Pastor didn’t know obscene materials in his house were prohibited in the country

A case in which a 40-year-old pastor in Nakonde district of Muchinga Province is charged with one count of being found in possession of obscene materials has taken a new twist after the pastor applied to change the plea.

This was after the Police Prosecutor Oscar Phiri, presented a letter of consent from the Director of Public Prosecutions (DPP) in Lusaka allowing the court to proceed with the matter.

This is in case in which Pastor Charles Nsemu of Katozi compound in Chieftainess Waitwika’s area is facing one count of being found in possession of DVDs suspected to have pornographic contents that are likely to corrupt people’s morals contrary to section 177(1) (A) chapter 87 of the laws of Zambia.

Pastor Nsemu changed his plea yesterday from not guilty to guilty when his case came up for trial before magistrate John Kajiko Njapau.

On August 13 this year Pastor Nsemu pleaded not guilty to the charge and the case was adjourned to November 5 for commencement of trial.

Pastor Nsemu was arrested by the Drug Enforcement Commission (DEC) officers on August 12 at his home with the said Obscene materials following a tip from members of the public.

Asked why he had in his possession the prohibited materials shortly after taking a fresh plea in which he has now pleaded guilty to the charge, pastor Nsemu said he did not know that the materials he had in his possession were prohibited.

“Your honour I didn’t know that the staff I was using was prohibited,” said Pastor Nsemu.

Magistrate John Kajiko Njapau has since adjourned the matter to tomorrow for written facts and sentencing.

  1. I thought the material was in his house and private . Is this really breaking the law?
    Nation of Hypocrites. Anyone, especially, those with smart phone, computers and IPADs or Tablets, be the first one to cast a stone on this pastor if you have not accessed obscene materials with your device. Anyway with the Internet has potentially got access to obscene material. What does the law say on that? 

  2. These are modern day pastors. Pastor watching ponographic material…… I propose we start regulating the mushrooming of these pentecostal churches. I think a law should be introduced to make make churches start paying tax and their activities should be of charitable nature which should be reviewed and monitored regularly. Any church found not adding value to the community should be deregistered. Most of the pente pastors are taking advantage of the vulnerable and suffering people who call on them for help. In turn they demand, sowing of seed and giving of tithes if one wants to be blesssed.

    • What makes you think that only Pentecostal pastors are watching such stuff?
      Are you aware of what goes on in Catholic Churches? Are you aware of sexual abuses going on?
      Are you aware of about ions going on?
      You seem to be anti-Pentecostal and your views are not balanced.
      You can condemn the act but don’t condemn the whole Pentecostal movement.
        

  3. The pastol surely knew that the materials he had were a moral hazard and keeping them was not in order more so that he is a man of God who preaches morality and salvation. The court should make an example of him.

  4. # 2 I agree with you some of these churches must pay tax unless it is really proven that they have good social responsibility plans for the communities they serve. Thay must support at least a school a clinic etc like Salvation Army, Catholics and SDAs do. The rest are just brief case churches meant to enrich the so called psators. Besides these pastors are school drop out who have failed to go to university or college…simple crooks they are!

    • The line up of churches you have made have a lot of skeletons in there closets while hiding behind social responsibility. Better to keep quiet and leave GOD to deal with some of these things.

  7. The Born again pastors are all fake. Just look at the cars they drive, the suits they wear, the shoes you name them. Tax them ,as they crooks

    • I am sure if Jesus was living in this era he would drive the same cars and put on suits. Why ride a donkey in an era of vehicles. Why pretend to live poor among the flock when back in your village you have invested heavily. Why put on gowns in an era of suits. Gowns or is it some shapeless long attire were the norm then.

It is interesting, first of all how does this material corrupt people’s morals if the pastor was using it himself, In his sentence he said ” Your owner I didn’t know that the staff(sic) I was using was prohibited,” The pastor does not say the staff we were using. Therefore who would have had the potential to have one’s morals corrupted. The Pastor man of God does not preach that in his Church, it was only for his own self knowledge. How did the people know that the pastor had this material?Are they the one’s he planned to corrupt their morals? If this was for the pastors eyes only then it means that he should not be arrested i thought this law applied to publicly produced materials. Anyhow all these materials are prohibited in Zambia.

  9. Technology is throwing up a lot of ethical and privacy issues here. If DEC raided the pastor’s property without a cleared warrant they actually trespassed and are liable (unless the law in Zed is so draconian that DEC can walk willy-nilly anywhere!??).  Other than that you have the contradiction of a borderless Internet accessibility versus national laws. Hypocrisy is now the order of the day and just like car reflectors on cars which already have them, it will become a formality way of earning money through fines!  THINK ABOUT THAT.

    • ya the car reflector issue still puzzles me. Why put those paper reflectors when the rear lights of ‘modern cars’ have inbuilt reflectors. I think it is an issue of enforcing colonial traffic laws when cars then didnt have inbuilt reflectors

  12. Amazing that people have chosen to play the devil’s advocate. This one is a pastor for that matter. Let’s just say that we do wrong as imperfect beings. But we must not glorify wrong things. All of us who have been watching are wrong. The man was exposed by God. There is no guarantee that these materials were not going to end up in someone else’s possesion, like how did the people who reported know? Iris fined K10m, let me just plead guilty.   13. No 7, if the Pastor had said that was the reason he was in possession of the same, he would have had a chance to defend himself. If, however, he was only using it for self- gratification, then there is a problem.

  16. i like the morality expressed by the bloggers. I just pray that it is well with all of us because the example with this Pastor is just pointing us to Christ that we repent. It does not pay to hide and seek.

  17. Pastors of nowadays are of questionable character and a big joke really. Poverty stricken and they form tutemba churches to collect umutulo. Even the so called bishops are businessmen. Wake up people and do not give away your hard earned money to these people.

Lets not be so judgmental on the Man of God. Just like Jesus Christ said, “he who is of without sin let him be the first one to throw a stone at this man of God.”

    The Question we all need to ask is how did they come to know that he is in possession of that material? has he been showing the public? if so then he has a case to answer but if it was for personal educational purposes then he has no case to answer. In fact he has a very strong case against those who arrested him because they intruded into his private life. Even those people that arrested him also watched the same which makes them accomplices.

  22. The pastor was given away by the lady he was watching with, in the name of teaching her how to please her man later, but the deal backfired when he wanted to practice with her!
