Masumba found with a case to answer over the NIPA certificate

North Western Province Minister and Mufumbwe Member of Parliament (MP), Steven Masumba, has been found with a case to answer in a matter where he is accused of obtaining pecuniary advantage through false pretences by a Lusaka Magistrates’ court.

Magistrate, Wilfred Muma, who has since put Mr Masumba on his defence said he considered the evidence brought before the court by the prosecution team and was satisfied that the state had established a prima facie case against Mr Masumba.

However, Mr Masumba’s lawyer, Mutakela Lisimba, asked the court to grant the accused person at least a one month adjournment so that the defence could have enough time to prepare.

As the state prosecution team from the Anti Corruption Commission (ACC) could not ague any more, Magistrate Muma later set March 11, 2013, for the commencement of defence in the matter.

This is in a matter where Mr Masumba, 31, of NAPSA Housing Units, Ibex Hill, is charged with one count of obtaining pecuniary advantage by false pretences contrary to Section 309 A (2) c of the Penal Code as read together with Section 41 of the Anti Corruption Commission (ACC) Act number 42 of 1996.

It is alleged that Mr Masumba on dates unknown, but between December 2005 and August 2008 in Lusaka did dishonestly obtain employment for himself as an Accounting Clerk at the Lusaka Business Technical College (LBTC) by falsely pretending that he held qualifications of Accounting Technician when in fact not.

Earlier magistrate Muma told the Anti-Corruption Commission (ACC) which is prosecuting Masumba to put its house in order saying there was gross disorder at the Commission.

“Why do you come late for your cases?” asked Mr Muma.

But State prosecutor Macqueen Zaza told Magistrate Muma that the ACC prosecutor who was prosecuting the matter was indisposed and that he was there to represent him.

Magistrate Muma then directed Mr Zaza to convey the message to his colleague that “you are perceived that you are not in order at all.”

    • Mushota if you’re 27 and have all of those qualifications you claim to have, then you had them printed in either Matero or Lagos! Here are the minimum durations of study for “your” qualifications;

      Bsc=3 yrs ( min)
      ACCA= 3 yrs (min)
      MSc=3yrs (min)
      CIMA=3yrs(min)
      MBA=2yrs( min) + min 3yrs work experience
      Prostitution=10 yrs (assuming you started at a legal age). And even if there were to be a period of concurrency for any 2 of the above you needed to have completed your high school at the age of 13!! What a joke?

  4. Why do we have leads who have cases to answer?? Musamba, kabimba, GBM the list goes on. These people should step down on moral grounds. The government should suspend all MPs/ministers with cases to answer till they clear their names in the courts of law. I suggest we put this in the constitution

    • Tawakwata amano iwe! Those people are innocent until proven guilty. Besides why have those accusing Musamba waited this long to question his qualifications? He has been around all this time and now just because he is an MP people start making noise. He was wrongly awarded the certificate and that is not his faulty. Just shows how low levels and incompetent people we have running the affairs of those institutions!

    • Why leave him alone?? His a cheat and doe not deserve a public office especially that of minister. Let him produce evidence then we shall leave him in peace otherwise we shall leave him in peaces. Who were his classmates?? Any graduation photos in a gown?? does the academic department have records of him graduating?? Lets see his full transcript, Does his name appear on the list of graduate from that school in that particular year ??

    • Mushota, what is to fodge? If you meant forge then I wonder how your PhD is coming. I bet the review board will have no hair by the time they reach page 2. I know people don’t speak English in Scotland but please buy a dictionary for your reference. You may also try to join a Grade 3 spelling bee competition to learn the basics. Feel shy mwandi.

      What is your first degree and where did you get it? Your MBA is from which Uni? I am trying to understand your background seeing that your grammer and reasoning are so flawed. Backgrounds matters a lot and it tells why some people do certain things.

    • No one except Sata. These are desperate people with nothing to offer Zambians but to make a name for themselves that they also became presidents of Zambia.

    • Of course Sata would win! But only because we are so docile and easily swayed by a “dangling carrot” and empty promises. This very case is an example of just how desperate and poverty stricken we are. How do we as a nation accept, never mind electing, such characters as our leaders?   14. A UK MP resigned his ministrial position soon after being implicated in a an offence in which it was alleged, at the time, that he allowed his wife to take his penalty points for speeding. An offence that he has now pleaded guilty to and as a result he has also resigned his MP seat. None of these issues were forced upon him but they are merely standard expectations from serving MP’s never mind ministers. Now look at this one… He will want to serve even with a conviction (if the LAW prevails) come what may. But I don’t think we’ll even get there as the PF will not allow that considering the kind of money they spent on securing this seat.

      At 24 ACCA + MSc
      At 25 CIMA ( with exemptions after ACCA)
      At 27 MBA and embark on PhD

      No working offcourse because it can be tight

  16. Two high ranking German ministers have resigned their posts in the recent past when their universities confirmed that they had plagiarized their dissertations. They, at least, made an effort to even do their PhD studies. Here is a Minister hanging on like a tick even when this case was running its course as he greedily ran for election of a parliamentary position. Is this why we are losing perceptive capital and blaming shadows for our failures? We, indeed, deserve the leaders we elect…

    • yes read about that one. Can never happen in Zambia though. This case will die, just look at the way the ACC are behaving; coming late to court.

    • Can citizens petition the resignation of minister on moral grounds and or seek industrial/labour law internvention through the ministry of labour? HR experts please help?

  21. Oyaya please be advised what is refered to as oxford brooks is Oxford Brookes University, the same ”oxford university. These are one and the same university.

    • Oxford Brookes is not the same as Oxford University. Oxford Brookes used to be Oxford Polytechnic until sometime in the 90’s when John Major, as Prime Minister, allowed Polytechnics to change their status to university status.
