The Dannish Department of Justice rejects Zambia’s request to extradite Attan Shansonga

The Dannish Department of Justice has rejected the request from the Zambian authorities to have Zambia’s former ambassador to the US Attan Shansonga extradited to Zambia.

This comes as a blow to Minister of Foreign Affairs, Given Lubinda, who on Friday last week said that the government was giving active attention to the extradition of former diplomat Attan Shansonga. According to Mr Lubinda, Zambian officers were currently shuttling between Zambia and Denmark pursuing the matter.

Mr Attan Shansonga, who is now a British national has been in custody for six weeks pending extradition to Zambia. The ex-ambassador was arrested at the airport in Kastrup and detained upon request from Zambia for theft of public funds.

According to the Danish newspaper, the Justice department informed the judge that the Zambian authorities did not satisfy the conditions to allow Mr Attan Shansonga to handed over to Zambia after the assessment of his case.

His Laywer, Tyge Trier, Ritzau confirmed that his client had been released.

“I spoke with my client earlier today and he is very happy and relieved at the release. He will take to the airport this evening and return home to his family in London,” he said.

“It has always been our opinion that this matter concerns a political game in Zambia, and is not an actual criminal case,” said Tyge Trier.

The lawyer also said that he was satisfied with the decision by the Justice Department, but he would have liked it if the matter had been handled faster.

“We must recognize that it is a complex matter, but it has always been so obvious that the conditions for extradition were not satisfied. The matter should have been settled within two to three weeks and not seven weeks,”, said Tyge Trier.

Tyge Trier will now consider whether to raise a claim on account of detention of Shansonga.

  2. Damn, Danm Damn it, there goes my Dual Citizenship up in flames. I hope the authorities will not use this case as the reason to muzzle Dual citizenship.

    I think the PF government are just being dumb about this. There is smith’s conviction in London and am sure they now know where Attan lives.

    Aren’t  there smart people in this Government that can piece those facts together and bring justice to this case without jumping on this extradition and Interpol craziness driven by one unsuccessful Zambian lawyer of all time called Wynter  Kabimba?

    Despite Attan being a British national, surely he can be prosecuted in British courts. 

    Anyway, just don’t touch my Dual Citizenship based on this case.

      I am a keen follower of your contributions on this blog and more often than not your analysis and contributions are of the highest calibre. However on this one you have missed a few key points. A trial of any case can only take place in a country where the said court has jurisdiction and this will often mean the country in which the offence was committed. The Smith case which you refer to may have taken off because the Chiluba case included transactions done in the UK. Unless Attan’s offences where committed in the UK, it cannot take off.

  3. I don’t believe Mr Attan Shansonga is a ‘clean’ man and he should probably have been extradited to Zed. But this case just shows how we behave as a country has wide implication in the bigger scheme of things. Zambia is not an island. All civilised countries will have doubts on sending anyone to Zambia with compromised judiciary and inept govt machinery

  5. But even though Shansonga is a British Citizen, He is a Zambian National as well. In UK you do not revoke you original citizenship in order to become a British citizen be migration. So, Shansonga is still Zambian. Check, when did he revoke his Zambian citizenship. If not his dual citizenship should compel authorities to extradite him. A thief is a thief if its true. Just play your cards well Attan Shansonga can come and answer cases in Zambia.

      Since Zambia does not allow dual citizenship (and I pray they don’t), Attan revoked his Zambian citizenship by implication. This applies to all Zambians who have acquired another nationality.
      However the key point in this case is that any western democracy cannot extradite anyone especially a British citizen to a country with a questionable record on human right, and that includes Zambia. The current situation will make it easy for a Judge to reach that conclusion.

    • YOU ARE WRONG!!! Read YOUR CONSTITUTION!!!! Asper today, he may be born Zambian, BUT HE IS BRITISH!!!! OUR OUTDATED CONSTITUTION IS WHAT HAS ACTUALLY SAVED HIM!!!!!!!!!!

In fact, Britain can Revoke his citizenship if it is established that he had hidden cases when he declare innocent at the time he applied for British citizenship. He concealed his theft cases and obtained British citizenship under false pretence.

  7. Scandinavia never extradite anyone to a country that has the death penalty, perhaps that could have been one of the reasons for the refusal

  8. Well, well, well. A case exists today to test the legal compentecy of PF govt. My fear is the sheer pathethic incomprehensible knowledge on international issues is next to zero. At best Sata PF may declare war with Dernmark. The closest he will arrive at after sleeping over it.

  9. It is so useless to even discuss dual citizenship. The fact of the matter is most Zambian who are out of Zambia have more than one citizenship. Zambia has no capacity to tell who has changed or who holds what citizenship.

    Moral of the story… cherish you foreign citizenship. Zambia has a government which is hell bent to jail anyone who opposes them….

  10. Extradition is always a complex issue and the fact that he has a British citizenship made it more complex, it has nothing to do with the Zambian Government, it is becaude of the EU regulations and extradition agreements they have!!

    So there is no political amunition for anyone and Hon. ubinda was oonly being optimistic, they did their part!!

  13. @The Engineer (Australia) I really would not go it your way of demeaning and insulting. Its not the best option even when you are so annoyed! Keep it cool, learned man! Australia is full of people you found. I do not think they would put it the way you are doing it.  I know there are opposition politics there just like in your original country Zambia. Learn not to use the waste words.  I think and trust that you can be more civil and decent than the way you are portraying yourself. Why not just discuss issues other than calling those who are not of your thinking fools. Its wrong. Raise your ball game man.

See, for me the name you see is my real name, I do not hide and my language is that which I can use to discuss issues with you if we met in person. This is a global village. Australia is a day away from where I am. If you are using your home internet I can even trace you and visit you so that we meet and discuss. If I mean to get to you I can come, make no mistake. Just use good language and do not injure others unnecessarily.

    • I can’t make sense of your comments. One can call a Govt “fools” and that does not imply that any ordinary Zambian is a fool. He is very clear that the fools are in Govt.

  18. Europe and America can not have it both ways. Condemn corruption by public officers as Shansonga and they keep them abroad. Shansonga is a corrupt Tonga man who should be punished to the full extent of the law. On this one I support President Sata to use any means possible to bring this criminal to book. Corrpution, corruption when we want to bring corrput people to Zambia you keep them. Go ahead and keep them.

How unonimous wrong doers can be traced: all internet users are connect by IPS, and your IPS knows you by location, your name and address as subscriber.  A simple google search can also give information about you. So make no shallow mind thinking that you are so unonimous. You can’t keep insulting others just like that, you can be traced and be held to account. Be reasonablewhen using internet. You have human rights but do not forget about those of others.

  27. As RB would call them, Vimasilu. A straight forward case presented by incompetent lawyers. The judge says they did not satisfy the requirements for extradition, not that they did not have a case. In any case the Zambian government has always known where this thug lives and its hypocritical of the PF Boma , a few months ago Sata wanted to appoint the kingpin in the plander of Zambian resources through the ZAMTROP account to some senior position in government. Had it not been for the outcry of our people we would have had a thug in goverment.

  28. Scandinavians and the entire EU protect their citizens to the fullest and never extradite, never…. especially ifya nkongole or theft! Never…. ! If Zambia wants Shasonga, they must abduct him the british style… but then the EU will blackmail Zambia through sanctions. Shasonga made a killing whilst he could and is living comfortably in the EU, has invested wisely, probably is now a member of the Employers Association and paying taxes, in short a bonafide citizen not those undesirable economic refugees on state welfare! Forget it !

  29. There is no way a EU citizen will be extradited to countries like Zambia. Interestingly, of course Zambia would have done better to present its case in EU courts and have the guy prosecuted there. There are milliards of USA citizens that the US refuses to extradite to the UK, even. So, sorry no surprises there. The Eu are spot on on this one, I am afraid.
