Judge Chikopa -Malawian high Court judge chosen to head the Tribunal

Government has said that Malawian Judge Lovemore Chikopa will remain in the country until the judicial review matter in the Courts is concluded.

Three Judges namely Charles Kajimanga, Nigel Mutuna and Philip Musonda have challenged their suspension in the courts of law by President Micheal Sata thereby stalling the sittings of the tribunal appointed to probe them.

Chief Government Spokesperson Kennedy Sakeni said that the nation should not worry about government’s expenditure on Judge Chikopa.

Mr. Sakeni said that the Zambian government invited the Malawian Judge into the country and will out of courtesy take care of him whilst in Zambia.

In an exclusive interview with QFM, Mr. Sakeni said that people should realize that running a government is not cheap.

He said that government needs to exhaust all available avenues for the matter to be handled in a transparent manner.

Mr. Sakeni, who is also Information and Broadcasting Services Minister, said that Zambians should be fair and respect what Judge Chikopa is in the country for.

The Chief Government Spokesperson wondered why the engagement of the Malawian Judge to head a tribunal to probe the judges has become an issue when even Zambians are engaged by other countries for similar tasks yet no eye brows are raised.

Seriously this CONSTITUTION is rendering Zambians toothless, exploited ,exposing them to vulnerability and abuses govt after govt.Will state this again n again! A revolution needed, Two urgent agendas:( 1) Immediately, suspend this barbaric colonial  “CONSTITUTION “which continues to breed bad leaders that are heartless, leaders that oppress citizens and the source of our economic exploitation. Chipoka is swimming in the same corruption that corrupted the very alleged Judges he’s been called to investigate. we already know the outcome of Chipoka’s report-public perception is greater& better than self righteousness. chipoka and PF are deepening wounds of abuse&corruption. Justice ,a cherished Ideal is slowly turning into an abused commodity. Everything we fought for at independence is at stake!! In the strictest sense, Legality or Law is not necessarily LAWFUL. What then is the point of wasting money on this disgraced Chipoka?

Honestly, he has cases and other commitments like family to attend to. He can go back to Malawi and return once we have sorted ourselves out….. only in zed!!!!!!

We are against the extravagance of keeping him in Zambia doing nothing other than getting allowances, eating and farting in 5 star hotels.   11. If this judge is as revered as he should be to take up such a monumental task that will have significant implications for the judiciary in Zambia, then he should be rather busy. Assuming that is the case surely shouldn’t he be attending to other equally important matters in Malawi and other parts of the world. Is the only entry in his diary “Zambian inquiry” in perpertuity…? I also find some comments from our leaders amusing. Surely was it necessary for Sakeni to say the “…running a govt. is expensive.” This reminds me of the MMD days when in the end the public was belittled with all manner of condescendence…….

  13. Chikopo has no sense of proper judgement, does it mean that even he himself can not see that he is wasting tax payers money. If he is a judge wealth his salt, he could seek for leave until pending cases are disposed off, but it now seems he has found a “katemba” to eat from or milk untill he has enough fresh on his body, this is an issue of poverty alleviation on the part of Judge Chikipo. Which poor and retired civil servant like judge Chikopo would refuse free money? The money is busy sorting out his historical debts in Malawi. By the time he goes back to Nyasaland, he would have started on a clean slate of social life, debtless.

If the Govt as stated by Mr. Sakeni is taking care of Judge Chikopa out of courtesy, when the time comes to Chair the tribunal, what should Judge Chikopa do in turn for the Govt of out his courtesy for the Govt’s taking care of him. And there is still more of taking care of him – he will be paid by the Govt for this assignment, how much? Really awkward situation!

    • This is not the issue of legality but logic.
      You can be legally right but logically wrong.
      The question is “what is he doing right now.”
      Can the nation spare the expenses government is encouring  over the man who is doing nothing?
      This issue has nothing to do with ones political affiliation but but sound judgement.

  31. The onus is on the Judge to recuse himself and offer to come back when the appeal is finalised! But then, the Judge is retired and won’t have much to do (retirement package ya pa Africa), eat (Pamozdi serves better food), cashflow (at $600 a day-even I wouldn’t go back), biased (whatever the outcome of the case will lean towards his paymaster).
    On the whol it is payback as Sakeni or ba Saizi might be getting a cut (smooth way to make a buck or two! More commissioners please!

  41. @33 Pixxy, so what will happen if the court rules in favour of the judges? Don’t you see that the tax payers’ money would have been wasted in vain? Will you help to pay back the money then? Malawi is only an hour’s flight to Lusaka and the man can be recalled very easily. Who said the court ruling is dependent on his presence? What if the court decides to postpone the ruling to next year? Will you still advocate to have him in Zambia at tax payers’ expense? Even if you are sympathetic to your PF then use your own money to pay him. No country in world can condone such stupidity.

Any chance that you can run Govt. differently from MMD? You cannot tell the Nation not to worry. You the Governors need to Govern us the TAX PAYERS in the most prudent manner. We have the right to question why the country is paying colossal hotel bills to someone who is doing absolutely no work in this country. The other day patients at Chingwere Clinic were up in arms with their area M.P. for not delivering on his campaign promises of improving the health delivery system. The reason the M.P. cannot deliver is because of this same money you are wasting on an unproductive person. Please,I plead, send him back. Call him when time is ripe.

  44. It is best for the PF party to foot Judge Chikopa’s luxurious living in expensive Hotels. Sata’s govt has never settled for a COVENANT with Zambians to squander tax payers money on third rate unprincipled lawyers. Although the Auditor-General acts on fraudlent misuse of public funds after 2 to 3 years of plunder, the national system will act promptly as soon as PF is no more. This Malawian mercenary must go home, otherwise he will soon be honoured with an appropriate title of PROHIBITED IMMIGRANT when God resores sanity in Zambia.

You chaps need to relies that the Judge was sworn-in; you can’t just put him on the plane to Nyasaland and call him again when needed and swear him in again, you know it doesn’t work like that.Remember the judge has been sworn in like any public servant, lets be rational in the way we post comments. 

    • @ Maxwell remove the picture of Fat Albert as he more sound than you are. Even public servants can go on leave or something like that; they are not glued to the position. It is not like if he went to Malawi to save Zambians tax payers money then he would be un-sworn. Be rational yourself!

  46. @50 Maxwell then let them spend your money. Your argument does not hold water. What happens when a judge who has been sworn in goes on leave, is he sworn in again when he comes back from leave? The answer is no. Chikopa will not need to be sworn in again if he went back to Malawi and return when it is necessary for him to do so.

  47. By this courteous treatment, the judge is already considered compromised and cannot be taken to be impartial hence forth. Don’t lawyers have such objectivity impairement risk fatcors in their professional code? The moment you receive some favours out of grace, you must be deemed non-independent because you depend purely on the goodwill of the one giving you favours. Ccita!

Get your acts together and stop treating Zambians like they are not learned enough to put 1 and 1 together. Couldn’t he honestly have gone home and waited until the conclusion of the court proceeding? Suppose, the court finds that, it is illegal for the Govt to conduct this tribunal, what next for the Malawan judge?

The university which awarded him the law degree should revoke it for his total failure to reason and practice law, furthermore the Malawian government should out of reason and honesty revoke his law practicing license.   51. This is an issue that should be raised in Parliament. The MPs should demand to be given a report on how much has been spent so far on keeping our learned friend in the country and to explain his continued presence. After all, that is why these guys are elected into office.

  54. I’d place the blame on both parties. For the administration it is arrogance writ large; how can they squander away tax payers money on such an ego trip? Also that’s the curse of Africa; in the developed world no professional (not even a plumber) would accept to get accommodated and paid for just sitting around doing nothing; they’d long have refunded this dysfunctional administration the allowances and gone back to earn a productive living.

    That’s a very Ukwatic statement. If PF itself is meeting the bills that’s fine by me. HOWEVER IF GRZ IS MEETING THE COSTS OF EXPENDITURE, WHICH IS OBVIOULY THE CASE, I HAVE EVERY RIGHT AS A TAXPAYER TO BE CONCERNED FOR FINANCING WHAT IS NOW A VACATION FOR A FOREIGN JUDGE.

  58. If Sata was a serious president Sakeni would not last in his position as spokesperson. Sakeni exhibits a very high degree of ineptitude such that even a grave 5 pupil can tell the minister’s lack of wisdom. You don’t comment in the manner Sakeni has done on issues that border on the use of public funds. How can he say, “we are taking care of Chikopa out of curtesy because we invited him”? The question is whether the purpose for which he was invited still exhists. If not, then we see no reason why we should be courteous. We are talking public funds going to waste indiscriminately. This government is so arrogant and undiplomatic in the way it is responding to public outcry. They are forgeting that we are the ones that vote and 2016 may seem so far away but its not. Watch this space!
