PF has no hand in the implemention of the Public Order Act-Kabimba

The Secretary General of the ruling Patriotic Front (PF) Wynter Kabimba has denied assertions from some quarters of society suggesting that the party has ‘an invisible hand’ in the recent enforcement of the Public Order Act.

Mr. Kabimba reiterated that the party and government have no role in the application of the provisions of the Act which has led to the arrest of some opposition political party leaders for illegal assembly.

He explained that the Public Order Act, which Zambia Police Service is currently using, has been there even when the PF was in the opposition.

He said he therefore does not understand how an independent and professional body mandated to maintain law and order can consult any political party on the application of the Act.

Mr. Kabimba, who is also Minister of Justice, was speaking to Journalists at the party’s youth and media centre in Woodland last evening.

He disclosed that his party worked hard in the opposition and later formed government when the Public Order Act was already in effect.

He said the PF members ensured that they always abided by the law to avoid causing the breach of peace in the country.

Mr. Kabimba has since advised the opposition political parties to either go to court if they are not happy with the way the act was being used by the police or adhere to what the law stipulates to avoid being arrested.

He reminded the public that abrogating the public order act was a crime adding that politicians who are arrested for disobeying the act will not be called heroes but criminals.

“You will only be called a criminal if you are arrested for abrogating the public order act and not a hero. The Police will arrest you as many times as you commit the crime. And if you are not happy with the way the police are using the Public Order Act, go to court and don’t blame the ruling party for your problems,” he explained.

Meanwhile, Mr. Kabimba has advised opposition political parties to work hard and stop complaining if they are to win the hearts of Zambians as his party did.

He noted that it was only through hard work that the opposition can gain ground adding that blaming the ruling party will not earn them the votes they want.

He said when the PF was in the opposition, its members went to all parts of the country especially in villages to convince people and not in markets to cause confusions.

The PF Secretary General said Zambians want a strong opposition party to offer checks and balances and not a mere critic of government on issues that do not concern all Zambians.

Mr. Kabimba is however happy with the popularity his party is enjoying countrywide saying Zambians are in love with the PF and its government.

He noted that almost all Zambians are supporting the ruling party because it laid a strong foundation when it was in the opposition.

He said the PF government will maintain the popularity by implementing projects they promised the people of Zambia such as constructing strong roads and by fighting corruption so that all Zambians benefit from the country’s resources.

Commenting on the deportation of foreign nationals by the Ministry of Home Affairs, Mr. Kabimba wondered why the opposition were protecting foreigners who were a danger to their own people.

He noted that it was illogical for a well meaning Zambian to protect individuals who are inimical to the country adding that the deportations are made in the best interest of the country.

He said deported individuals should not resist as they are taken back to their country of origin, a thing he said should make them happy to return home.

May be we need to help president Sata to re-define Kabimba’s duties both in government and party

    • Summer is a lawyer who is on record to have never won a court case…so, it will be asking for too much to expect him to perform as Justice Minister because his calling is somewhere else..

  9. Kabimba do not lie and PF must thank RB for ignoring the existence of the public older act when he was president. Serpent Cobra Ukwa Sata CNP was allowed to hold rallies from day one of his losing elections in 2008 and what is PF in government doing, the opposite. I don’t claim that Zambians love PF no in fact they are losing interest in PF fast because PF is not fulfilling promises. The public older act was one, then constitution, more money etc and all the promises to be fulfilled in 90 days. Zambians must be regretting voting for PF and Kabimba’s days of sorrow are coming soon and will not pity him. You were let loose when at LUDC and now as a bogus leader will deal with you when Zambia withdraw power you abusing. I pity you cos the HIV/AIDS you has suppressed will be full blown.

    • You have a parochial view of what it was like being in opposition under Rupiah. MMD used every tactic to stop/frustrate the PF wave. The POA was used irrationally and with impunity and on many ocasions PF leaders and cadres suffered.
      The only thing that MMD and Rupiadh could not stop was uthe robust organisation under Michael.
      The opposition must get over this POA issue and mobilise the people like PF did.

As for the status of the opposition, they have already won the hearts of the people. They are doing just fine in spite of all the efforts by PF to disturb their programmes.   12. The condition has a medical term A.R.D which stands for AIDS RELATED DIMENTIA. Sadly he is not the only leader suffering the the ravages of this sad condition although his is pretty serious. In such cases its only a matter of time before he does something really obvious like runs butt-naked on the streets or such.   13. Talking sense…Morons in the opposition always need someone esle to think for them. Go to court if the application of the POA is wrong. The opposition must ask themselves this question: how do political parties in countries were it is not possible to hold rallies campaign? For example you cannot hold a rally in minus 30 degrees.

      First and foremost its unwise to call people in opposition as morons, these people put checks and balances in the governance of a country. Most of these leaders will totally rape the country in the absence of opposition. The countries you are referring to with minus 30 degress temps are mostly in the northern hemisphere and the majority have developed economies including communication infrastructure meaning that you do not need need to call a rally to reach thousands of people. Tell me how else you can reach the population of Kalingalinga, Mandevu, Chaisa without calling a rally. If you give them leaflets, most of them can not read and will use them as shinda paper.

    • Anything that starts on a plafform of anger, hate and envy (which was sadly MCSs real motivation), soon reflects just that when it succeeds. It is a vipers nest with very deranged angry people biting each other in full view of the world. What a tragedy.

  21. Much as most people may not like Kabimba for various reasons, I tend to look at the substance and objectivity of his statements.
    The opposition in general & the MMD in particular should stop crying about the POA but get organised. Who can cross over and support the opposition in their current state? What can the opposition offer the Zambian people today in their current state? Agony…
    The POA is law and must be enforced. You break it you will be arrested… It’s that simple!
    Much as we may not like it (POA), we have to abide by it as long as it remains in our statute books or we amend it, unless we want to be like Americans who s.tupidly cling on to their second amendment despite so many senseless killings with guns

    • The application of the POA is what is being called into question. How do you explain the blatant disregard of the POA by the Winter when he stormed the ACC offices with a hoarde of PF cadres or the protest against Lubinda by cadres who marched to State House without police sunction??????

  23. I am beginning to suspect that part of the requirements to become a lawyer in Zambia is to be an empty can. A rusty one for that matter. You all remember Eric Silwamba? We got this same arrogance from Eric during the first ten years of MMD in office. Then came late VP Kunda. LPM did not do much to improve the image either. To that list add two lawyers I fired for bungling clear cut deals. Recently, I fired a supposedly top flight lawman for failing to conclude three simple transactions. What’s going on at ZIALE?

Sad to note. in zambia people like lawlessness. we all know that there is a law preventing people from urinating in public or law against drunken driving and a law against illegal assembly. if the law enforcers were not effective in the past, we have a working govt now. enforcing the law. why are people crying foul. every man will condemn defilement, but if a defiler is caught & punished, he will start saying the law enforcers are brutalising him. comeon, we just have a working govt.
