Former Zambian President Rupiah Banda’s Lawyer has rejected as false allegations by State House on the story published by the Post Newspaper that he would use every ounce of influence he thinks he has to stop Bembas from continuing to rule Zambia when President Sata’s term ends.
Following Friday’s statement by President Michael Sata accusing former President Rupiah Banda of sowing ethnic divisions, international lawyer Robert Amsterdam has rejected the move as a dishonest and desperate slur on behalf of the Patriotic Front administration.
“Let me be absolutely clear: these accusations represent yet another blatant lie based on yet another bogus news article in The Post Newspaper, forming part of the ongoing politically motivated attack against my client,” said Amsterdam, who represents former President Banda and his son, Henry Banda.
“By recklessly playing with the issue of ethnic divisions, President Sata or possibly his inner circle have placed their personal needs above the needs of Zambians, and have irresponsibly conducted themselves in a manner unbecoming of a serious and lawful government.”
Amsterdam continued: “The comments are both untrue and embarrassing, as Former President Banda has strongly supported the Bemba leader of the Movement for Multiparty Democracy (MMD) Pastor Nevers Mumba.”
Rupiah Banda’s lawyer pointed out that the latest attack fits the pattern of recent abuses by the Patriotic Front:
“Let’s keep in mind that these are the same people that tried to forcefully dissolve the country’s largest opposition party, appointed family members throughout the Ministry of Finance, sought the removal judges to help their supporters avoid paying debts, called for the dissolution of the judiciary, filed dozens of lawsuits against critics, and are overseeing a completely discredited witch hunt that they call an ‘anti-corruption campaign,’” Amsterdam stated.
“Should we be surprised that they make wildly incendiary statements based on stories quoting non-existent ‘anonymous sources’ reported by their ally in the press? Unfortunately this is the new reality in Zambia that the international community is beginning to understand.”
And based on the Post Newspaper story Defence Minister Geoffrey Mwamba advised former President Rupiah Banda to choose his fights and enemies with caution, otherwise he may end up losing more than he will gain as he struggles to keep his political career alive.
Mr Mwamba was reacting to statements made by Mr Banda that he would use every ounce of influence he thinks he has to stop Bembas from continuing to rule Zambia when President Sata’s term ends.
“Mr Banda is supposed to be a retired statesman, living supposedly on state funds and enjoying other facilities such as security,” Mr Mwamba said. “The gravely divisive statements he has made make him an active political player. He could lose all his privileges since he has shown that he doesn’t want to retire.”
Last week, The Post revealed that the former President wants United Party for National Development (UPND) president Hakainde Hichilema to lead an alliance with the MMD to cut short the “Bemba hegemony”.
But Mr Mwamba said: “Mr Banda has forgotten that only eight months ago, he campaigned as ‘President for all Zambians’ and now he is preaching politics of hate and tribe. He is a bitter old man who can’t come to terms with change and does not take defeat very well.”
He said history has finally caught up with Mr Banda’s tribal inclination that could “plunge this beautiful country into chaos if we don’t deal with him quickly, fairly and squarely”.
Mr Mwamba added: “We are all Zambians and must live as thus and Mr Banda must remember that politics is about numbers, not tribes. He must know better than that and act with a certain level of political maturity befitting a former head of state.”
Mr Mwamba’s parting shot, however, was that “the gloves are now off and Mr Banda will receive the same treatment any normal opposition leader gets because he has out-stretched the goodwill the government has given him despite all the tasteless statements he has been making since his bitter defeat.”

That gives him every right to comment on matters happening in Zambia in as far as they affect his client. It is not about pro bono work of a practicing Lawyer but the merits that makes one an attractive option within the field. In the UK you have Lawyers and barristers and often barristers will specialise in one aspect of Law and attract work from that area. It does not make them criminals or complecent to the wrongs of those they represent. Mwanawasa successfully defended individuals accused of treason against the UNIP Govt many years ago. He was not labelled a conspirator but made a name for himself in that field of Law. Let’s be objective in matters of professions.

People lets be reflective in our comments. We will understand that Zambia has never been tribal until the PF Govt came in power. Kaunda worked wonders in unifying the country as a single nation. If I look back in my own family, I see the work of breaking barriers at play. My grand parents were of the same tribe, my parents generation have a mixed crop with the women (aunties) marrying from the tribe while the men have married into other tribes. My generation has gone even further with all my married sisters marrying into other tribes while the guys have even touched base with women in other countries. All this is a result of the efforts of the Kaunda regime. What we have today is a Govt deeply rooted in plots to weaken the opposition at any cost even that of national unity.

There is no question that tribalism in Zambia has always worked for the Super Tribe – the Bemba tribe and against the Non-Bemba stand-alone tribes. The reason is very clear, the Bemba tribe is a collection of many tribes, all working under the umbrella of the Bemba trade mark, hence the term “super tribe.” The Non-Bemba stand alone tribes like the Lozis, Tongas, Ngonis etc have failed to replicate this, and are therefore the perpetual losers in the game. Tribalism favours “the survival of the fittest.” In this case, the Bemba supper tribe is the fittest and hence it’s dominance of Zambia politics from the late 1950s. RB is not under investigation or litigation for him to use his lawyers to respond to anything. To the Zambian people he is our leader to Robert Amsterdam he is a client. When will he stop being a client and be a leader to Zambians. When PF leadership has a problem with former MMD leadership, how is a lawyer like Robert Amsterdam come in? Exactly, how does a former President or any Joe Public for that matter use a lawyer not just any lawyer but a sly international lawyer in the name of Robert Amsterdam to respond to issues of a political nature, the money this chap Ala Bee is paying this blood-sucking lawyer in a month can be used to employ an experienced Zambian PR assistant being assisted by two high-flying media students from UNZA or NIPA in his office.

Do not forget that it is Wynter Kabimba who first started to drag Amsterdam into our politics. Mmembe then continued to drag Amsterdam into our politics.
