Police unconditionally free UPND Lusaka Province chairperson, refer all queries to Mutembo Nchito

United Party for National Development (UPND) Lusaka province Chairman Adrian Bauleni who was six days ago charged with the murder of Patriotic front (PF) member Crispin Menyani Zulu, has walked to freedom.

Ambassador Bauleni 66 of Lusaka’s Ibex Hill Township was unconditionally released by from police custody on Thursday evening.

He was on Friday last week charged together with four others for the murder of Mr Zulu who died in Rufusa.

But Ambassador Bauleni has since been unconditionally released giving an indication that he had no case to answer.

UPND Secretary General Winstone Chibwe confirmed the release of Ambassador Bauleni on Thursday.

Mr Chibwe said that they were no conditions which were attached to the release of Ambassador Bauleni but said it was an indication that the UPND member had no case to answer.

“Yes Ambassador Bauleni was released yesterday evening and we were not given reasons for his release but one thing you should know is that police can charge a person but it does not meant that is the final position, anything could happen before he is taken to court”, Mr Chibwe said.

And UPND lawyer Martha Mushipe said in a separate that she was not present at the time when Ambassador Mr Bauleni was being released but only got information that her client had been set free.

Ms Mushipe said she did not know the circumstances that led to release of former Ambassador because she was not present and was not communicated to by the people who set him to freedom.

“As a lawyer to Mr Bauleni, I don’t even know what transpired to the release of my client because there has been no communication with me. At the time police apprehended Mr Bauleni, if they knew there was nothing, why did they act that way because my client is now traumatized,’ she said

Ms Mushipe said it was not right for police to have charged Ambassador Bauleni with murder and release him before the case could go anywhere without proper explanations and communication.

But when contacted for a comment, Ms Kasosa referred all queries to Director of Public Prosecution (DPP) Mutembo Nchito.

Ms Kasosa said the role of the police was to investigate and charge of the suspects and therefore hand over to the DPP who was supposed to prosecute the case.

  1. If the Police did not have any credible evidence why did they push the matter to the DPP for prosecution? Ms Kasosa seems to be passing the buck.

    • It’s not intellectual bankruptcy, it it lack of morals and integrity, Chikeanda is actually a good example himself. Corruption syndrome and mindsets. 

    • There is no place like home. It’s easier to say this when you are just getting into you prime. Home is home, but good luck if and when you achieve your desires.

  3. Menyani if he had any relatives they need to take this case seriously.

    Ask yourselves, is this what you wanted for your son? They kill him and use his death to score political points? Did they have any value for his life when he was being used to cause violence?

    Get PF to answer you honestly, for the sake of your lost one.

    • And hopefully justice catches up with them when they answer…they should never take people who are determined to get justice  for granted.

    • Justice delayed is justice denied, yet Jesus Christ died and forgave us for our misgivings. If we cannot accept forgiveness as humans, then we have no reason to be called God’s children. Forgiveness is a gift from God.

  4. Just thank God he is out. But he must go into exile immediately because Sata may murder him at home. Remember we are dealing with agents of hell. Don’t expect justice. PF will kill and no one will say nyoo.

    • Iwe kapanga, Sata has already shown he’s patient and reasonable contrary to the perceptions of the few. He is Commander in Chief and has all the services at his fingertips. If he want them *****s, it only takes a few steps. Don’t misconstrue kindness for weakness. Sata has behaved in a way that everyone of us is shocked about. We thought he was gonna go after them children like Hakaivotela Humwine, and the false prophet in “Kano nga ebo mumba.”  Micheal Sata is nobody’s fool and he’s gonna kick bemba, ngonis, mbundas, lozis, lambas together without even thinking about it. He has been in politics before and after independence and if anyone wants to start a fight with the king cobra, then be prepared for the wrath.

  5. And the political nonsense never stops. First, we are told that, Bauleni is a suspect. With a matter of days, we are told, Bualeni has been pick up to “assist” with investigations. Without any care to the suspect or the deceased family, the police tell us, Bauleni and a couple other people have been charged with the murder of the PF cadre.

    Please, will someone tell the police that, charging anyone with murder is a serious issue. You can’t be charging poeple with murder without clear evidence. Besides, it seems, or atleast by reading this article that, DPP and police are neer on the same page.

    This is so embarassing! What is going on with our legal system?

    If I were Bauleni’s lawyer, I’d be seriously considering suing the government. This is a circus.

  7. We Zambians must something from Abassador Bauleni saga. Under PF you can be accused of a crime that you did not commit. We thank the judiciary who saw this as it is. A politicall fight between him and Sylvia Masebo. But she already MP, no need to fight. First she bribes MMD Mwakalombe by giving a position as ambassador to Mozambique. Creating a bye election, then she wins but Ambassador Bauleni is like a shadow she cant run away from him. Cant wait for 2016.

  10. There could have been some intervaton from his daughter Mable Mungomba who works in the DPP Office. Muntembo Nchito was scared of the legal battle ahead hence the dicision. This Ukwa is fond of ordering police to do wrong things with promises for promotion like the Mugabe way. There is no evidence but if it was somebody without connection, he would have perished out of ignorance . Police have been reduced to PF vigilantees but days are numbered. Its our prayer that this Ukwa is taken by the almight God before he kills all political oponents. Even this lady Kasosa with all her experience with the UN is slowly been reduced to a robort so as to be promoted dubiously like the useless and fake Dr Jere. Gentlmen days are numbered and this Ukwa will not be there to witness your suffering.

Even the gentleman who was accused of this has been freed, which means he is innocent, no substantial evidence. Bloggers think before you say anythng, ukulandalanda fye tekusuma. The police should investigate this murder and bring the culprit to books, we are watching this space for the police to solve the puzzle….Bwana Jere show us what you have got, we cannot have criminals killing people becoz of their political views, or is there something more than what meets the eye here?   13. The police operate professionally within the confines of law. According to judjes rure no. 1 gives power to the police interview ANY PERSON WHETHER SUSPECTED OR NOT and during that interview he’s warned and cationed,UPND lawyer knows that. She is ignorant that the police do not report to lawyers during their operations. I pray that the actual murderers will face the law

  14. The decision is that the DPP has declined to prosecute the suspect, who happened to have been a Mr. Baulen ( a senior UNPD member). Reasons pertaining to the refusal to prosecute could range from insufficient evidence or due to tempering of evidence or contaminated evidence. Mr. Bauleni still does have legal recourse in that he can bring about charges against the Minister of Home Affairs for false arrest or wrongful detention. His human rights such as the freedom of movement, freedom of association etc. were disregarded by the arresting officers on the day in question. He must also added civil charges on top of criminal charges against the employer of the arresting officers ( the Ministry of Home Affairs) and also against the foot soldiers.Viva my brother HH, one blood and one family,UNPD

    • What has one blood gat to do with this case? I liked the way you brought out the facts, but the ending goes into blood again, see bringing out tribal sentitments. Huh, The DPPoffice is for all Zambians and the stand the office took in this case of Mr. Baulen was very professional and non partisan, tells us that UKwa as you call him has no interference in the judicial system. Yes Baulen can go ahead and sue now for damages, that’s his right. As for the Police, let them hunt down the real killer now, thats their real job now. There is a criminal moving around, no man, woman and children are safe now, find him/her let them face the law.

The argument here is not about the police’s conduct in terms of interviewing a suspect or a witness and informing the aforesaid about their legal rights before they are interviewed or informing their legal representative/s about their/his/her clients would be police interview, but the act of effecting an arrest of a citizen whose level of involvement in a criminal act is not clearly defined in relation to the evidence held the first arm of the criminal justice (the police) is the cream of this discourse. It is clear that the arrest of brother Bauleni is a product of a discursive construction concocted by the headless mulfunctioning PF regime in a desperation to discredit my brothers and sisters. PF is just a blimp on our radar screen and it is a non-entity.

  16. We are also worried about the other suspects who are still in custody. With such latest develoments we can only hope that the state evidence has collapsed so far and this circus should come to an end. This vindicates our consistence that these pro Sata detectives have been concocting evidence all along, not building up evidence against the real perpetrators of the criminal act itself. Let the other suspects be freed so that they can rejoin their own families and their UNPD comrades in lieu of languishing in stinking inhumane prisons. Viva comrades, viva UNPD

  19. The culprits who killed Zulu are well known, but the PF chose to accuse the innocent souls. The credible truth emerged immediately Zulu was murdered, when the Police attributed his death to PF intra-party squabbles as they shared the money. It was premature for a Republican President of all Zambians to point fingers at the opposition and order the Police to arrest anyone at random in the vicinity of Rufunsa. It is high time PF cleaned up its own mess to correct its morals. The killer of Menyani Zulu is in their own midst, and a special team of well-trained CIDs can easily apprehend the killer. Every Zambian has a right to his/her life.
