Andrew Banda pleads not Guilty as Fratelli Locci is placed under House arrest

Andrew Banda and Sakwiba Sikota leave Woodlands police station after signing a police bond

Former Republican President Rupiah Banda’s son Andrew and Italian businessman Antonello Locci have pleaded not guilty to charges of corrupt practices involving over 171 million Kwacha.

This is in a matter in which Mr. Locci, a director of Fratelli Locci SRI Limited, a road construction company currently working on some roads in Mufulira and Ndola under the formula one programme is charged for the offence of offering Gratification Contrary to Section 28 Subsection (2) (a) of the Anti-Corruption Commission Act No. 38 of 2010.

And Andrew 52, now a farmer of Chasimpa farm in Chipata is charged with one count of soliciting 2 per cent gratification amounting to K171 million on all payments made by RDA on current and future road construction projects contrary to Section 28(1) paragraph A (i) of the Anti-Corruption Act No.38 of 2010.

The solicitation is alleged to have been done through a written agreement dated June 22, 2011 signed by Andrew and Mr. Locci and witnessed by Mr. Banda’s daughter, Ketiwe.

Appearing for plea before Principal Magistrate Joshua Banda in Lusaka today, the two accused denied the charges.

Meanwhile, Magistrate Banda has set aside the bail application for Mr. Locci and has since placed the Italian Businessman under house arrest on condition that the accused lives at 6 Mpulungu Road Olympia Park and surrenders his passport.

Magistrate Banda further directed that Mr. Locci be guarded by the police 24 hours and that should there be any need of essentials; it must be communicated to the police to facilitate such a move.

The matter comes up on Friday 3rd August for commencement of trial.

  1. let him be in police remand ,why house arrest.just because money has exchanged behind the scene.because all suspects who are not on police bond are in prison.Police should not waste resources on one man.its either he is on police bond or in prison Mr Magistrate.

What is wrong with signing a business deal in which one facilitates a transaction on condition that they are paid 2% of future profits or earnings.I’m very sure GBM does the exact same thing.Go anywhere in the world its done.This is persecution. All PF dreams about is realigning districts,realigning ministers and ministries and going after  Rupiah Banda and the sons he has raised so well.May the truth set the Bandas free.

    • Are you so used to corruption that you can’t even recognize it when its staring you straight in the face? Its attitudes like yours that make us never to progress! I can’t believe you would even dare utter the word persecution. If its done anywhere in the world its called corruption. Only in your book is it called persecution.

You Magistrate you out of order, how can you allow the fugitive corrupt Italian to be under house arrest and be guarded by Police 24hrs, where are we going to get the man power to police this criminal, our Police force is over worked and have limited resources, this is to show that this Magistrate is out of touch with reality. This guy was better off under Police custard. We are watching you Magistrate Banda.
    2 down until all the thieves from this family are brought to book. And you Sikota the law you studied was just about defending thieves, you will also pay.

  7. #1 You are dead on. Fratelli Locci must be sent to a remand prison. There should be no partiality over this matter. The same ruling must apply to Andrew Banda.

  8. K117 million is not that much for a son of a president, just sethim free. It will cost even more money to pay Shakwiba Sikota, the Policemen guarding umusungu (plus baleumfwa bwino ba kapokola, drinking free Italian tea day & night?”

    PEOPLE, LETS START HONKING OUR HORNS IN CAIRO ROAD @12 30hrs for 10 minutes everyday till Chikopa leaves Zed!!!!!
