AG who has more experience and legal acumen than andeleki and they may not be that lucky next time.

  7. AG appointed by PF govt is acting independently so says Shamenda. Where is the coherence in this govt? Shamenda has messed up the labour movement and strikes and protests and higher institutions closures are the order of the day. Where is the functioning of this govt? Wait more surprises, governance is not just unpalatable rhetoric. Todate Zambians are waiting for the fulfilments of election promises– more employment, development,BRA64 fulfilment, tribal free jobs and good governance. Lies come round and PF will create more lies to cover the first ones.

Ask HH, last time he was taken by america embassy, he was taken to pentagon. and in the past 8 months, The embassy has been taking Zambian including journalists to Pentagon (so that they have positive writing on africom or they dont even mention anything).  The Clintons, Bill Gates and Bushes of these world they dont just pay a charity visit for nothing, they are pure capitalist. My question to every one is that is it good for Zambia or is this going to make Zambia more safe, thats have having american army base?

  14. This move by PF is very costly to the country. Sata now has compliant judges on the supreme bench and if the case goes there, it is merely an academic exercise as we all know it. The backlash has the potential to bring down Satan and his hood of vampires.

Neverlands (nevers mumba) should do his politics differently from boko haram commander, aka hakaivotela heka, aka chimbwi no strategy(cns), aka under 5, if he wants to be taken as serious opposition leader.

  16. Why must the opposition always go crying to the international community to resolve internal issues? It just shows lack of maturity and even an inferiority complex to some extent. This is a very straight forward issue, its not rocket science! The MMD just needs to sit down with the registrar of societies and negotiate a payment plan of how they will clear their debt. In case the opposition has forgotten, Zambia is an independent and sovereign nation! Its embarrassing for them to keep running to the international community – that is self-colonization! It is also an admission that they are not capable of resolving their own issues and yet they aspire to run government! Such behaviour does not inspire confidence in me personally and I would not vote for such characters.

You are acting like a baby or some one who has no sense, no wonder Mwanawasa fired you, you are not fit to be a leader, stop crying and just find money and pay up. The law has no exception. Democracy will still be practiced in Zambia without your silly Party MMD.

  21. MMD needs to do a better job of explaining why it hasn’t paid. Still, I can’t help but feel they are being convicted by the PF-controlled media before all the facts are in. The little bits of news I’ve seen on this suggest the ones who did not pay were little more than youth clubs and auxiliary wings and hardly the MMD national party itself which is what Mr. Andeleki, the Attorney General, and their boss, Mr. Sata himself wish to de-register. Let these clubs and local branches be de-registered if you must, but that is very different from de-registering the entire party and all of the MMD’s duly elected parliamentarians.

    Still, as I say, MMD should do a better job of explaining its side of the story and say what is going on!

  23. Nevers you call yourself a pastor and you know what the bible says. Give to ceasar what belongs to ceasar. If the law says that you should pay why cry foul and call for international community for help. You are the same people who preach that you should tithe becos thats what the bible says and if you dont tithe then you are a thief, you are stealing from God. Why should you complain when MMD has stolen from the Govt. You are a hypocrity.

  24. Who took the MMD to Court in the first place – Was it the registrar of Society or the AG?
    What is in the mind of AG, to recover the money or to enforce punishment?
    How many entties in Zambia have found themselves in ‘bad debts’? It is a must that any entity that defaults in payment shall result it its deregistration?
    How much money is the govt spending on the same case, and how does it compare with what was purported to be owed by the MMD?
    What is the motive of the whole pursuit of the case?

  25. The bill belongs to the President too, he should pay for ten years and Nevers will pay for the other ten. It is unfortunate that all educated people have been turned into beggars for jobs from the President so they do not have a mind of their own, they just as good as garden boys and maids who always wait for instructions, some are even better than that because they know what they are supposed to do. Shame on this government nothing has changed for the better except that those close to power are chewing our tax and donor funds.
